SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND
JUSTIFICATION
I. Recommended Action:
APPROVE Right of Way Contract and ACCEPT Temporary Construc-
tion Easement dated April 20, 1988 from Kaiser Foundation
Hospitals.
AUTHORIZE the Chair of the Board to execute the Temporary
Construction Easement and the Chief Engineer to execute the
Right of Way Contract on behalf of the District.
APPROVE payment of $33, 674 for said property rights and
AUTHORIZE the Auditor-Controller to issue a check in said
amount payable to Kaiser Foundation Hospitals, to be for-
warded to the Real Property Division for delivery.
DIRECT the Real Property Division to have the above
referenced Temporary Construction Easement recorded in the
office of the County Recorder.

II. Financial Impact:
Payment of $33,674 from Flood Control Zone 3B funds which are
100% reimbursable from the State Department of Water Re-
sources.
III. Background and Reasons for Recommendations:
These property rights are required for the San Ramon Creek
Bypass project in accordance with approved plans and spec-
ifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow
construction in accordance with the approved plans and
specifications.
