Bragdon, Contra Director of Community Development Costa DATE: May 3 , 1988 coi '•J SUBJECT: ' Environmental Impact Report for Diversion of Central County Wastes SPECIFIC REQUEST(S) OR RECCMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Accept report from Director of Community Development on status of determining if an Environmental Impact Report is necessary for the disposal of Central County solid wastes at existing East and West County landfills after Acme Fill closes. FINANCIAL IMPACT None. REASONS FOR RECOMMENDATION/BACKGROUND On April 26 , 1988, the Board referred to the Community Develop- ment Director for recommendation a letter dated March 28 , 1988 , from the West Contra Costa Solid Waste Management Authority requesting that an Environmental Impact Report be prepared prior to the diversion of Central County wastes to existing East and West County landfills upon closure of Acme Fill. In order to determine it an Environmental Impact Report is nec- essary, it is first necessary to determine if any discretionary actions by a public agency are involved. In the case of the West Contra Costa Sanitary Landfill, the landfill is partially within the City of Richmond and partially in the unincorporated area. Our department has determined that the County-issued land use permit does not need to be modified for acceptance of Central County waste, but the Solid waste Facilities Permit (the operat- ing permit) issued by the County Health Services Department may need to be revised. The revision of the operating permit is subject to CEQA. We have written a letter to the City Manager of Richmond asking whether or not the City has a land use permit for the landfill and if that land use permit needs to be modified for acceptance of Central County waste. We have also asked the City . if they have any other entitlements, such as their franchise agreement which needs to be modified, that also may be subject to CEQA. The availability of an interim transfer station at Acme Fill also needs to be addressed. Once more information is available about these plans and after an inventory of the public agency entitle- ments are obtained, a determination as to the appropriate CEQA document can be made by the appropriate lead agency.
