(Copies are attached and included as a part of this record. ) The Board concurred with the recommendations as set forth in the reports. There was agreement on the need to review local and state laws to insure that law enforcement agencies are covered by statutes to address this issue. Supervisor Fanden recommended that the Board support legisla- tion aimed at regulating the conveyance of radioactive materials. She further recommended that the reports be referred to the Direc- tor of Community Development for comment. Following discussion, the Board took the following actions: 1. ACCEPTED the report of the Health Services Director; 2. REQUESTED County Counsel to review provisions of the County Ordinance Code and State Vehicle Code and recommend legislative actions required to strengthen local laws and State Law in prohibiting the parking of large trucks in shopping centers; 3 . APPROVED recommendations of the Sheriff as set forth in the attached reports relative to posting of signs prohibiting overnight parking in shopping centers, increase in enforcement activities, and dedication of revenues received to fund increased enforcement by the Sheriff; 4. AUTHORIZED Chairman to sent letter to the County' s Legislative Delegation expressing support for legislation to include the regulation of trucks carrying radioactive materials; 5. BACKGROUND : On February 9, 1988, the Board of Supervisors requested the Health Services Director, County Counsel , Public Works Director, and Sheriff to make recommendations relative to possible legislative action to regulate the parking of vehicles hauling hazardous materials within commercial and residential areas . Based on reports submitted by the Sheriff ' s Office and Public Works Department (copies attached ) , we concur with the recommendations of the Sheriff ' s Office as follows : - "Owners of shopping centers post their property with signs stating a prohibition of overnight parking . - Increase the bail and fine amounts on the schedule followed by the courts to an amount that clearly is punitive in return for parking violations . - Revenues from fines should be dedicated to the Sheriff ' s Department budget for increased enforcement activities in that area of community concern . - The Board should indicate a desire for more active enfor- cement by- the Sheriff ' s Department ; however, must realize the impact on staff vs called-for-services ; i . e. , serious criminal activity. Rainey 1 Subject: Shopping Center Sheriff-Coroner I This report is submitted as an update to your Board' s January 12-, -- 1988 , inquiry regarding issues raised by the toxic emission incident on Sunday, January 10, 1988 , at Tara Hills Shopping Center; and the Board' s February 9, 1988 , request to review the matter of trucks parking at neighborhoods and shopping centers. I Board Order - January 12 , 1988 (Update) The initial response to the January 10th incident was coordinated by the Sheriff ' s Department Patrol personnel, with cooperation of other responding agencies. A. Response Review An administrative review was completed regarding the response to the incident. Generally, all agencies responded in accordance with the County protocol. The minor exceptions identified related to the sequence of notification and evidence gathering. (See Attachment #1) These issues have been reviewed with staff in a training format. Increased cooperation between enforcement agencies and continuing "Hazmat" training is the best solution for handling future incidents. B. Who has jurisdiction for enforcement on the streets , or private property and in shopping centers Regarding jurisdictional responsibilities. Parking and vehicle code enforcement on County streets remain the primary responsibilities of the California Highwav Patrol . Private property parking violations are handled by the Sheriff ' s Department through applicable County ordinances , usually on a as—time permits or AN ECUAL OPPORTUNITY EMPLOYER Page 2 March 24 , 1988 B. Cont' d. The Sheriff ' s Department has recently increased our self-initiated activities in cooperation with various business and homeowners groups. Whenever possible will mare County ordinance violation citations. C. What action, if any, can be taken aaainst the Driver and Co=anv? Criminal Investigations Follow-up investigation was completed by Deputy E. Templeton, working with representatives from Health Services, the District Attorney, and Pinole Fire District. This resulted in a Misdemeancr, criminal ccmplaint against the driver - Glenn Dean Middlina, Jr. , for violation of Section 25191 (d) of the California Health and Safetv Code - Unlawful Storage of Hazardous Waste. ( See