SUBJECT: Support for AB 3500 - Areias y
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
That the Board of Supervisors support AB 3500 - Areias,
"Foster Care Eligibility for Relatives Caring for a Child. "
Further, that the Board authorize the County Welfare Director
to send a letter of support for AB 3500 to Assemblyman Areias
and include data regarding out-of-home placement costs and
waiting time for such placements.
BACKGROUND:
AB 3500 proposes amending AFDC-FC eligibility to allow
relatives, caring for children needing out-of-home placement,
the same aid options currently available to non-relatives.
Under current law, non-related guardians of children
ineligible for Federal Foster Care, may select either AFDC or
AFDC-FC payments; relatives have only the option of AFDC. Aid
payments differ as shown below:

0-4 yrs. 5-8 yrs. 9-14 yrs. 15-20 yrs.
AFDC only $311/mo. $311/mo. $311/mo. $311/mo.
AFDC-FC $294/mo. $319/mo. $340/mo. $412/mo.
Fewer than 100 children were Federally ineligible in Contra
Costa last year. Thus, the shared State/County cost would be
negligible to allow relatives the same option as non-relatives
for either AFDC or AFDC-FC payments, in allowing relatives the
same options as non-relatives. AB 3500 encourages family
unity, and a family environment for children needing
out-of-home placement.

Children in out-of-home placements are automatically eligible
for AFDC only. Establishing Income Criteria for relatives, as
proposed in the Appropriations Committee, is meaningless.
Additionally, an Income Criteria for relatives continues
discriminatory treatment, intrudes into the relatives '
finances, and imposes additional paperwork.
