" t J Property Tax Exemption for Nursing SUBJECT; Homes and _Related Items SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1 . Consider this report as an emergency item pursuant to the . Brown Act. thereby allowing its consideration on April 26 , 1988. 2 . Refer to the Health Services Director to incorporate with other nursing home issues the feasibility . of increased payments under the Medi-Cal Program for nursing homes which accept a specified number ofr,Medi-Cal patients. Also consider placing .a condition on land use permits for nursing homes that the proposed nursing home accept its fair share of Medi-Cal .patients. 3 . Authorize the Health Services Director and County Administrator to conduct a fiscal analysis of the viability of having the County purchase the Regency Hills nursing home in Pittsburg and/or a retirement home in Pleasant Hill which is also available for purchase. 4 . Remove this item as a referral to our Committee. BACKGROUND: On February 23 , 1988 , the Board of Supervisors referred to our Committee a report from County Counsel relative to property tax exemptions for nursing homes. In County Counsel' s opinion, he notes that in. order to provide a property tax exemption for -nursing homes a Constitutional amendment would be required to exempt the nursing home' s real property and that legislation approved by a two-thirds vote of each house would be necessary to exempt personal property belonging to a nursing home. Supervisor McPeak also brought to our Committee' s attention on April 25 the fact that the Regency Hills Nursing Home in Pittsburg has been cited by a State licensing staff for quality of care issues. The State has insisted that the owners sell the facility or otherwise transfer their equity in the facility to a new owner. Supervisor McPeak also noted that there 'is a retirement home for sale in Pleasant Hill. CLERK OF THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR BY ,DEPUTY M382/7-83 — Page: 2 While it is clear that a fiscal analysis would need to be conducted regarding the viability of purchasing either of these facilities, our 'Committee believes that we cannot continue to allow available. nursing home beds which accept Medi-Cal patients to go bankrupt or. otherwise to be forced out of business thereby reducing the available number of nursing home beds in the County which accept- Medi-Cal patients. in view -of the difficulty of providing a real .property exemption from property taxes for nursing homes, we .would prefer looking at providing .-higher reimbursement to those nursing homes which agree to accept .a substantial number of Medi-Cal patients and to add' a condition to `land use permits for approval of nursing homes in. .the unincorporated area of the County that the owner agree to accept a fair share of Medi-Cal patients as a condition of receiving a land use permit. We would also like the Health Services, Director and County Administrator to consider the possibility of purchasing either of the facilitiesnoted above. A report on this matter should be made to the full Board as soon as possible.
