SUBJECT: Regulation of Large Trucks Parked in Residential
Districts and Shopping Centers
The Board considered the reports of the Health Services
Director and the Sheriff-Coroner relative to the regulation of
large trucks parked in residential districts and shopping centers.
(Copies are attached and included as a part of this record. )
The Board concurred with the recommendations as set forth in
the reports. There was agreement on the need to review local and
state laws to insure that law enforcement agencies are covered by
statutes to address this issue.
Supervisor Fanden recommended that the Board support legisla-
tion aimed at regulating the conveyance of radioactive materials.
She further recommended that the reports be referred to the Direc-
tor of Community Development for comment.
Following discussion, the Board took the following actions:
1. ACCEPTED the report of the Health Services Director;
2. REQUESTED County Counsel to review provisions of the
County Ordinance Code and State Vehicle Code and recommend
legislative actions required to strengthen local laws and
State Law in prohibiting the parking of large trucks in
shopping centers;
3 . APPROVED recommendations of the Sheriff as set forth in
the attached reports relative to posting of signs
prohibiting overnight parking in shopping centers,
increase in enforcement activities, and dedication of
revenues received to fund increased enforcement by the
Sheriff;
4. AUTHORIZED Chairman to sent letter to the County' s
Legislative Delegation expressing support for legislation
to include the regulation of trucks carrying radioactive
materials;
5. REQUESTED the Director of Community Development Department
to review the attached reports of the Health Services
Director and Sheriff relative to non-conforming uses
and zoning enforcement, and report to the Board on
May 10 , 1988.

Residential Districts and Shopping Centers
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION :
Accept report from Health Services Director and direct
County Counsel to review the provisions of the Vehicle Code
and recommend any legislative action available to Contra
Costa County to strengthen the State law in prohibiting the
parking of large trucks in shopping centers .
BACKGROUND :
On February 9, 1988, the Board of Supervisors requested the
Health Services Director, County Counsel , Public Works
Director, and Sheriff to make recommendations relative to
possible legislative action to regulate the parking of
vehicles hauling hazardous materials within commercial and
residential areas .
Based on reports submitted by the Sheriff ' s Office and
Public Works Department (copies attached ) , we concur with
the recommendations of the Sheriff ' s Office as follows :
- "Owners of shopping centers post their property with
signs stating a prohibition of overnight parking .
- Increase the bail and fine amounts on the schedule
followed by the courts to an amount that clearly is
punitive in return for parking violations .
- Revenues from fines should be dedicated to the Sheriff ' s
Department budget for increased enforcement activities
in that area of community concern .
- The Board should indicate a desire for more active enfor-
cement by- the Sheriff ' s Department ; however, must realize
the impact on staff vs called-for-services ; i . e. , serious
criminal activity. "

This report is submitted as an update to your Board' s January 12-, --
1988 , inquiry regarding issues raised by the toxic emission
incident on Sunday, January 10, 1988 , at Tara Hills Shopping
Center; and the Board' s February 9, 1988 , request to review the
matter of trucks parking at neighborhoods and shopping centers.
I Board Order - January 12 , 1988 (Update)
The initial response to the January 10th incident was
coordinated by the Sheriff ' s Department Patrol personnel,
with cooperation of other responding agencies.
A. Response Review
An administrative review was completed regarding the
response to the incident.
Generally, all agencies responded in accordance with
the County protocol. The minor exceptions identified
related to the sequence of notification and evidence
gathering. (See Attachment #1)
These issues have been reviewed with staff in a
training format.
Increased cooperation between enforcement agencies and
continuing "Hazmat" training is the best solution for
handling future incidents.
B. Who has jurisdiction for enforcement on the streets ,
or private property and in shopping centers
Regarding jurisdictional responsibilities. Parking and
vehicle code enforcement on County streets remain the
primary responsibilities of the California Highwav
Patrol . Private property parking violations are
handled by the Sheriff ' s Department through applicable
County ordinances , usually on a as—time permits or

