GREEN) WITH AMENDMENTS - "IN-HOME SUPPORTIVE SERVICES" (JUNE 14 , 1988 AGENDA) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION' RECOMMENDATION• That the Board of Supervisors adopt a position supporting SB 1794 (C. Green, et al) - with amendments to define the expansion of protective supervision and to ensure funding through the Budget Act for such services in the In-Home Supportive Services %.program; and, Further that the Board authorize the chair to send letters to the County's legislative delegation outlining support for SB 1794 as amended. BACKGROUND: Existing law provides that In-Home Supportive Services include protective supervision for aged, blind, and disabled persons. SB 1794, as originally proposed, expands the definition of protective supervision for disabled persons to include "monitoring behavior or physical condition of mentally or physically disabled recipients" . Additionally, as originally proposed, SB 1794 was considered to be a State mandated program subject to reimbursement through the State Mandates Claims Fund. The expansion of protective supervision, as originally proposed, could have included persons actually needing professional medical care and supervision. Amendments to SB 1794 will define the expansion of protective supervision to persons "in need of paramedical or non-medical personal care services which must be provided on a 24-hour basis to ensure the recipient's safety. Such assistance shall include, but not be limited to, respiration and suction machines or similar equipment" . Counties will not be mandated to implement funding of the expanded protective supervision services unless shared funding from the State is available in the Budget Act. The California Welfare Directors Association has worked with the authors of SB 1794 to secure these amendments, and supports SB 1794 with the amendments. LA2/sbl794 .doc
