RECOMMENDATION APPROVE the Second Amendment to the Consulting Services Agreement with Field/Gruzen Associated Architects, for Architectural Predesign Services for Superior Court Annex and Parking Platform, Martinez, and AUTHORIZE the Director of General ' Services to execute the Amendment, which will increase the scope of services to include (A) schematic design sketches as needed to test the feasibility and validity of revisions to the Initial Architectural Program, and (B) attendance at meetings as required to present the schematic design sketches. In addition, the Amendment will increase the payment limit to provide compensation for the increase in scope of services. II. FINANCIAL IMPACT This Amendment will change the Agreement payment limit, as amended by the First Amendment, from $38, 000. 00 to $53 ,000. 00, an increase of $15, 000. 00. There are sufficient funds . in the plant acquisition account for this project to cover the Payment Limit increase. Also, the County will be reimbursed for costs incurred under this agreement. The reimbursement will be from the construction fund established under the Trust Agreement with the Contra Costa. County Public Facilities Corporation, dated June 1, 1986 , providing for the delivery of the 1986 Certificates of Participation for Capital Projects IV and V. III. REASONS FOR RECOMMENDATION/BACKGROUND A. By . an Order dated March 6, 1984, the Board appointed Field/Gruzen, San Francisco, as Project Architect for the Superior Court Annex and, by. an Order dated May- 1, 1984, the Board approved a consulting services agreement for architectural predesign services with Field/Gruzen.. - CONTINUED ONATTACHMENT:. In letters dated September 19, October 15, and November 15', 1984, Field/Gruzen requested extra payments of approximately $42,000. 00 to $47,000. 00 over the payment limit specified in the agreement. Field/Gr uzen argued it was due such extra payments because it had performed services in excess of those required by the Agreement, even though no such services had been ordered in writing in accordance with the Agreement. County staff evaluated the claim, found that some extra services had been performed to the benefit of the County and that it would be equitable to offer Field/Gruzen $14, 500. 00 as compensation for such extra services. Field/Gruzen rejected the offer. C. By an Order dated December 11, 1984, the Board approved a Program Verification Study for the Superior Court Annex, which was the end product of the architectural predesign services by Field/Gruzen. By an Order dated December 18, 1984, the Board rescinded the appointment of Field/Gruzen as Project Architect and appointed another architect. D. In a letter dated June 23 , 1987, attorneys for Field/Gruzen notified the County that it will accept $15,000. 00 as full compensation for any extra services and, on February 15, 1988, Field/Gruzen signed the Second Amendment to the Agreement. County staff recommends approval of this Amendment and payment of $15, 000. 00 as an acceptable fee for the extra services performed by Field/Gruzen. 25004B04. 27B RDH:pg I Page 2 of 2
