SUBJECT: Expand the Shell Task Force To Address the Shell Crude Oil
Spill Disaster and Other Problems
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION: That the Board formalize and expand the
ongoing Shell Task Force, to address the threat of other
waterfront industries capable of contaminating the San
Francisco Bay/Delta Estuary and broaden the scope of the
committee to include environmental safety. The task force
membership shall include representatives from the:
Board of Supervisors
Regional Water Quality Control Board
Bay Conservation and Development
County Environmental Health
State Environmental Health
Fish and Game
County Fish and Wildlife Committee
City of Martinez
East Bay Regional Park District
Emergency Services
Hazardous Materials Commission
Environmental Protection Agency
Coast Guard
Army Corp of Engineers
State and National Representatives
Industry
The Shell Task Force shall investigate and report to the
Board on the following matters:
1. Monitor the Shell disaster cleanup, and rehabilitation
of the shoreline, marshes and wetlands.
2. The cause or causes of the disaster.
3 . Determine whether existing law is adequate to protect
the environment from potential toxic releases. If it
is not, make recommendation to strengthen the law.
4. Review Agency enforcement practices to determine
adequacy and if needed, describe methods of
improvement.
5. Review the operations of other waterfront industries to
determine whether wetland toxic contamination risk is
present.

6. Make recommendation as to the feasibility of
establishing a safety standard to be met by industries
who present a risk to our wetlands and waterways. If a
risk free method cannot be achieved, review the
feasibility of relocating those threatening hazardous
operations to less environmentally sensitive
locations.
7 . Review systems of monitoring industries to ensure
environmental safety, including the waterway site
inspector (Creek Sleuth) capable of inspecting industry
from the environment. Suggest methods of funding.
BACKGROUND: The existing Shell Task Force is composed of
the Office of Emergency Services, Consolidated Fire, the
City of Martinez The task force has responded to public
safety issues on an as need basis.

Adopted this Order on May 3, 1988 , by the following vote :

SUBJECT : Request to Shell Oil Company for Mitigation/Clean-up Measures
Supervisors McPeak and Fanden jointly recommended, in regard
to the oil spill at the Shell Oil refinery which occurred April
23-24, 1988, that Shell Oil Company be asked to do all of the
following:
1. Continue to clean up the impact areas including the
Martinez waterfront and marina, and the tidal and
seasonal wetlands in and around Peyton Slough.
2. working with public agencies, secure the 240 acre Shell
Marsh and surrounding uplands for public ownership and
eventual dedication to an appropriate public agency,
such as the East Bay Regional Park District.
3 . Fund a rehabilitation program for all marshes and Bay
waters affected by the spill.
4. Fund long-term studies of the impact of the oil spill
on the wetlands and Bay estuary. This program should
be developed and managed by appropriate State and local
agencies with approval by local environmental groups.
5 . Establish a trust fund for the long-term rehabilitation
and maintenance of the affected wetlands. This fund
should also be used to study the long-term impacts of
the spill on the marshes and Bay fishery and to provide
educational information to the public about Shell Marsh
and its recovery.
The Board members discussed the oil spill and its impact on
the environment and economy of the County.
All Board members being in agreement, IT IS BY THE BOARD
ORDERED that the recommendations of Supervisors McPeak and Fanden
are approved.
