THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA and
THE REDEVELOPMENT AGENCY OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this order on May 3, 1988 by the following vote:

The Contra Costa County Board of Supervisors (the "County" ) and
the Contra Costa County Redevelopment Agency (the "Agency" )
Resolve that:
The Pleasant Hill BART Station. Area Redevelopment Plan calls for
Agency participation in the construction of a Commuter Bike Trail
along -certain rights-of-way formerly owned by the Southern
Pacific Transportation Company. The rights-of-way to be utilized
from Monument Boulevard south to Rudgear Road have been acquired
by the County and the Agency. The -Agency' s area of responsi-
bility extends from the Contra Costa- Canal north to Monument
Boulevard in the City of Pleasant Hill ( "Agency' s Segment" ) . The
California Department of Transportation (CALTRANS) and the City
of Walnut Creek, have agreed to assume the responsibility for
funding construction of the bike trail in all areas of the
right-of-way other than the Agency' s Segment ( "CALTRANS
SEGMENT" ) .
The County and Agency are ready and willing to enter into a
Cooperative Agreement with CALTRANS, the City and Redevelopment
Agency of Walnut Creek and the East Bay Regional Park District,
for the funding, design, engineering, construction and main-
tenance of the Commuter Bike Trail. It is understood, however,
that the East Bay Regional Park District will assume full
responsibility for the maintenance of the Commuter Bike Trail
after proceeding through a formal review process and acceptance
of design standards.
NOW THEREFORE IT IS HEREBY RESOLVED, that the Contra Costa County
Board of Supervisors and the Contra Costa County Redevelopment
Agency will enter into a Cooperative Agreement with CALTRANS, the
City and Redevelopment Agency of Walnut Creek and the East Bay
Regional Park District, for funding, design, engineering,
construction and maintenance of a Class 1 Bike Trail constructed
to CALTRANS standards along the abandoned Southern Pacific
right-of-way from Monument Boulevard to Rudgear Road. The
Cooperative Agreement may provide that if Agency funds are not
available at the time construction is to begin on the Agency' s
Segment, CALTRANS funds shall be used to complete the
construction on Agency' s Segment. At such time as Agency funds
become available, Agency shall contribute a sum equivalent to the
amount expended on the Agency' s Segment to complete construction
on another segment of the bike trail.
IT IS FURTHER RESOLVED that no funds shall be expended by the
Agency for purposes of constructing the Commuter Bike Trail on
Agency' s Segment pursuant to the Cooperative Agreement with
CALTRANS unless CALTRANS is able to secure funding for con-
struction of the trail on the CALTRANS Segment.