B. Cont' d.
The Sheriff ' s Department has recently increased our
self-initiated activities in cooperation with various
business and homeowners groups. Whenever possible will
mare County ordinance violation citations.
C. What action, if any, can be taken aaainst the Driver
and Co=anv?
Criminal Investigations
Follow-up investigation was completed by Deputy E.
Templeton, working with representatives from
Health Services, the District Attorney, and Pinole
Fire District.
This resulted in a Misdemeancr, criminal ccmplaint
against the driver - Glenn Dean Middlina, Jr. , for
violation of Section 25191 (d) of the California
Health and Safetv Code - Unlawful Storage of
Hazardous Waste. ( See Attachment #2)
A conviction could carry a fine of $5,000 maximum,
or one ( 1 ) year in County Jail.
The District Attorney will also pursue a civil
complaint against Chemical Transfer of Stockton,
CA. , for restitution of emergency response actions
taken by Contra Costa County.
D. Allegation by Mr. Glenn Middling of Law Enforcement
permission to park at Tara Hills Shopping Center
During the criminal investigation of the toxic
emission, Mr. Middling was interviewed by Deputy E.
Templeton.
Information gathered did not support the allegation
that he had received "permission" to park at the
location from any law enforcement personnel.
Page 3
March 24, 1988
D. Cont'd.
Mr. Middling felt he had "implied" permission, because
approximately one ( 1) year previously, he had parked
there while two ( 2) Deputy Sheriffs were at the
location conducting unrelated business. The Deputies
were unaware of his actions, and took no action due to
the priority of criminal activity around the area.
The Sheriff' s Department does not grant anyone
permission to park on private property. This has been
re-emphasized to Patrol staff.
E. Do we need to have new legislation introduced?
In our opinion there is existing law already available
to handle the majority o= hazardous material
transportation issues .
Continued training of responding agency personnel and
public education is a key.
One area of concern relates to trucks parked on private
property or driving through the area that are placarded
"radioactive. "
It does not appear there is an existing law that
restricts or prohibits "radioactive" truck routes.
(This was confirmed through Mr. Chuck Taylor,
Department of Energy - Radioactive Transport Division
and Sergeant David Firkins, California Highway Patrol) .
Sergeant Firkins advised legislation is being
considered to amend existing law to include
"radioactive" materials with that which restricts the
"Explosives-Category A" designated routes. However, it
is not expected to take effect before January 1989.

II Board Order 2/9/88 - Toxic Cas Leak at Tara Hills Shopping
Center; Truck Parking Restrictions
The Health Services Director, County Counsel, Public Works
Division, and Sheriff-Coroner were requested to review the
matter of large trucks parking in neighborhoods or shopping
centers, and return to the Board with recommendations
relative to possible legislative action.
We have reviewed the issue and feel the problem of
commercial vehicles parking in shopping centers cannot be
addressed by specific CVC violations or County ordinances .
The County Ordinance Section 46-4. 003 is not applicable for
the following reasons :
a. ls4- the area is not a "residential district" as defined
by CVC 515 . It is a "business district" as defined in
CVC 235 .
b. 2nd, the County ordinance clearly states the vehicle
must be "on any County street or highway, or portion
thereof . " In this instance the complaints pertain to
parking on "private property" (The shopping center)
and, therefore, not applicable.
Additionally, the original ordinance (Co Ord #79-88) wording
at the time of adoption-August 7 , 1979 (Attachment #3 ) does
not lend itself to a "positive" enforcement approach.
During the period of March 1978 and August 1979, the issues
surrounding the adoption of Co. Ord. #79-88 were reviewed.
When the Board adopted the Ordinance they stated,
essentially that while there would truck parking
restrictions, signs would not be posted. County Counsel had
advised that without a sign, enforcement would be extremely
difficult (See Attachment #4) .
Further the ordinance states C.H.P. would not enforce the
ordinance, leaving the burden of enforcement to the Sheriff.
(Attachment W .
Page 5
March 24, 1988
The Board indicated the Sheriff ' s Department should respond
to complaints only, instead of assuming the enforcement
burden of seeking out violations . (See Attachment #15 ; Memo
dated July 11, 1979 from Vern Cline to Sheriff Rainey) .
Finally, should the above deficiencies be corrected and a
violator was found guilty by the court, the 'Line is only
twenty-eight ($28.00 ) dollars.
on March 10, 1988, represettatives from the Sheriff ' s
Department, California Highway Patrol, Health Services and
Public Works met with the Tara Hills Community Association.
The issues as set forth above were discussed. (See
Attachment #6)
Based on our review and discussions we recommend.
-owners of shopping centers post their property with
signs stating a prohibition of overnight parking.
-Increase the bail and fine amounts on the schedule
followed by the courts to an amount that clearly is
punitive in return for parking violations.
Revenues fr'om fines should be dedicated to the Sheriff ' s
Department budget for increased enforcement activities in
that area of community concern.
-The Board should indicate a desire for more active
enforcement by the Sheriff ' s Department; however,
must realize the impact on staff vs called-for-ser-rices;
i.e. , serious criminal activity.
The Sheriff' s Department will continue to work with the
community, the Board of Supervisors and other agencies to
mitigate these issues.

