SUBJECT: Hearing on Rezoning Application #2785-RZ, Blackhawk Corporation
(Applicant) and Country Club at Blackhawk Improvement Association
(Owner) , to amend the preliminary development plan for the Blackhawk
Ranch development project. Subject property consists of 25 acres and
is located at the south terminus and on the west side of South Eagle
Drive, in the Blackhawk area.
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the environmental documentation prepared for this
project as being adequate. /
2. Approve Rezoning Application '#2785-RZ, along with Final
Development Plan #3004-88 and Subdivision #7086, including
conditions of approval imposed by the San Ramon Valley
Regional Planning Commission.
3 . Adopt the San Ramon Valley Regional Planning Commission' s
findings as set forth in Resolution No. 25-1988 as the
determinations for these actions.
4. introduce ordinance giving effect to the aforesaid rezoning,
waive reading and set date for adoption of same.

CONDITIONS OF APPROVAL FOR PRELIMINARY DEVELOPMENT PLAN 2785-RZ AND AMENDED FI
' NAL DEVELOPMENT PLAN 3004-88, AND VESTING TENTATIVE SUBDIVISION 7086, EAGLE ,NEST
TOWNHOUSES WEST
1. Development shall be based on the amended Final Development Plan consisting
of:
a. Index sheet to drawings, prepared by Bryan and Murphy Associates, dat-
ed January 1988.
b. Illustrative Plan prepared by Samson Associates, dated January, 1988.
c. Amended Preliminary and Final Development Plan, prepared by Bryan and
Murphy Associates, dated January, 1988.
d. Vesting Tentative Map (two sheets) , prepared by Bryan and Murphy Asso-
ciates, dated January, 1988.
e. Entry Landscape Plan, prepared by Samson Associates, dated January,
1988.
f. Front and Rear Building Elevations, prepared by the Dahlin Group, dat-
ed January, 1988.
g. First Floor Plan, Units A and B. prepared by the Dahlin Group, dated
January, 1988.
h. Second Floor Plan, Units A and B, prepared by the Dahlin Group, dated
January, 1988.
2. A maximum of 24 units shall be permitted within- the 25.1 acre area of
3004-88 and Subdivision 7086.
3. The project shall be subject to Design Review by the Zoning Administrator
who may approve future refinements to the design of the project.
4. Covenants, Conditions & Restrictions, Articles of Incorporation and By-Laws
for the mandatory homeowner's association shall be submitted prior to ap-
proval of a Final Subdivision Map. These documents shall provide for es-
tablishment, ownership, and maintenance of the common open space, private
streets, landscaping and park areas. The applicant shall investigate the
possibility of combining the new association with the existing Eagle Nest
Terrace Homeowners' Association.
5. Dedicate the development rights of the approximate 17.6 acre + open space
area to the County.
6. Street names shall be subject to review and approval of the Community De-
velopment Department. The proposed street names shall be submitted to the
Graphics Section prior to filing a final map.
7. Maintenance of the private streets within the project shall be provided by
a homeowner's association.
8. If during the construction, grading or excavation, any items of potential
historical or scientific interest are discovered, the Community Development
Department shall have- the authority to issue an order appealable to the

Planning Commission to stop work in the area of any find pending verifica-
tion of the discovery and the development of methods for the protection and
treatment of areas of significant interest.
9. A maximum of one model and sales office shall be permitted, subject to pri-
or submittal of an office site location map to the Zoning Administrator.
10. All construction and transport equipment shall be muffled in accordance
with State and Federal requirements.
11. Grading operations shall occur during dry periods to the extent feasible,
consistent with the Grading Ordinance.
12. The applicant shall develop, in conjunction with the County Building In-
spection Department, a program to minimize erosion and generation of dust
resulting from grading operations.
13. Provisions shall be made to protect down slope lots from surface waters
flowing from the above hillsides.
14. Grading and soil foundation engineering shall comply with recommendations
of the soil report by Engeo, Inc. , dated September, 1984.
15. Comply with drainage, road improvement, traffic and utility requirements as
follows:
A. In accordance with Section 92-2.006 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision
Ordinance (Title 9) . Any exceptions therefrom must be specifically
listed in this conditional approval statement. Compliance with Title
9 will require the following:
1. Constructing a paved turnaround at the end of the proposed pri-
vate road.
2. Undergrounding of all utility distribution facilities.
3. Conveying all storm waters entering or originating within the
subject property to a natural watercourse having definable bed
and banks or to an existing adequate storm drainage facility. An
exception to this requirement is permitted for Parcel A provided
the applicant maintains the existing drainage pattern and does
not dispose concentrated storm waters onto adjacent properties.
4. Submitting a Final Map prepared by a registered civil engineer or
licensed land surveyor.
5. Submitting improvement pians prepared by a registered civil engi-
neer, payment of review and inspection fees, and security for all
improvements required by the Ordinance Code or the conditions of

approval for this subdivision. These plans shall include any
necessary traffic signage and striping plans for review by the
County Traffic Engineer.
B. The onsite private road shall be constructed as shown on the Vesting
Tentative Map as a 24 foot wide road within a 34 foot right of way.
C. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance
for the Countywide Area of Benefit for Unincorporated Areas as adopted
by the Board of Supervisors. The current fee is $5,276 per dwelling
unit.
D. Furnish proof to the Public Works Department, Engineering Services
Division, of the acquisition of all necessary rights of entry, permits
and/or easements for the construction of off-site, temporary or perma-
nent, road and drainage improvements.
E. Prior to issuance of building permits, file the Final Map for Subdivi-
sion 7086.
THE FOLLOWING STATEMENT IS NOT A REQUIREMENT OF THIS APPROVAL BY THE COUNTY BUT
IS INTENDED TO ADVISE THE APPLICANT OF OTHER AGENCIES' REQUIREMENTS IN THE
REVIEW OF THE PROJECT.
A. Comply with the requirements of the San Ramon Valley Fire Protection Dis-
trict.
