12 1 . You are hereby notified that NATHAN CHITWOOD (Date of
13 Birth - August 11 , 1974) whose address is 1420 Renwal Road ,
14 Concord , California 94521 claims from CONTRA COSTA COUNTY damages
15 for injuries in the amount of One Hundred Thousand Dollars
16 ($loo ,000) .
17 2 . This claim is based on personal injuries and severe
18 emotional distress sustained by claimant on January 7 , 1988,
19 January 8 , 1988 and January 9 , 1988 at the County Juvenile Hall
20 located on Glacier Drive , Martinez , California under the
21 following circumstances .
22 3 . The claimant , a minor , was placed in temporary custody
23 in a sleeping room at the County Juvenile Hall by public
24 employees of Contra Costa County. The occupants of the sleeping
25 room were known to the public employees as persons who sexually
26 abused other occupants of the County Juvenile Hall . Said public
27 employees, due to their employment duties , had a special
28 relationship with the claimant and therefore had a duty to
1 protect the claimant from harm and injury. Said public employees
2 breached this duty by failing to protect the claimant and allowed
3 the occupants to sexually abuse the claimant over a period of
4 three days. By these actions the public employees violated the
5 civil rights of the claimant .
6 Due to the physical condition of the sleeping rooms, i . e .
7 the blocked windows and doors that prevented observation and
8 control of the actions and activities of the sleeping room
9 occupants and the over crowded conditions the public entity and
10 its employees created a dangerous and hazardous condition in that
11 they could not supervise and protect .the occupants. These acts
12 were a direct and proximate cause for the injuries to the
13 claimant .
14 4 . The names of the public employees are currently unknown.
15 5 . The injuries to the claimant are physical , emotional and
16 psychological . The expense of medical treatment and counselling
17 are presently undetermined .
18 6 . All notices and communications with regard to this claim

Dear Mr. Batchelor:
The 100-day limitation, like all statutes of limitations,
begins to run from the date of discovery. This is particularly
true when there has been fraud or failure to perform the duty
of notification as in the present case.
Although the date of occurrence is November 4, 1987,
the date of discovery is December 15, 1987 . December 15, 1987 is
well within the 100-day limitation.
For the above reason, I am returning this claim for your
consideration. If you will read the last paragraph on page two,
you will see that I make reference to December 15, 1987.
Please bring your decision in line with the Federal and California
case law and consider this claim as timely filed. Further, in
paragraph 3, I make reference to 1983. That date should be
changed to 1985 . Also, commitment is misspelled.

22 Plaintiffs MARY and RUSSELL SEWELL, filed a complaint for
23 damages No. C88-00247 in the Superior Court of California, County
24 of Contra Costa, a copy of,that complaint is attached hereto as
25 Exhibit "A". Plaintiff MARY SEWELL alleges that on April 21,

1987, she was walking on a sidewalk near 5701 Barrett Avenue in

E1 Cerrito when, as a result of the dangerous condition of the
2
sidewalk, she fell suffering personal injuries and consequent
3
hospital and medical expenses. In addition, plaintiff RUSSELL
4
SEWELL is alleging damages for loss of consortion. Plaintiff's
5
have named DANIEL L. CARLEVARO as a defendant in this action. On
6
or about February 2, 1988, defendant DANIEL L. CARLEVARO was
7
served with the above mentioned complaint for damages. Claimant
8
DANIEL L. CARLEVARO claims it was the County of Contra Costa
9
which had a duty to maintain the sidewalk in proper condition and
10
is therefore liable for plaintiff's injuries.
11 (d) General Description of Indebtedness Obligation, Injury,

Damage or Loss:
13 Claimant DANIEL L. CARLEVARO claims he has a cause
14
of action for either complaint equitable indemnity or partial
15 equitable indemnity against the County of Contra Costa arising
16 out of the SEWELL complaint for damages.

18 Unknown at this time.

20 Claimant DA'N'IEL L. CARLEVARD is presently unaware
21 of the total damages being claimed by plaintiffs. Plaintiff
22 claimed she severely broke her right wrist, there is nerve damage
23 and she will be in need of future surgery. Claimant DANIEL L.
24 CARLEVARO claims he is entitled to be indemnified by the County
25 of Contra Costa for any amounts claimed by the plaintiffs,
26 providing judgment as against CARLEVARO and for plaintiffs, or in
27 the alternative, should DANIEL L. CARLEVARO and the plaintiffs

