Resolution on May 3, 1988 by the following vote: AYES: Supervisors Powers , Fanden, McPeak, Torlakson & Schroder NOES: None .ABSENT: None ABSTAIN: None RESOLUTION NO. 88/239 SUBJECT: Completion of Improvements, Declaring Certain Roads as County Roads and Approval of Road Improvement Agreement (Almaden Circle) , Subdivision 6333, Oakley Area. The Public Works Director has notified this Board that the improvements in Subdivision 6333 have been completed as provided in the Subdivision Agreement with Hofmann Company heretofore approved by this Board in conjunction with the filing of the Subdivision Map. The Public Works Department having also notified this Board that these improvements have been completed with the exception of minor deficiencies, for which the following document was presented Board approval. A Road Improvement Agreement with Kaufman and Broad of Northern , California, developer, whereby said developer agrees to complete all improvements as required in said Road Improvement Agreement within one year from the date of said agreement. Improvements generally consist of removal of fence blocking Almaden Circle from the west intersection of Vintage Parkway to Lot 6, Subdivision 6333. Said document was accompanied by the following: Security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 138538, dated April 8, 1988) in the amount of $1, 000, made by Kaufman and Broad of Northern California. B. Additional security in the form of a corporate surety bond dated March 21, 1988, and issued by American Casualty Company of Reading PA (Bond No. 524 46 61) with Kaufman and Broad of Northern California as principal, in the amount of $3, 000 for faithful performance. NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED for the purpose of establishing a six-month terminal period :for the filing of liens in case of action under the Subdivision Agreement: DATE OF AGREEMENT SURETY January 22, 1985 The American Insurance Company Bond No. SC 639 88 66 BE IT FURTHER RESOLVED that the hereinafter described roads, as shown and dedicated for public use on the final map of Subdivision 6333, filed January 28, 1985, in Book 287 of Maps at page 12, Official Records of Contra Costa County, State of California, are ACCEPTED and DECLARED to be County Roads.
