Position Paper Regarding Current Recycling Legislation
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
1, Support the following favorable and unfavorable points as the County's
position on current recycling legislation:
Favorable Points
o The solid waste planning fee assessed to landfill operators should be
modified to allow for expenditure for solid waste public education
programs.
o The options for funding, as proposed in the various pieces of
legislation, that would require an assessment to the tipping fee
should be optional for local agencies.
O The current State law requires a mandatory recycling goal of 20
percent in all Solid Waste Management Plans. This goal should be
supported and not changed.
o Support State research and market development for recyclable
materials.
o Support a comprehensive view of resource recovery, which includes
composting and waste-to-energy in addition to recycling.
o Support integration of recycling in the overall solid waste management
program for the County as included in the County Solid Waste
Management Plan.

o Support local determination of how to meet State-mandated goals.
Unfavorable Points
o Oppose fees that are assessed on landfill operators, sent to State
agencies and then partially returned back to local agencies except for
research and market development programs.
o Oppose the involvement of the State Department of Conservation in
reviewing recycling plans. Encourage the California Waste Management
Board to review County recycling efforts as part of the review of
County Solid Waste Management Plan.
o Oppose unrealistic recycling goals.
2. Authorize letters to be sent to appropriate legislators and governmental
organizations outlining the County's position.
3. Authorize the Solid Waste Commission to represent the County at Legislative
Committee hearings on current recycling legislation.

REASONS FOR RECOMMENDATION%BACKGROUND
Staff presented to the Solid Waste Commission at its April 20, 1988 meeting,
a position paper outlining various favorable and unfavorable points of current
recycling legislation. This general position toward recycling legislation was
offered as an alternative to taking individual positions on the numerous bills
now in Sacramento. The Commission reviewed each point and unanimously supported
the position paper and recommended that it be considered by the Board of
Supervisors. The Commission also requested authorization from the Board to
attend Committee hearings and present the County's position on current recycling
legislation.