Attachment #2) A conviction could carry a fine of $5,000 maximum, or one ( 1 ) year in County Jail. The District Attorney will also pursue a civil complaint against Chemical Transfer of Stockton, CA. , for restitution of emergency response actions taken by Contra Costa County. D. Allegation by Mr. Glenn Middling of Law Enforcement permission to park at Tara Hills Shopping Center During the criminal investigation of the toxic emission, Mr. Middling was interviewed by Deputy E. Templeton. Information gathered did not support the allegation that he had received "permission" to park at the location from any law enforcement personnel. Page 3 March 24, 1988 D. Cont'd. Mr. Middling felt he had "implied" permission, because approximately one ( 1) year previously, he had parked there while two ( 2) Deputy Sheriffs were at the location conducting unrelated business. The Deputies were unaware of his actions, and took no action due to the priority of criminal activity around the area. The Sheriff' s Department does not grant anyone permission to park on private property. This has been re-emphasized to Patrol staff. E. Do we need to have new legislation introduced? In our opinion there is existing law already available to handle the majority o= hazardous material transportation issues . Continued training of responding agency personnel and public education is a key. One area of concern relates to trucks parked on private property or driving through the area that are placarded "radioactive. " It does not appear there is an existing law that restricts or prohibits "radioactive" truck routes. (This was confirmed through Mr. Chuck Taylor, Department of Energy - Radioactive Transport Division and Sergeant David Firkins, California Highway Patrol) . Sergeant Firkins advised legislation is being considered to amend existing law to include "radioactive" materials with that which restricts the "Explosives-Category A" designated routes. However, it is not expected to take effect before January 1989. Page 4 March 24, 1988 II Board Order 2/9/88 - Toxic Cas Leak at Tara Hills Shopping Center; Truck Parking Restrictions The Health Services Director, County Counsel, Public Works Division, and Sheriff-Coroner were requested to review the matter of large trucks parking in neighborhoods or shopping centers, and return to the Board with recommendations relative to possible legislative action. We have reviewed the issue and feel the problem of commercial vehicles parking in shopping centers cannot be addressed by specific CVC violations or County ordinances . The County Ordinance Section 46-4. 003 is not applicable for the following reasons : a. ls4- the area is not a "residential district" as defined by CVC 515 . It is a "business district" as defined in CVC 235 . b. 2nd, the County ordinance clearly states the vehicle must be "on any County street or highway, or portion thereof . " In this instance the complaints pertain to parking on "private property" (The shopping center) and, therefore, not applicable. Additionally, the original ordinance (Co Ord #79-88) wording at the time of adoption-August 7 , 1979 (Attachment #3 ) does not lend itself to a "positive" enforcement approach. During the period of March 1978 and August 1979, the issues surrounding the adoption of Co. Ord. #79-88 were reviewed. When the Board adopted the Ordinance they stated, essentially that while there would truck parking restrictions, signs would not be posted. County Counsel had advised that without a sign, enforcement would be extremely difficult (See Attachment #4) . Further the ordinance states C.H.P. would not enforce the ordinance, leaving the burden of enforcement to the Sheriff. (Attachment W . Page 5 March 24, 1988 The Board indicated the Sheriff ' s Department should respond to complaints only, instead of assuming the enforcement burden of seeking out violations . (See Attachment #15 ; Memo dated July 11, 1979 from Vern Cline to Sheriff Rainey) . Finally, should the above deficiencies be corrected and a violator was found guilty by the court, the 'Line is only twenty-eight ($28.00 ) dollars. on March 10, 1988, represettatives from the Sheriff ' s Department, California Highway Patrol, Health Services and Public Works met with the Tara Hills Community Association. The issues as set forth above were discussed. The Sheriff' s Department will continue to work with the community, the Board of Supervisors and other agencies to mitigate these issues. As I indicated' in an earlier Ccnversaticn, the District Attorne -' S pCSition is that they desire a clear violation of Calirorn_a Vehicle Code or Health & Safety Codes in order to consider issuing