BACKGROUND: 4 The Board✓ of Supervisors recently requested the Executive Director of the Human . Relations Commission to undertake a mediation effort between . the residents of Clyde and the protesters at the Concord Naval Weapons Station in an effort to amicably resolve their differences. Mr. Persily indicates he is unable to undertake this effort without additional funding since otherwise his time should be dedicated to the Hate Violence Project for which the Board has already contracted with him. Mr. Persily has, therefore, suggested a contract in the amount of $12,000, $6000 of which he hopes to obtain .from the San Francisco Foundation; the. other $6000 will need to come from County funding. The County Administrator indicates that $3000 of the County funding can be taken from the 1987-88 budget and the other $3000 built into the 1988-89 budget. This grant application will permit Mr. Persily to continue the work he has undertaken. with the residents of Clyde and the protesters at the Naval Weapons Station . andstill continue his existing work with the Human Relations Commission and Hate Violence Project. Protest demonstrations at the Station have generally been sporadic_ events requiring emergency efforts by law enforcement and the Navy to prevent encroachment into security areas and to provide passage for emergency vehicles , etc . Clyd,.> , a community comprised of approximately 400 people residin; in 150 affordably priced homes and apartments , borders the main entrance to the Station . Clyde can be reached only by Port Chicago Hihway which intersects the "caval ` eapons Station . Port Chicago High ,aav is usually closed durin; demonstrations to enable the passage of emer-ency vehicles and access to Clyde , is either restricted to residents or closed completely . Although , demonstrations have restricted residents from leaving or returnin, to their hones sporadically since the Vietnam war residents were villin; to seek legal means to remedy their Situation . Since June , 19"% demonstrators have been stagin a 24 hour per day protest at the site where Brian Nilson was run over by a train while blocking the tracks to protest the war in Central America . Demonstrators have set up an encampment on the tracks and the Naval ,%eapons Station has altered its schedule for transporting weapons, across the highway . The navy concentrates deliveries so that only one train crosses the road on any given day . The County Sheriff and the Navy close the road , remove and detain demonstrators , and the train crosses . The road is closed , and access to and from Clyde halted generally around 9 : 00 am in the morning; for 20-40 minutes . The increased frequency of unannounced road closings is frustrating parents trying to take children to school , preventing people from making appointments , etc . ; and the 24 hour presence of people "camping" on the road across from the town park at the entrance to Clyde with tarps , water coolers , seats , cameras , charts , signs , and other paraphernalia ; has led to escalating friction between the residents and the protesters . -1- Y PROBLEM STAWMEN T . Counterdemonstrations called for by some residents have attracted not only neighbors , but people who are politically opposed to the demonstration . Many of these counter— demonstrations have resulted in eggs and other projectiles being hurled at the protesters . Demonstrators retort that they have received threats and vehicles have veered towards them . Residents of Clyde who have tried to establish a dialog with the demonstrators have themselves been the subject of threats and intimidation by neighbors who view them as "selling . out" . Residents of Clyde and the demonstrators both express the opinion that the violence will escalate . The County has been forced to make unanticipated expenditures exceeding $250 , 000 simply to attempt to cope with the continual problems encountered at the demonstration site . Attempts were made by the Sheriff and by the Board to cope with the situation before the decision was rade to request the Director of the Human Relations Commission to mediate the situation between the residents and the demonstrators . The Human Relations Commission Director is contracted to staff the Commission on a part—time contractual basis and this assignment is beyond the scope of the contract . The Commission needs the Director to perform his contractual duties and cannot modify his contract , but it voted to support the Director ' s involvement in the mediation effort if he was reimbursed from funds not included within the Commission ' s budget and the activity did not unduly interfere with other Commission activities . Contra ,Costa County , not unlike other counties , is in a severe budget crises and is in a deficit spending situation . These unanticipated costs cannot be covered by existing revenues . Due to the urgency of the situation the Director agreed to begin working; on this project on the assurance that the County would appropriate some emergency support and seek matching funds to reimburse him for his efforts . 2 GOAL : To prevent violent conflict between the protesters at the Concord ?"