SUBJECT: Approve Execution of Agreement with the United States
of America for Grant of Easement of Federal Lands,
Upper Pine Creek project, FCZ No. 3B, (#7520-6B8688)

Justification
RECOMMENDATION ACTION:
A. APPROVE the right of way contract #7-07-20-L3857 with the
United States of America for use of Bureau of Reclamation lands
as part of the Upper Pine Creek project, and Authorize the Chief
Engineer to execute the contract to allow current construction
work to continue.
B. ACKNOWLEDGE the concerns of the Chief Engineer regarding the
responsibilities for bridge maintenance placed upon the Flood
Control District.
. C. DIRECT staff to work with the Contra Costa Water District and
the East Bay Regional Park District to develop an equitable
maintenance agreement.
FINANCIAL IMPACT:
The U.S. Bureau of Reclamation has waived the right of use fee.
The administrative charges are $221.20 of which $200. 00 has been
deposited. The financial impact of the maintenance requirements
may be significant if the bridges are subjected to unreasonable
use or vandalism.

REASONS FOR RECOMMENDATION/BACKGROUND:
The Upper Pine Creek project requires the construction of a
concrete channel and the replacement of bridges appurtenant to
the Contra Costa Canal (Milepost 35.28) on federal land managed
by the Department of the Interior, Bureau of Reclamation. The
Contra Costa Water District is the local representative of the
Bureau of Reclamation presently responsible for maintaining two
timber bridges used to access and to maintain the canal and the
Ygnacio Canal pump station. The bridges are also used by the
East Bay Regional Park District for trail purposes. The timber
bridges will be replaced by- reinforced concrete structures
providing equivalent utility.
In response to the Flood Control District request for necessary
project land rights, the Bureau of Reclamation has provided a
contract granting the rights of way and requiring the Flood
Control District to maintain the replacement bridges. The
District is concerned that the agreement contains no provisions
requiring the other users to share the bridge maintenance costs
despite the disproportionately high benefit which they receive.
Since the Upper Pine Creek project is under construction, we
recommend that the Board approve and authorize the Chief Engineer
to execute the agreement to allow completion of the project.
Staff will work with the Contra Costa Water District and the East
Bay Regional Park District to develop a mutually acceptable
maintenance agreement.
CONSEQUENCES OF NEGATIVE ACTION:
The construction project cannot proceed on Federal property
without execution of the subject agreement.