any ccmplaint regarding hazardous materials, spills or emissions . Sepulveda states that the District Attorney will nOt attemmt anv civil restituticn/recover of Costs if no viol tion can be articulated. HeJ of course, desires that all hazardous material cases be routed through hint for review, and if the District Attorney decides the case has no criminal merit he will point cut deficiencies , if possible, and/or Suggest ccnt3Ct with County Counsel. With regard to the Tara Hills incident, -Sepulveda felt that the initial casef i le written by Sheriff 's Office and Health Services report, accempanied .by the Pinole Fire Department's report, had many unanswered questions and significant lack of prosecutable information. On January 2E , 1988 , I recontacted S-Middling, admonished him and attempted to gain significant information which Might show criminal intent or negligence. I discovered through contact with the General Manager of Chemical Transfer (responsible company) that S-Middling had in fact been disciplined 'on a prior occasion for parking the truck in another shopping area. Joseph Covello, Nblin/San Ramon Services District , requesting that the County adopt an ordinance to prohibit ccnmercial vehicles free+ parking for long periods of tine on streets within the Dublin/San Ramon area. The Public Works Director submitted a report dated July 2, 1979 setting forth two basic options if the Board wishes to initiate a program to control commercial vehicle parking in residential districts: (A) Commercial Vehicle Parking Pestriction, and (B) Weight Limit on Residential Streets. Board members discussed the provisions of each option, and determined to adopt the provisions of Option A set forth in the Public Works Director's report as follows: "A. Commercial Vehicle Parvina Restriction Pursuant to Section 22507.5 of the Vehicle Code, the Board can adopt regulations (by ordinance or resolution) to prohibit the parking of commercial vehicles weirhir.g o.•tr 10,000 pounds in a residential district on a county-wide or specified Street basis. "The Vehicle Code defines a residential district. Most roads I where commercial vehicle parking complaints are received are within t1,1s code definition. The conclusions reached at that time are still valid; namely . that the Board has two basic options if it wishes to initiate a program to control commercial vehicle parking in residential districts. These options are : A. On February 9, 1988, the Board of Supervisors requested the Health Services Director , County Counsel , Public Works Director and Sheriff, to make recommendations relative to possible legislative action to regulate the parking of vehicles hauling hazardous materials within commercial and residential areas. I have read Dan Bergman' s memo dated February 9, 1988, to the Board of Supervisors on this subject. Generally, I agree with his statements about not finding specific existing statues or regulations applicable to this issue. If the Board of Supervisors wishes to pursue additional legislation on this matter, perhaps the current Vehicle Code Sections #31303 and #31304 (pertaining to transporting hazardous materials) could be amended to include "designated safe parking areas" similar to those contained in Section #31614 C.V.G. pertaining to vehicles transporting explosives . At this time, we are not sure what role or involvement the Public Works Department has in this matter. This problem is a major concern for various citizen action groups. The Tara Hills Community Association specifically has been experiencing a compounded problem with this type of vehicle parking in their neighborhood while carrying or containing hazardous materials residue. Our investigations have revealed what the Sheriff ' s Department believes to be a "weak link" in our ability to assertively address a resolution to this situation. It appears , after review of the County Ordinances, that there currently is no ordinance which directs its attention to this problem. It is, therefore, the Sheriff ' s recommendation that County Ordinance 46-4. 003-Parking, Commercial Vehicles; be amended to include language which would preclude commercial vehicles over 10,000 lbs. from standing, parking, or entering a residential district. More specifically, forbid any hazardous material carrier, loaded or empty (includes residue) from transiting a residential district to stand . or park on any County street or highway or private property. Current exemptions can be maintained. We encourage a stiff bail be affixed. We propose a $200 mandatory fine for normal commercial vehicles and an enhanced mandatory fine of $500 for any hazardous material carrier.