?aval I•'eapons Station and the residents of Clyde OBJECTIVES 1 . To enable the residents of Clyde and Nurembur^ Actions ( the collective decision making bodv for the oranizations en„aSed in protests at the Concord 'claval Veapons Station ) reach a mutually satisfactory a.greement on the conduct of demonstrations to minimize the negative impact on the residents . 2 . To gain the compliance of -a11 parties necessary to implement the terms of the agreement . The a;reenent will likely require the concurrence of the Contra Costa County Board of Supervisors , the Sheriff , the Atavy and the City of Concord as well as the parties to the agreement . 3 IrT'?0T)S 1 . Contra Costa County, Board, of Supervisors contracts with the Director of the Puman Relations Commission to serve as a mediator to attempt to ease tensions between the residents of Clyde and Nuremburg fictions . 2 , The mediator icets residents of Clyde to identify the issues that have been responsible for the conflicts between the demonstrators and the people in the community . 3 . The mediator -meets with Nure-9burg Actions and determine whether mediation is a viable option to attempt to resolve the conflicts betveen Clyde and Puremburg Actions . 4 . The mediator assists each group in the formation of negotiation teams . 5 . The mediator will provide a 12 hour course on negotiation and mediation to each negotiation team and assist them in preparing for the mediation effort . 6 . The mediator will then begin the mediation process which will consist of : a . reaching an a reement on the logistics and -round rules for the mediation (t,,here the mediation will to?:e place , issues of confidentiality , etc . b . once this stave is reached the parties will begin negotiations and the mediator will wor':: with them to facilitate the development of an agreement . 7 . Once an a^reer..ent is reached other parties whose actions will be affected by the agreement will be contacted and efforts will begin to gain their compliance . These parties are likely to include the Navy , the Sheriff ' s Department , the County !)omni of Supervisors , the County Administrator and , perhaps , other agencies or organizations to monitor and enforce the agreement . 4 TIiltFLII F CHRONOLOGY OF STEPS TAK, N February , 19''S The Contra Costa County 11oard of Supervisors requests the Human Relations Commission to attempt to ease tensions between Clyde and Nurembur^ Actions The ?luman 1?el.ations Commission authorizes Fred Persi.ly , their interim director , to determine whether mediation is a viable option for resol.vino the conflict . Conduct mediation 60 hours Gain consent necessary for implementation 40 hours 200 hours `? $60 per hour $12 , 000 Contribution from Contra Costa County $6 , 000 Requested from The San Francisco Foundation $5 , 000 7 1 . 58b THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 17, 1988 , by the following vote: AYES: Supervisors Powers, Fanden, McPeak, Torlakson, Schroder NOES: None ABSENT: None ABSTAIN: None ------------------------------------------------------------------- ------------------------------------------------------------------- SUBJECT: Protest at the Concord Naval Weapons Station Don Elam, 168 Norman Avenue, Clyde, appeared and commented on a previously approved item on the Board' s agenda this day (Item No. 1. 58 ) relative to submission of a grant application to the San Francisco Foundation for $6,000 to fund mediation efforts between the residents of Clyde and the protestors at the Concord Naval Weapons Station. He advised that he was not supportive of the Board' s action in seeking these funds and expressed the frustration of the people of Clyde whose community has been interrupted by the protest activity at the Weapons Station. Supervisor McPeak commented on the meetings that have occurred with representatives of legal departments, law enforcement agencies, the community and protestors to resolve this matter. She also noted that there was concern for the safety of the motorists and protestors because of the tables, chairs, and other various and assorted items positioned on the edge of the right of way of the Port Chicago Highway. In order to provide for the safety of all parties, she advised that the Public Works Director had issued an abatement order for his Department' s crews to remove the various items and structures situated on the edge of the roadway or intruding into the right of way. V. J. Westman, County Counsel, advised that in accordance with legal requirements, the protestors were notified to remove specified items by May 17, 1988. Mr. Westman noted that the Nuremberg Actions Committee sought redress in the Federal Court and that U. S. District Court Judge Stanley Weigel granted the protestor' s request for a temporary restraining order, which will be in effect until the hearing on a preliminary injunction scheduled for June 23 , 1988 . The County Counsel expressed concern for the safety of all parties using that roadway and the encroaching materials being maintained in it. Supervisor McPeak requested the Board to adopt a position in support of County Counsel' s efforts to defend the Public Works Director' s abatement action in Federal Court. Board members expressed concern for the safety of all parties along the right of way, for the need to protect the integrity of the road right of way, and agreement to support Supervisor McPeak' s request.
