FROM: cc: Perfecto Villarreal , Executive Director SUBJECT: THE OSBORN COMPANY V. HOUSING AUTHORITY OF CONTRA COSTA COUNTY COMPROMISE AND MUTUAL RELEASE I. RECOMMENDED ACTION: AUTHORIZE Chairman of the Board of Commissioners to EXECUTE the Compromise and Mutual Release to be entered into in the Osborn case, approved as to form by County Counsel . II. FINANCIAL IMPACT: Sufficient funds for payment of both the necessary legal fees and the settlement on this lawsuit are available in the Development Account for CA 011015, Elder Winds, Anti"och. III. REASONS FOR RECOMMENDATION/BACKGROUND: On January 12, 1988, in closed session, the Board of Commissioners approved a proposed settlement on the Osborn lawsuit. In accordance with HUD regulations, that proposed settlement was reviewed and approved by HUD Regional Counsel . The Housing Authority has now received the original settlement agreement to be entered into in .the Osborn case and the Compromise and Mutual Release has been approved as to form by County Counsel . IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not authorize the Chairman to execute the Compromise and Mutual Release in the Osborn case, the Housing Authority could find itself in costly extended legal proceedings.
