April 13, 1988 SUBJECT: SB 2396 (Boatwright) Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATION Support.SB 2396 (Boatwright) which would prohibit unauthorized discharges into sewer systems, if amended to give a judge more discretion in imposition of violator penalities. ° FINANCIAL IMPACT None to the County. REASONS FOR RECOMMENDATION/BACKGROUND The Sanitary Districts are sponsoring SB 2396 (Boatwright) which would prohibit unauthorized discharges into manholes,cleanouts or other sanitary sewer facilities..SB 2396 responds to concerns that closure of IT and increased costs of legal disposal of hazardous wastes could stimulate illegal disposal of hazardous materials into the sewer system. The Hazardous Materials Commission is concerned that the bill does not clearly give a judge discretion to impose a fine,jail sentence or neither penalty. The Sanitary Districts have expressed their willingness to so amend the bill, and will request the amendment from Senator Boatwright.