HAZ-,KkT Spill
I met with Deputy District Attorney Sepulveda regarding the
District Attorney' s r6a irements for pursuing any hazardous
material prosecutions.
As I indicated' in an earlier Ccnversaticn, the District
Attorne -' S pCSition is that they desire a clear violation of
Calirorn_a Vehicle Code or Health & Safety Codes in order to
consider issuing any ccmplaint regarding hazardous
materials, spills or emissions . Sepulveda states that the
District Attorney will nOt attemmt anv civil
restituticn/recover of Costs if no viol tion can be
articulated. He recommends we have the COunt"T COU'nSel
attempt civil remedv in those areas.
HeJ of course, desires that all hazardous material cases be
routed through hint for review, and if the District Attorney
decides the case has no criminal merit he will point cut
deficiencies , if possible, and/or Suggest ccnt3Ct with
County Counsel.
With regard to the Tara Hills incident, -Sepulveda felt that
the initial casef i le written by Sheriff 's Office and Health
Services report, accempanied .by the Pinole Fire Department's
report, had many unanswered questions and significant lack
of prosecutable information.
Sepulveda highlighted the following deficiencies:

Sepulveda left me with the impression that chances for
misdemeanor criminal prosecution was slim at this point.
On January 2E , 1988 , I recontacted S-Middling, admonished
him and attempted to gain significant information which
Might show criminal intent or negligence.
I discovered through contact with the General Manager
of Chemical Transfer (responsible company) that S-Middling
had in fact been disciplined 'on a prior occasion for parking
the truck in another shopping area. The General Manager was
angry that S-Middling had again chose to ignore the
ccmpanies long standing requirement to park HAZ-MAT vehicles
at contracted secure industrial facilities. -- - --- -
Your ccncern about S-Middling receiving "permission" to park

On June 12, 1979, at the' renuest of Supervisor Hasseltine,
the Board of Supervisors referred to the Public Works Director -and County Counsel a letter fron 'Rr. Joseph Covello, Nblin/San
Ramon Services District , requesting that the County adopt an
ordinance to prohibit ccnmercial vehicles free+ parking for long
periods of tine on streets within the Dublin/San Ramon area.
The Public Works Director submitted a report dated
July 2, 1979 setting forth two basic options if the Board wishes
to initiate a program to control commercial vehicle parking in
residential districts: (A) Commercial Vehicle Parking Pestriction,
and (B) Weight Limit on Residential Streets.
Board members discussed the provisions of each option, and
determined to adopt the provisions of Option A set forth in the
Public Works Director's report as follows:
"A. Commercial Vehicle Parvina Restriction
Pursuant to Section 22507.5 of the Vehicle Code, the Board
can adopt regulations (by ordinance or resolution) to prohibit the
parking of commercial vehicles weirhir.g o.•tr 10,000 pounds in a
residential district on a county-wide or specified Street basis.
"The Vehicle Code defines a residential district. Most roads
I where commercial vehicle parking complaints are received are within
t1,1s code definition. However, sore complaints are received for
roads not included in the Code definition.

"County regulations adopted under Section 22507.5 may not
require the posting of sires; Concord and Pichnond and Alameda
County have had such an ordinance for some tire and they do not sign

that without sign posting such an ordinance may be extremely difficult
to enforce. The cost of a rrogran to initiate such parkinv, control
would be increased substantially if sign posting is reouired.

Commercial vehicle Parking in Residential Districts
This !♦ a follow up to your—sumo—dated July ) , 1979. In which i
you coacnente9J on my proposed report to the—Board of Supervisors on
this subject.
On Juiy ia. 1979, the Board approved option A of the attached
Public Works Department ' s Report A. The aoard stated their preference
that this restriction be initiated without the Installation of signs
and that the Sheriff' s Department should respond to complaints only,
Instead of assuming the enforcement burden of seeking out vloiatlons.
The board also directed County Counsel to prepare the appropriate
ordinance to be applied on a Countywide basis, therefore, you way
wish to check with County Counsel on this matter.

