SUBJECT: Request Of Serafino Bianchi For Reconsideration Of The
Board Decision To Deny Application For Land Use Permit
No. 2048-87 In The Alamo Area.
On March 22, 1988, the Board of Supervisors sustained the denial
decision of the San Ramon Valley Regional Planning Commission 'as the
Board of Appeals relative to Land Use Permit Application #2048-87
filed by Serafino Bianchi to establish a pre-school facility at 1420
Livorna Road in the Alamo area.
The Clerk of the Board of Supervisors received a letter dated
March 25, 1988 from Serafino Bianchi, 4347 Cowell Road, Concord,
President, Bianchi Schools, requesting that the Board of Supervisors
reconsider the matter.
Supervisor Schroder advised that the matter before the Board
today was whether to grant reconsideration and hold a hearing, and
agreed to take very brief statements from individuals desiring to
speak.
Supervisor Fanden commented that she was willing to deny Mr.
Bianchi' s request at this time for all the reasons stated at the last
public hearing and moved to deny the request for reconsideration.
Supervisor Schroder seconded the motion.
Supervisor McPeak questioned staff relative to the procedure for
a proposal by Mr. Bianchi for less than 65 children.
Karl Wandry, Community Development Department, responded to i
Supervisor McPeak' s inquiry.
Supervisor Fanden commented on the character of the neighborhood
not being a neighborhood in transition nor new development, and
advised that it would be a violation of that neighborhood to impose
this child care center on it no matter what the number.
Supervisor McPeak commented that the ordinance does not speak to
neighborhoods in transition.
Supervisor Schroder advised that he was not referring to the
child care ordinance but was referring to the land use permit
provisions.
Karl Wandry advised the Board that Mr. Bianchi had not applied
for anything less than 65 children.
Serafino Bianchi, Bianchi Schools, commented that the Board by
denying his project had violated its own policy, and requested a
reconsideration by the Board on this matter.
Frank Bellici, 1430 Livorna Road, Alamo, commented that there was
no new evidence in this case, and no reason for the Board to reverse
its stand on the matter. He commented also that Mr. Bianchi does not
own the property involved and that this is not a question of child
care but a question of land use.
