Phil Batchelor, Contra County Administrator CxJ.7lGl DATE* April 11, 1988 (JO^ SUBJECT Legislation: Assembly Bill 2717 (Klebs) SPECIFIC REQUEST(S) 'OR RECOMNENDAT.ION(S) & BACKGROUND AND ,JUSTIFICATION RECOMMENDATION:- Adopt , a ECOMMENDATIONrAdopt, a position of opposition to AB 2717 by Assemblyman Klehs which would effectively, make it. impossible for the Assessor to hire private assessors for appeals cases. BACKGROUND: Under existing law, appraisals of property may either be done by employees of the Assessor' s Office or by contract appraisers. In Contra, Costa� County initial appraisals are done by the Assessor' s staff.. In cases where the property- owner appeals the Assessor' s valuation of the property the Assessor may contract for an outside expert appraisal, particularly where the property is relatively unique or the issues involved are extremely complex. . A contract appraiser is compensated based on the complexity of the case and the time required to properly value the property and testify at the appeals-hearing. Assemblyman Klehs has 'introduced AB . 2717 which, as amended March 14, 1988, provides. that. any contract for appraisal work by the individual who is not an employee of the State, a county or city must 'contain- a provision that in the event of an appeal the appraisal work will be defended at .no additional charge. It is alleged that. the reason for AB 2717 is to discourage a contract appraiser from artificially inflating the appraisal on a piece of property, thereby encouraging an appeal for which the appraiser can then be paid again. However, the .' Assessor says what the practical consequen%ce will .be is to prevent the Assessor from using a contract appraiser, since he cannot pay extra for appeals work. In those cases where a contract appraiser does ' the initial . valuation of . the .property, it is reasonable to assume the appraiser will charge more for the initial appraisal to cover the possibility of an appeal. In addition, a contract appraiser can be expected to under-value propertyin an effort to avoid any. The Assessor urges the Board of Supervisors to oppose AB 2717 and this office concurs with that recommendation.
