SUBJECT: Recommendations that the Board of Supervisors Affirm its Support
of the Proposed Acme Landfill Height Extension and Lateral
Expansions to the San Francisco Bay Regional water Quality
Control Board, and to Request the Regional water Quality Control
Board to Continue its Hearing on the Matter. ( Item 2. 13 ,
Supplementary Agenda, Superseding Item 3 . 2 )
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1 . Recommend that the San Francisco Bay Regional Water Quality
Control Board and the U.S. Army Corps of Engineers act
favorably on Acme Fill Corporation' s application to allow
the Acme landfill to be extended to approximately elevation
l5 feet and expanded by about 24 acres.
2 . Recommend that the San Francisco Bay Regional Water Quality
Control Board continue its hearing on Acme Fill Corpora-
tion' s request to extend the life of the Acme landfill. The
hearing is now scheduled for 10 : 00 a.m. , Wednesday, June i5 ,
1988 . The Acme Fill Corporation proposes a continuation of
approximately 30 days.
3 . Appoint a Supervisor to present the Board of Supervisors '
recommendations to the San Francisco Bay Regional Water
Quality Control Board.

BACKGROUND
Acme Fill Corporation' s application to the San Francisco Bay
Regional water Quality Control Board (RWQCB) is described in
their attorneys ' (Gordon, DeFraga, watrous and Pezzaglia) letter
to the Board of supervisors, dated June 9 , 1988 ( Item 3 . 2 ) . It
was submitted in response to the Board of Supervisors ' request to
the Acme Fill Corporation on March 8 , 1988 . At that time, the
Board of supervisors directed staff to wri e to the owners of the
three operating landfills in Contra Costa 'ou to sk them to

consider obtaining extensions and expansions of their facilities
to provide short-term waste disposal capacity while a long-term
solution is being resolved. The Acme Fill Corporation is the
only landfill owner which has formally taken steps to expand its
facility.
Approvals from both the U.S. Army Corps of Engineers and the San
Francisco Bay RWQCB are needed to accomplish the landfill expan-
sion proposed by Acme. The RWQCB_ approval is a matter of first
concern because the RWQCB is scheduled to consider the applica-
tion at its June 15 , 1988 , meeting ( starting at iO : UU a.m. this
Wednesday) . The RWQCB staff is opposing the Acme proposal. (The
Board of Supervisors has received a letter from the Audubon
Society opposing the expansion. ) Acme representatives and County
staff are recommending a continuance of approximately 30 days to
enable the proponents to prepare additional information and to
organize additional support from cities and other units of gov-
ernment.
if possible, the County' s position should be presented to the
RWQCB by a Supervisor because the RWQCB is a policy board.
The RWQCB does not have direct control over the proposed 15 foot
height extension in this case, but it does control the duration
.that this particular area of the landfill can operate and,
therefore, the feasibility of the height extension. The RWQCB
does directly control the lateral expansion of the landfill in
the 24-acre area between the eastern edge of the landfill and the
federal flood control levee on the east. it also has control
over another unfilled 8-acre parcel cut off by Waterfront Road
near the landfill entrance which could take a small amount of
refuse if allowed to.
much of these 24-acre and 8-acre areas are technically diked
wetlands and are under state and federal jurisdiction. Although
they are essentially dry most of the year, their filling probably
would require oft-site mitigation.
The height extension and the 24-acre and 8-acre expansions are
covered by the 1983 Acme Landfill Expansion EIR/EIS. The height
extension and the 24-are expansion are both covered by the orig-
inal 1958-60 landfill land use permit. The 8-acre expansion
probably would require a land use permit.
