June 2, 1988 co 1� SUBJECT: �+ Legislation: Senate Bill 2869 (Keene) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND .AP[:) JUSTIFICATION RECOMMENDATION• Adopt a position in support of SB 2869 by Senator Keene which would reimburse the County for the costs of housing a person who is sentenced to State prison and who is entitled to credit on their State prison term because of the time spent in the County jail. BACKGROUND: Under existing law, a county is entitled to reimbursement from the State for certain costs incurred in connection with State prisoners. The Sheriff reports that SB 2869, which has been introduced by Senator Keene, would authorize the county full reimbursement for prisoners who have been convicted, but are awaiting the processing of commitment papers. In an average month, the Sheriff has 55 such commitments awaiting transfer to a State prison. These individuals remain in custody an average of four weeks waiting for the Superior Court to process the commitment papers. At the current State-approved jail rate for the main detention facility of $48. 43 per day, the Sheriff estimates that the County could receive $958,914 per year if SB 2869 were enacted into law. The Sheriff recommends that the Board of Supervisors strongly support SB 2866 and this office concurs in that recommendation.
