SUBJECT: Contract Administration for Willow Pass Grade Third
Lane Project, West Pittsburg Area
Specific Request(s) or Recommendation(s) & Background &
Justification
I. RECOMMENDATION
APPROVE the concept of the Public Works Department providing
project engineering, inspection contracting and administration
for the Willow Pass Westbound Third Lane Project, to be
constructed this summer using East Central County Corridor AOB
funding, and
AUTHORIZE the Public Works Director to prepare the necessary
plans and specifications and agreements between Caltrans and the
County for said work.
II. FINANCIAL IMPACT
It is anticipated that risk management and legal costs resulting
from potential lawsuits filed in connection with the work will
cost the County $20, 000 to $25, 000. .

III. REASONS FOR RECOMMENDATION/BACKGROUND
The installation of a third westbound lane is urgently needed to
meet the traffic demand on the Willow Pass grade during the a.m.
peak traffic movement. The County, in conjunction with the '
Cities of Antioch and Pittsburg, has developed funding for
implementation of this interim improvement to the state highway,
until such time as the freeway will be rebuilt with the Willow
Pass grade lowering project.
Caltrans has advised that the earliest they can advertise the
project is in August. This schedule precludes construction
completion in 1988. The only way the project can proceed on
schedule is for the County to take over the project contract
award and administration.
It must be recognized that the performance of the work by the
County will undoubtedly lead to lawsuits by motorists traveling
on this very busy road during construction. It should be
anticipated that a dozen accidents will probably occur. These
accidents will probably be alleged to have been caused by the
construction work or status of the freeway during the time of
construction. The contractor performing the work will be
required to carry insurance and to hold the County and the State
of California harmless for such accidents. However, as in all
lawsuits, those named must spend time and funds to protect
themselves. The Public Works Department finds that the risk is
worth taking when compared to the benefits of advanced completion
of the project.
The Transportation Committee will review this matter on April 11,
1988.
IV. CONSEQUENCES OF NEGATIVE ACTION
The interim widening project on Highway 4 will not be completed
until the Fall of 1989 .
