MICHAEL WMI=, CHIEF IINM20M DATE: June 21, 1988 SUa7ECT: Approve Agreements with Pacific Gas arra Electric for Relocation of Gas Facilities for the Wildcat and San Pablo Creeks Project, Flood Control Zane No. 7 arra Drainage Area 73, (#7527-6D6618, #7567-6DB633) Specific Request(s) or Reecumendation(s) & Background & Justification I. 1=014YENDATICK ACTION APPROVE the agreements with the Pacific Gas and Electric C upany, AUTHORIZE the Public Works Director to execute agreements for the relocation of gas facilities and for the deferral of the contribution in aid of construction, and DIRECT the County Auditor-Controller to issue a purchase order to Pacific Gas and Electric Company for the gas facility relocations in an amount not to exceed $80,783.00 and to prepare a warrant to Pacific Gas and Electric in the amount of $66,775.00 as partial payment of the purchase order. II. FINANCIAL IMPACT By the terms of the agreement, the Flood Control District is required to pay the estimated relocation costs of $66,775.00 prior to the commencement of the work. The costs are reimbursable from the California Department of Water Resources at the rate of 75.38 percent. III. REASONS FUR ON/BACFUF0IND By Order of the Board of Supervisors, dated June 17, 1986, the Flood Control District approved an agreement with the Corps of Engineers the terms of which require the relocation of utility facilities for construction of the Wildcat and San Pablo Creeks project. The required relocations include the facilities owned by Pacific Gas and Electric described in the agreement. Upon completion of the work, the Pacific Gas and Electric will provide an accounting of the actual costs of the relocation. Subject to a determina- tion by the California Public Utilities Commission the District may be responsible for paying a contribution in aid of construction. Pending that determination the contribution can be deferred until September 10, 1989. The purchase order will encumber funds to pay the contribution as necessary.
