HomeMy WebLinkAboutMINUTES - 05101988 - 2.1 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 10, 1988 by the following vote: AYES: Supervisors Powers, Fanden, McPeak, Torlakson, Schroder NOES: None ABSENT: None ABSTAIN: None ------------------------------------------------------------------ ------------------------------------------------------------------ SUBJECT: East County Rape Crisis Unit The Board received the attached report from the County Administrator, in response to the Board' s request dated April 12, 1988, relative to action to be taken regarding the East County Rape Crisis Unit contract. Supervisor Tom Torlakson commented on the importance of the services provided by the East County Rape Crisis Unit and the need to continue those services without interruption. He recom- mended that the County Administrator proceed immediately with both the financial audit and a performance review and evaluation in order to resolve the matter as soon as possible. John Coker, member of the Board of Directors of the East County Rape Crisis Unit, expressed the belief that the Grand Jury Report was a preliminary report only and that the County should proceed with its own investigation prior to making any decision relative to funding and/or termination of the contract. Sherry-Ann Nichols, member of the Board of Directors of the East County Rape Crisis Unit, read for the record a letter from a client of the Rape Crisis Unit commenting on the value of the services provided by the Rape Crisis Unit and the need for the continuation of such services. She also submitted a letter for the record from the East County Rape Crisis Center, urging that funding continue while the audit and evaluation are being conducted. Phil Batchelor, County Administrator, stated that the District Attorney had advised that because proper documentation has not been submitted as requested and in light of the the Grand Jury Report, his Office would no longer authorize payments to the East County Rape Crisis Unit without further direction from the Board of Supervisors. Supervisor Torlakson noted that the Grand Jury had not done a performance evaluation, and again stressed the need to continue the services provided by the East County Rape Crisis Unit. He recommended that the County Administrator conduct the reviews as noted in Recommendation A, and that funding resume upon completion of those reviews. Supervisor Tom Powers inquired as to whether or not the agency would continue to operate in the interim. Victoria Porter, Director of the East County Rape Crisis Unit, advised that her staff would continue to provide services. Board members being in agreement, IT IS ORDERED that the County Administrator is AUTHORIZED to arrange for a financial audit and a performance review and evaluation of the East County Rape Crisis Unit, said audits to be funded from the East County Rape Crisis Unit' s current budget. If it: is the Board's desire to better understand the current operation of the East County .Rape Crisis Unit (ECRCU), authorize the County Administrator to contract with an appropriate,. independent CPA firm to do a financial audit and an outside contractor to do a performance review and evaluation, or B. If it is theBoard,'s desire to accept the Grand Jury's -recommendation (to immediately terminate the existing contract), direct the County Administrator to issue a notice of- termination. pursuant to paragraph 5.a. of General Conditions of the current contract and request the District Attorney, with assistance from the County Administrator's Office, to immediately implement a plan. for the continued provision of rape crisis .services in eastern Contra Costa County. REASONS FOR RECOMMENDATION/BACKGROUND: The 1987-88 'Contra Costa County Grand Jury has prepared a report, dated March 30, .1988, on the ECRCU, which is funded by County general funds. The current year contract with the Unit is in the .amount of $49,899 covering the period July 1, 1987 through June 30, 1988. The first and major recommendation of the Grand Jury is that "the County immediately terminate the existing contract with. the ECRCU a'nd, select a qualified organization to provide these services". The report details the financial mismanagement of County funds by the Unit and the lack of adequate financial and internal controls, including an ineffective and poorly organized Board of Directors. On April 12, your Board received this report from' the Grand Jury and ordered the report referred to the County Administrator. This Office has thoroughly reviewed the report and discussed it with. a number of individuals, including the Project Director and several members of the Board of Directors of the ECRCU. The first option would be to accept the recommendations of the Grand Jury's report and terminate the existing contract with the ECRCU. General Condition #5.a. provides one mechanism for doing this in that it allows the County to cancel the contract upon 30-day advance written notice to the contractor. Exercising this option would also require the County to find another mechanism for continuing to provide rape crisis services to eastern Contra Costa County. The other option would be to use the findings of the Grand Jury's report as guidelines for a separate County performance and financial audit of the ECRCU and the services it provides. In order to carry out this option, this Office believes that outside professional help must be contracted for. We believe that expertise will be required in two areas: 1) financial audit, and 2) performance review and evaluation. This Office has preliminarily investigated and identified individuals who would be qualified to do this work over the course of the next month and a half. This would require two separate purchase of services agreements which would total approximately $6,000 to $8,000. The District Attorney's Office has separately sent a letter to each Board member indicating that given the Grand Jury's report, the District Attorney's Office will make no further payments under the contract to the ECRCU without your Board's authorization.
