MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: May 3, 1988 SUBJECT: Presentation of FAR Part 150 Noise Study Specific Request(s) or Recommendation(s) & Background8 Justification RECOMMENDED ACTION: ACCEPT the draft FAR Part 150 Noise Study Recommendations and direct that these recommendations be submitted to the Federal Aviation Administration for their review, comment and approval. FINANCIAL IMPACT: All work for the 'Noise Study has been funded through Federal Aviation Administration grants and Buchanan Field Airport Enterprise Fund. REASONS FOR RECOMMENDATION/BACKGROUND- The FAR Part 150 Noise Study is a comprehensive noise study funded by a 90% Federal Grant with the remaining 10% funded out of the Airport Enterprise Fund. The FAR Part 150 Noise Study does in-depth noise analysis and develops new Composit Noise Equivalent Level (CNEL) curves for the airport. This study also projects air traffic for the next 20 years both at constrained and optimized levels and projects CNEL curves for these conditions. The study further makes recommendations to minimize the noise impact on surrounding communities The Aviation Advisory Committee has held 15 meetings since January 20, 1987 where the Noise Study has been discussed. At each of these meetings the AAC provided substantial time for public discussion. In addition, the AAC formed a Noise Task Force made up of an elected or appointed official from Concord and Pleasant Hill, a citizen member from Concord and Pleasant Hill, a pilot member and two members from the Aviation Advisory Committee. There were three formal meetings with the organized pilot group representatives to discuss the Master Plan and the Noise Study. In addition, there were meetings with the Concord Chamber of Commerce Aviation Subcommittee. On March 15, 1988 the Aviation Advisory Committee received full presentation of the draft Noise Compatibility Program and the first review of the Noise Ordinance. The AAC received input and comment on these documents at that meeting. On April 26, 1988 the Aviation Advisory Committee held a meeting with the Noise Compatibility Program and the Ordinance as the primary topic of discussion. The Noise Ordinance proposal as recommended by the noise consultant, the legal consultant and the airport staff was found to be unacceptable to the Aviation Advisory Committee. This proposed Ordinance would have been based upon established lists of airplane noise levels. This list would have permitted certain airplanes access to the airport and airplanes exceeding certain specified noise levels would have been prohibited. The Aviation Advisory Committee developed several concerns with this approach. The Aviation Advisory Committee requested that the airport consultants and the airport staff consider other alternatives for an airport ordinance. The Committee further asked that the Chairman of the AAC appoint a special study committee to meet within one week to consider other options for the ordinance. The AAC further asked that these alternative proposals be presented to them for their first consideration on May 10, 1988. If the alternative proposals are found acceptable at that time, the committee would then recirculate for comment and reconsider the new proposed ordinance recommendations. The AAC recommends adoption of the Noise Compatibility Program. The Public Works Department concurs with this. The AAC recommends that the proposed noise ordinance not be considered at this time. Hodges & Shutt Aviation Advisory Committee 3.t5 sf Page 2 of 3 Harold Wight, Manager of Airports, introduced the noise study which he advised had been funded primarily by FAA funds, stating that its goal is to develop a program to mitigate the impact of the airport on the surrounding communities and includes the recommendation for a.:community relations officer (noise abatement officer) . He introduced Mike McClintock of McClintock, Becker and Associates, who served as consultants for the study. Mike McClintock, consultant, gave an overview of the study. Virginia Schaefer, Chair of the Aviation Advisory Committee, advised that the Committee unanimously recommends the FAR Part 150 Study for adoption, and suggested hiring a full-time Community Relations Officer to manage the entire compatibility program at Buchanan Field. Sheri Sterritt, City of Pleasant Hill Councilmember, submitted material reviewed by the City Council at its meeting last evening. She also requested that all hearings and meetings on the upcoming noise ordinance be held in the evening, but agreed to moving forward with the FAR noise study. Dennis Lee, Attorney for the City of Pleasant Hill, confirmed that the City did not oppose the noise study, but suggested additional concerns and comments set forth in the City' s letter be incorporated in the noise study. Paul-Andre' Schabraco, Consultant for the City of Pleasant Hill, suggested that the noise compatibility study does not address several key issues of concern to the City such as safety, sleep interference, the issue of the reliever airport, flight training and land use measures. He objected to Runway 19R being designated the preferred daytime and nighttime runway. Gerry Greth, Executive Vice President, Mt. Diablo Pilots, urged acceptance of the noise. study and advised that the pilots want a good noise ordinance to go forward. Joyce Church, member of the Noise Task Force, referred to a letter she had written on April 11, 1988 outlining concerns. She wants no further flight of jet aircraft over the City of Pleasant Hill after 10: 00 p.m. She wants assurance there will be no further scheduled commercial flights over Pleasant Hill, more notice of meetings where the airport is to be discussed, and she wants background material for said meetings to be given out earlier. She also requested nighttime meetings. Ron Sorenson, representing business interests at the airport, commented that there does not seem to much opposition to passage of the 150 noise study, and urged the Board to accept it today. Joe Campbell, P. O. Box 5553 , Walnut Creek, commented that activity at the airport peaked in 1977/1988 and predicted a decrease in activity in the future. He encouraged the Board to accept the noise study today and go forwarded with the proposed noise ordinance. Anthony Tiritilli, representing Contra Costa Airport Association, submitted written comments relating to the proposed noise ordinance and supported acceptance of the FAR 150 study and urged. prompt adoption of a reasonable noise ordinance. As recommended by Supervisor McPeak, IT IS BY THE BOARD ORDERED that the recommendations of staff set forth in this report are APPROVED, and. all of the comments made by parties testifying today are REFERRED to the Aviation Advisory Committee to acknowledge., address and consider in the process of developing a noise ordinance.