Subject: Ccx--.errial Vehicle Pork;nq in Residential Distri1Lts
(Item on Puhl is Works Agenda for July 10, 1919)
The matter of commercial vehicles parking in residential districts
was investigated at length in early 1.079 by the Board. the Public
Works Director , and County Counsel . The conclusions reached at
that time are still valid; namely . that the Board has two basic
options if it wishes to initiate a program to control commercial
vehicle parking in residential districts.
These options are :
A. Commercial Vehicle Parking Restriction
Pursuant to Section 22507.5 of the Vehicle Code, the Board can
adopt regulations (by ordinance or resolution) to prohibit the parking
of commercial vehicles weighing over 10,000 pounds in a residential
district on a Countywide or specified street basis. !
• The Vehicle Code defines a residential' district . Most roads
where commercial vehicle parking complaints are received are within
this code definition. However . some complaints are received for
roads not included in the Code definition.
County regulations adopted under Section 22507.5 may not require
the posting of signs ; Concord and Richmond and Alameda County have
had such an ordinance for some time and they do not sign post the
restrictions. Our County Counsel however , has cautioned that without
sign posting such an ordinance may be extremely difficult to enforce .
The cost of a program to initiate such parking control would be in-
creased substantially if sign posting is required.
It is the position of the California Highway Patrol that the
Patrol will not enforce local ordinances Implementing the Vehicle Code;
therefore, the burden of enforcement would rest with the Sheriff . No ,
estimate of his budget requirements has been made.
4
t.
B. We;cht limit on Res identiat Streets
Pursuant to Section 35712 of the Vchicto Code , the Board can •
. establish a 14 .000 pound load limit on a specific residential street
1 provided there is an unrestricted alternate route for such traffic .

Board of Supervisors - 2 - June 26, 1979
Such load '. unitrestriction require
signs along the street ,
so any program to increase such restrictions will require appro-
.z, priate increases in the traffic signing budget .
' = Enforcement of such load limits is the res;onsibility of the
California Highway Patrol . However, recent changes In CHP policy
concentrates their activities on certain major routes. local toads
i
are no longer patrolled routinely.
r
:. Summary
Each of the above options has .advantages and disadvantages.
'''•.ti- Both require additional expenditures by the Public Works Department
and , in the case of Option A, by the Sheriff.
I believe option A is the better solution to area,.,,ide problems
such as brought up by the Dublin-San Ramon Services District .
4 n.
Option B may often be the better solution for isolated single
i street problems.
If the Board determines to pursue a program of restricting
cor^nercial vehicle parking in residential district3 , it is recom-
mended that the Board indicate the level of signing and enforcement
expected so that costs and budget adjustments for the program tan
i
be determined by the Sheriff and Public Works Director before any
%` program is finally adopted.

Reference is glade to your memorandum of June 22, 1979, regarding
the above subject which was forwarded to me by Leory Vukad on a
routing slip dated June 27. 1979.
My staff has reviewed this document and indicates that the most
acceptable option in the document would be"Option A. Cocaerical
Yehicle Parking Restriction". While this is the most acceptable
of the two options. enactment of this ordinance will increase
the enforcement burdens on our Patrol Oivisinn.

CONTRA COSTA COUNTY. STATE OF CALIFORNIA
In the Natter of Proposal for ) <
Restricting Co=ercial Vehicles ) March 7, 1978
Parking in Residential Areas. )
The Board on January 17. 1978 having requested its Internal
Operations Co:maittee (Supervisors W. N. Boggess and J. P. Kenny) to
study the question of whether a need exists for an ordinance (under
Vehcile Code Section 22507.5) to prohibit parking of cocmercial vehicles
in unincorporated residential areas; andThe Co=ittee having this day reported that it had reviewed.
the January 17. 1978 report of the Public Works Director on this matter,
that it found no evidence that a significant problem suints in unincor—
porated areas of the County, that based on the Vehicle Code definition
of a "residence district" such an ordinance would not apply to most of
the co=p:aints. and ttat County Counsel and County Sheriff-Coroner are _
of the opinion that the ordinance provisions would be very difficult
to enforce; and
Tht Ccmittee having reco=ended therefore that the proposed
ordinance not be adopted at this time but that the Public Warks Director
review on an individual basis each complaint about co=ercial vehicles
parking in residential areas and attempt to resolve the problem wi:h the
offending truck operator; and
Supervisor E. H. Hasseltine having stated that he favored
adoption of an ordinance so as to have so= basis for restricting
parking of co=ercial vehicles on those streets where there are
problers; and -)
Supervisor N. C. Fanden having indicated agreement With

