SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Authorize the Chairperson on behalf of the Contra Costa County Board of Supervisors and the Contra Costa County Flood Control and Water...Conservation District, and the Contra Costa County Redevelopment Agency to reactiviate by Amendment Agreement the Joint Exercise of Powers Agreement with the Cities of Pinole, Richmond, and San Pablo, and the Redevelopment Agencies of Richmond and San Pablo for the development of strategies and a plan for the construction of State Route 93 (North Richmond Bypass) . FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS The original JEPA expired in October 1986 and was reactivated by Board action in April 1987 . The Amendment Agreement reactivating the JEPA is substantially the same form as the original JEPA allowing the County Flood Control, and the Redevelopment Agency to work with the Cities of Pinole, Richmond, and San Pablo in developing strategies for construction of the North Richmond Bypass. Parties . The parties to this Amendment Agreement are the County of Contra Costa, a political subdivision of the State of California; the City of Richmond, California, a municipal corporation; the City of San Pablo, a municipal corporation; the City .of. Pinole, a municipal corporation; the Contra Costa County Flood Control and Water Conservation District, a political subdivision of the State of California; and the Redevelopment Agencies of the' County of Contra Costa, City of Richmond, and the City of San Pablo. Route 93 Committee (North Richmond Bypass ) Joint Exercise of Powers Agreement Amendment Agreement Page 1 2 . Purpose. 'This Amendment Agreement is being entered into to amend the Joint Exercise of Powers Agreement which became effective on February 1 , 1987 and which was approved by the governing bodies of the parties pursuant to Government Code Section 6500 . Said Joint Exercise of Powers Agreement shall hereinafter be referred to as the "Original Agreement" and is incorporated herein by reference. 3 . Original Agreement Provisions . The parties hereto agree' to -continue to abide by those terms and conditions of the Original Agreement and any amendments thereto, which are un- affected by this Amendment Agreement. 4 . Amendment Provisions . This Amendment Agreement is subject to the following Amendment Provisions which control over any conflicting provisions of the Original Agreement, or any amendment thereto: Paragraph 11 (c) (Termination) of the Original Agreement is hereby amended to extend the contract term. Paragraph 11 (c) of the Original Agreement is amended to read as follows : " (c) Notwithstanding the above, this Agreement shall terminate on February 28, 1989 , unless it is extended by unanimous consent of the parties hereto.