Over the signature of Deputy County Counsel Mary Ann McNett ,
I received in the mail from your office a "Notice of Insuf-
ficiency and/or Non-Acceptance of Claim" of Joachim Rasmijn,
a minor (under the age of 14 years ) .
You state in Item 4 of vour said Notice that the claim fails
to state the names of the public employees causing the
iniury, damage or loss , if known.
Under Item 7 in vour said Notice , you further state "If
known, please state names of medical staff providing care
to claimant on 2/5/8811 .
Please be advised that the identity of the public employees
causing injury, damage or loss in addition to Dr. John Doe
Mandel identified in said minor' s claim are not known to
claimant , his mother or his attorney.
Please note further that the names of the medical staff
providing care- to claimant on 2/5/88 are also unknown to
claimant , his mother or his attorney.
I believe that the claim submitted on behalf of Joachim
Rasmijn, a minor under the age of 14 years , was in all
particulars , a sufficient claim under the laws of this
state to apprise the County of Contra Costa of the
nature and the basis of said minor' s claim.
The minor and/or his mother and/or his attorney are . not
required to state what is unknown to them in connection

with the minor' s claim nor is it required under the statute
that claimant is to state what is unknown to him or his

The claim statute is not designed to be a trap for the unwary
as held by the California Supreme Court .
The reason we have not vet obtained the identity of the public
employees causing the injury, damage or loss to Joachim
Rasmijn or the names of the medical staff providing care to
said claimant on 2/5/88 is that we have not yet been favored
with legible copies of the hospital and medical records
prepared under the direction and control of the health
providers employed by Contra Costa County who mistreated
and mis-diagnosed said claimant as set forth in the claim.
I also notice that a copy of your "Notice of Insufficiency
and/or Non-Acceptance of Claim" was sent to Risk Management ' s
(Insurance Carrier) representative. In this connection,
there is sufficient information set forth in Joachim Rasmijn' s
claim to enable your Risk Management personnel to investigate &
decipher the names of the medical staff providing care to said
claimant on 2/5/88 and in addition the names of the public
employees causing the injury, damage and loss to claimant .
Upon performance of your duty to investigate the facts set
forth in this claim, we expect that the County will accept
the claim. In the event that we do not hear from you within
the next 45 days , we will deem the claim rejected by the
County and will proceed with a formal action on behalf of the
minor claimant as provided by law.

Claimant is: Joachim Rasmijn, a minor born 2/04/75, residing
with his mother and natural guardian, Mavis van Den Hout at 2863
Esmond Avenue, Richmond, California 94804. Telephone: Care of
their attorney, Martin J. Jarvis, Esq., 685 Market Street, San
Francisco, California --94105; telephone: (415)543-0666.
Basis of the Claim: Said minor, above named, suffered
traumatic injury to his left lower extremity on 1/29/88. On said
date, the respondents, Martin Luther King, Jr. Family Health Center,
101 Broadway, Richmond, California 94804 and Dr. John Doe Mandel
of that medical facility, undertook to treat said minor for his said
injuries. Said medical facility and Dr. Mandel were each negligent in
and about the medical attention given to said minor on that date in
failing to diagnose and properly treat fractures of said minor's left
lower extremity.
Thereafter, on or about 2/5/88, the respondent Contra Costa
County Health Services - Merrithew Memorial Hospital and Clinics at
Richmond, California, undertook to render proper medical attention

to said minor for his injured left lower extremity. Then and there
said medical and hospital facility did undertake to diagnose,
examine and treat said minor for the injuries to his left lower
extremity. Said respondent, Contra Costa County Health Services -
Merrithew Memorial Hospital and Clinics at Richmond, California
was negligent in its said undertaking and provided sub-standard
medical and hospital attention and treatment for said minor thereat,
all to said minor's damage and to the consequential damage of his
mother and natural guardian, Mavis M. Van Den Hout, residing with
said minor child at the above address.
The Nature and Extent of Damages: The minor claims general
damages in the amount of $50,000; his mother and natural guardian,
Mavis M. Van Den Hout claims special damages in the amount of at
least $250 to date and continuing for appropriate medical and
hospital care for her son's said injuries. The minor also claims
special damages in an amount as yet uncertain for impairment of the
value of his time as a student currently and for future wage loss by
reason of such impairment occasioned by the negligence of the
respondents and each of them herein. -

mother and natural guardian, Mavis M. Van Den Hout, residing with
said minor child at the above address.
The Nature and Extent of Damages: The minor claims general
damages in the amount of $50,000; his mother and natural guardian,
Mavis M. Van Den Hout claims special damages in the amount of at
least $250 to date and continuing for appropriate medical and
hospital care for her son's said injuries. The minor also claims
special damages in an amount as yet uncertain for impairment of the
value of his time as a student currently and for future wage loss by
reason of such impairment occasioned by the negligence of the
respondents and each of them herein.