particular problem areas in her district; and

On March 7, 1975. t:;e Board c! Surer%•.%ars directed the PUbllc Works
Director and County counsel to work wl*t., Supertiscr i.assC.tit•.e on
drafting a general ordinance to prohibit co—+arcial vehicles from
Parking in residential areas.
The County Counsel advises Chats (1) the Vehicle Code does not re-
quire the Hoard of Supervisors to adopt a general or *blanket"
ordinance to control co=arcial vehicle parking; (2) the Board of i
Supervisors may, by adoption of a Resolution, prohibit or restrict
the parking of cc=zercial vehicles of a certain weight on specific
streets which are located in 'residential districts' in the sass
as:ner that the roar: presently uses to adopt or establiah other
types of traffic regulations.
It should be *_-3te¢ lhaz 4 general ordinance to prohibit co=,Brcial
e7ii3 rk3nr residential districts would be a new progress
which would require additional budget appropriations in the Sberiff*3
Departzent for eanfoxeezent and in the Public Forks DepaZtzent for
r purchisinq and installing appropriate sinus.
` It should also be noted that girsuant to Section 35712 of the
'`,a nornli de ccTe"Code,, the Board of Supcsviaors r..ag establi tb a
14,000 pound load limit on^a residential street. It is the opinion
of the Public: Wor..s Di_ectr that in a st irsstancaes where co-plaints
have be" received by Lha board, the establishment of a weight licit
restriction would be ire appropriate than u parking restriction.
The reasons aro that til t.hs 14,000-pound load limit will be on-
forced by the Calixornia Highway Patrol whereas the burdens to esn-
fores the dar ting rssstrictions would be placed on the Sheriff;
a (2) the load limit is loss costly to post s•car.>se it W1.11 require
a smaller sssaEber of signs and (3) the load limit will prevent the
va jority of the larger trucks from evens entaria2 into the residen-
tial arca or subdivisions while 'the parking restriction would oily
prevent tb>sne from parking on a particular street.
Tor these reasons, it is reco=vatsd ed that the Director continue to
review all c%mpla.ints concerning commercial vehicle parking as t ey
arise and advise the Board as to which restriction„ naaeoly parking
or weight limit, would be the most appropriate to resolve the prob-
les. !

PUBLIC 'WORKS DEPARTMENT
CONTRA COSTA COUNTY
DATE:,j,Kebruary 23, ;1,4I$$ { t
TO: Mark Finucane, Health Services Director = -
FROM: J. Michael Watford, Public Works Director
SUBJECT: Board of Supervisors Referral !
On February 9, 1988, the Board of Supervisors requested the Health Services
Director , County Counsel , Public Works Director and Sheriff, to make
recommendations relative to possible legislative action to regulate the parking
of vehicles hauling hazardous materials within commercial and residential areas.
I have read Dan Bergman' s memo dated February 9, 1988, to the Board of
Supervisors on this subject. Generally, I agree with his statements about not
finding specific existing statues or regulations applicable to this issue.
If the Board of Supervisors wishes to pursue additional legislation on this
matter, perhaps the current Vehicle Code Sections #31303 and #31304 (pertaining
to transporting hazardous materials) could be amended to include "designated safe
parking areas" similar to those contained in Section #31614 C.V.G. pertaining to
vehicles transporting explosives . At this time, we are not sure what role or
involvement the Public Works Department has in this matter. If you need further
input from this Department, please contact Leroy Vukad, our Traffic Engineer, at
646-4470.

of Supervisors

Dear Chairman Schroder:
As you are aware, the Board of Supervisors directed the Sheriff to
investigate a problem regarding large commercial tractor-trailer
vehicles, parking and transiting through residential areas.
This problem is a major concern for various citizen action groups.
The Tara Hills Community Association specifically has been
experiencing a compounded problem with this type of vehicle parking
in their neighborhood while carrying or containing hazardous
materials residue.
Our investigations have revealed what the Sheriff ' s Department
believes to be a "weak link" in our ability to assertively address a
resolution to this situation.
It appears , after review of the County Ordinances, that there
currently is no ordinance which directs its attention to this
problem.
It is, therefore, the Sheriff ' s recommendation that County Ordinance
46-4. 003-Parking, Commercial Vehicles; be amended to include
language which would preclude commercial vehicles over 10,000 lbs.
from standing, parking, or entering a residential district. More
specifically, forbid any hazardous material carrier, loaded or empty
(includes residue) from transiting a residential district to stand
. or park on any County street or highway or private property.
Current exemptions can be maintained.

We furthermore believe that current bail schedule for this ordinance
does not offer anyone choosing to ignore signs or laws, a viable
deterrence in the form of a realistic or proportionate fine. We
encourage a stiff bail be affixed. We propose a $200 mandatory fine
for normal commercial vehicles and an enhanced mandatory fine of
$500 for any hazardous material carrier.
At your convenience and discretion, Lieutenant Wm. Shinn or myself
would be available -to meet with you to further discuss this problem i
and recommendation.
Sincerely yours,
RICHARD K. RAINEY, Sheriff-Coroner
