THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on April 26, 1988 by the following vote:
AYES: Supervisors Powers, Fanden, McPeak, Torlakson, Schroder

ABSENT: None

SUBJECT: McFarland Energy, Inc. Drilling Pad at Tosco
The Board received the attached report dated April 14,
1988 from Harvey E. Bragdon, Community Development Director,
related to the proposed natural gas well drilling pad at the Tosco
Refinery near Martinez.
Paul Kilkenny, Community Development Department, advised
that the Fish and Wildlife Study Committee had reviewed the issue
and concurred with staff ' s recommendations.
In response to an inquiry from Supervisor McPeak, Mr.
Kilkenny stated that the Fish and Wildlife Study Committee had not
made a site visit to the proposed drilling pad area. Supervisor
McPeak then suggested that the matter be referred back to the Fish
and Wildlife Study Committee for further review.
Supervisor Fanden noted that the Environmental Health
Department had previously been requested to report on the
feasibility of establishing a permanent monitoring system on all
creeks and channels in the County. She requested that that report
be provided to the Board as soon as possible.
Supervisor McPeak noted that, in light of the recent oil
spill in the Carquinez Straits, she felt it was appropriate for the
Fish and Wildlife Study Committee to investigate all existing
systems in the wetlands area and to develop a plan for monitoring
and preventing future spills of this nature.
Board members being in agreement, IT IS ORDERED that the
following actions are APPROVED:
1. REFERRED the issue of construction of a natural gas well
drilling pad at the Tosco Refinery near Martinez to the
Fish and Wildlife Study Committee for further review;
2. REQUESTED the Fish and Wildlife Study Committee to
investigate all installations along County waterways and
the wetlands area and report to the Board with
recommendations for monitoring of such installations;
and
3 . REQUESTED Dan Bergman, Environmental Health Director, to
report to the Board on May 24, 1988 or sooner on
proposal to monitor creeks and channels.

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
1 . Direct staff to request that wetland mitigation be provided
in a nearby area and that the mitigation reflect the value
of a producing gas well.
2. Direct staff to request that the Corps of Engineers follow a
full public notice EIR/EIS if additional drilling pads are
requested.
FINANCIAL IMPACT

BACKGROUND
On January 19 , 1988 , the Board of Supervisors referred to the
Community Development Department a letter from the Mt. Diablo
Audubon Society requesting the Board to take a position in oppo-
sition to the proposal submitted by McFarland Energy, Inc. to
construct a drilling pact adjacent to the Tosco Avon refinery.
McFarland Energy, Inca has requested authorization from the Corps
of Engineers to construct a drilling pad (File No. 17163E10) .
The Corps published a notice of the request and has received
responses from a number of environmental agencies, including the
U.S. Fish and Wildlife Service, California Department of Fish and
Game, National Marine Fisheries Service, and the United Stated
Environmental Protection Agency expressing concern about the loss
of wetlands. These letters and objections have been forwarded to
the applicant for consideration and response. The applicants
have indicated to the Corps that they will resolve the objections
and have agreed to the recommended modifications to its original
application for the Department of Army permit.
The project consists of the construction of�--a- earth--pad,.about 14'0
feet long by 260 feet, on which a gas drilling rig will be con-
structed. If gas is found, the earth till ea will be reduced
to about 70 by 125 feet. If gas is not f nd e e ire pad
will be removed.

Paul Kilkenny, of Community Development staff, made a field
review of the site in company of Gerald B. Faudel, Environmental
Program supervisor for Tosco. The project has also been consid-
ered by the Fish and wildlife Committee. The Committee ' s major
concerns are the possibility, that if the drilling is successful,
it will be a precedent to numerous other pads which would be, in
the cumulative sense, very detrimental to the wetlands in the
area and that mitigation take into account the value of a produc-
ing well.
