April 20, 1988 County SUBJECT: Authorize letter to California Waste Management Board requesting a time "` extension for resubmittal of the County Solid Waste Management Plan Revision. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Authorize the Chair to execute a letter to the California Waste Management Board requesting a 'one-year time extension for resubmittal of the County Solid Waste Management Plan revision. FINANCIAL IMPACT None REASONS FOR RECOMMENDATION%BACKGROUND The Solid Waste Commission, at its April 20, 1988 meeting, voted unanimously to recommend that the Board of Supervisors request the California Waste Management Board (CWMB) grant the County a one-year time extension for resubmittal of the County Solid Waste Management Plan Revision. When the CWMB disapproved the Plan Revision on January 13, 1988, the County was given until May 13, 1988 to revise the revision, approve it (including the cities) , and resubmit the Plan to the CWMB. Many questions, issues- and options remain unanswered and unaddressed. The. Commission felt that these should be considered before an adequate plan revision could be prepared and submitted to the State. The letter to the CWMB will explain the current situation in Contra. Roodzant, Chairman California Waste Management Board 1020 - 9th St. , Suite 300 Sacramento, CA 95814 Dear Mr. Roodzant: On January 13, 1988, the Waste Management Board disapproved Contra Costa County's Solid Waste Management Plan. Your Board found the plan revision deficient in several areas, the most important area being the inability to satisfy the eight-year disposal capacity requirement. Your Board directed our County to resubmit a plan revision with modifications that would be subject to the requirements of the California Administrative Code, which requires that a plan revision, with city and Board of Supervisors approval , be submitted within 120 days from the date of disapproval . At this point in time we find .that we will not be able to meet the 120 day deadline of May 13, 1988, and hereby request that the Waste Management Board grant a one year time extension to Contra Costa County to allow for preparation and resubmittal of a plan revision. The Board of Supervisors remain deadlocked over the two privately proposed landfill sites (the East Contra Costa Sanitary Landfill and the Kirker Pass Waste Management Landfill ) with a 2-2 vote. Because of a possible conflict of interest, one supervisor has abstained from voting on any matters related to this issue until further clarification can be obtained from the Fair Political Practices Commission. Because of the current dilemma over the siting of a landfill , the Board of Supervisors has asked the County Solid Waste Commission and County staff to explore all possible alternatives that might allow the County to meet the landfill capacity requirement. One of these alternatives includes a request of County landfill operators to investigate the feasibility of expanding landfills now in operation. Analysis is underway by the operators and answers are expected within the next two months. The County Solid Waste Commission, under Board direction, is currently considering the alternative to include various landfill sites in the Solid Waste Management Plan as tentatively reserved sites. This issue has been discussed at the Commission's last two meetings and will be discussed -2- further during their upcoming meeting in May. Many questions have been raised regarding CEQA implications as a result of including landfill sites as tentatively reserved sites in the Solid Waste Plan. County staff is researching the answers to these various questions that have been raised. Another alternative that is being pursued is to obtain an export agreement with Alameda County to obtain adequate landfill capacity for Contra Costa County. An application for waste import has been submitted to Alameda County. The County will be involved in these negotiations. These negotiations will begin soon and it is estimated that they may take approximately six to nine months to complete. This alternative seems to be the most feasible at this point in time. Due to the various unanswered questions involved with each alternative being considered and the length of time needed to execute an alternative once one is selected, the Board of Supervisors of Contra Costa County requests that the California Waste Management Board grant a one year extension to allow adequate time to thoroughly investigate all alternatives in order to prepare an adequate plan revision for resubmittal to your Board.
