Adopted this Order on March 8, 1988. by the following vote:
AYES: Supervisors Powers, Fanden, McPeak and Torlakson

ABSENT: Supervisor Schroder
ABSTAIN: None
SUBJECT: Hearing on Recommendation of the Zoning Administrator on
Development Agreement Relative to the Development Shadow
Creek in the Tassajara Area.
The Board of Supervisors on March 1, 1988, continued to this date
the hearing on the recommendation of the Zoning Administrator on the
request by Dame Construction to review and approve the Development
Agreement relative to the development known as Shadow Creek in the
Tassajara area.
Karl Wandry, Community Development Department, presented a brief
history of the request by Dame Construction and described the project
area. He commented that the Town of Danville still had some concerns
as to when fees would be collected as the project goes forward. He
presented the staff recommendation to accept the environmental
documentation as adequate, accept the development agreement as
proposed, adopt the appropriate ordinance and authorize the Director
of Community Development to sign the agreement on behalf of the County
after the Dame Construction Company representative has signed it.
The public hearing was opened and the following people appeared
to speak:
Michael Rupprechet, 2070 San Ramon Valley Boulevard, San Ramon,
representing Dame Construction Company, expressed agreement with the
proposed Development Agreement.
Joe Callabrigo, 510 La Gonda Way, Danville, Chief of Planning,
the Town of Danville, commented that the Town of Danville did not
object to the County' s proposal to enter the agreement and requested
the assistance of the Board in seeing that all of the improvements
that are required of this project are completed in the soonest
possible time frame. He requested two things of the Board: 1. asking
the developer to stipulate to paying the fees at an earlier date, at
the time of the final map and to include this in the Development
Agreement; and 2. in lieu of that request that the Board consider
directing the staff to satisfy the requirements of Government Code
Section 53077 which would allow for the collection of the fees at an
earlier date, that being the final map, prior to approving and
recording this Development Agreement.
The Board discussed the collection of the fees in other
Development Agreements.
Paul Speroni, 245 Joseph Lane, Pleasanton, requested a
continuance on this matter because he had received the revised
Development Agreement just yesterday, and he expressed concerns
including collection of the fees and amending development plans and
conditions.
Karl Wandry responded to Mr. Speroni' s concerns.
Michael Rupprechet spoke in rebuttal, requesting no more
continuances of this matter and commenting on the Leonard Bill and
that there is a statute in the State of California that defines how
fees are collected.

The public hearing was closed.
The Board discussed the issues including the requests of the Town
of Danville, and asked staff if they were or were not recommending the
request.
Karl Wandry commented that staff was not recommending the request
but they did not totally disagree with it either, and that staff was
recommending what had been done throughout the County on various other
Development Agreements.
Supervisor Torlakson commented on a similar mechanism in East
County in the fee benefit areas to have the option to call the fees
in at the map or if there is not a construction project ready to go to
defer it to another point of call until the building permit at which
time the fees absolutely must be called. He also expressed that he
recommended deferring this matter for two weeks and letting Supervisor
Schroder have an opportunity to review the testimony.
The Board discussed whether to defer the matter.
IT IS BY THE BOARD ORDERED that decision on the Development
Agreement relative to the project known as Shadow Creek in the
Tassajara area is DEFERRED to the March 22, 1988 determination
calendar.
