III . REASONS FOR RECOMMENDATION/BACKGROUND
By resolution dated January 21 , 1958 , the Board of Supervisors of
Contra Costa County gave assurances of local cooperation! to the
Corps of Engineers for the Walnut Creek Project . Among these
assurances are requirements to pay in cash 7 . 4 percentlof the
Federal project construction cost and to provide for the
relocation of all roads , bridges and utilities required for' the
project . The Corps of Engineers has agreed to include relocation
work in the Federal project at 100 percent local cost to be paid
as "Contributed Funds Other ."
On August 26 , 1986 the Board of Supervisors approved and executed
a Joint Exercise of Powers Agreement with the City of Walnut
Creek which obligated the Flood Control District to pay 7 . 4
percent of the cost of a channel cover funded by the City and
included in the Federal project as a " Contributed Fund Other"
item .
Under current State law the local costs of relocation work
required for the San Ramon Bypass and the Upper Pine Creek
Projects are 100 percent and 90 percent reimbursable ,
respectively, by the Department of Water Resources .
IV . CONSEQUENCES OF NEGATIVE ACTION
Failure to authorize the issuance of a warrant would be cause for
the Corps of Engineers to stop further work on the Walnut Creek
Project .
