The Contra Costa Water District is the local representative of the Bureau of Reclamation presently responsible for maintaining two timber bridges used to access and to maintain the canal and the Ygnacio Canal pump station. The bridges are also used by the East Bay Regional Park District for trail purposes. The timber bridges will be replaced by- reinforced concrete structures providing equivalent utility. In response to the Flood Control District request for necessary project land rights, the Bureau of Reclamation has provided a contract granting the rights of way and requiring the Flood Control District to maintain the replacement bridges. The District is concerned that the agreement contains no provisions requiring the other users to share the bridge maintenance costs despite the disproportionately high benefit which they receive. Since the Upper Pine Creek project is under construction, we recommend that the Board approve and authorize the Chief Engineer to execute the agreement to allow completion of the project. Staff will work with the Contra Costa Water District and the East Bay Regional Park District to develop a mutually acceptable maintenance agreement. CONSEQUENCES OF NEGATIVE ACTION: The construction project cannot proceed on Federal property without execution of the subject agreement.
