SUBJECT: Landfill Site Ballot Advisory Measures
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Approve landfill site ballot advisory measure(s ) for the
June 7 , 1988 election ballot where the following criteria are
complied with:
a. A majority of the Board expresses its intent to
approve the site' s development entitlements if the voters approve
the site' s advisory vote measure.
b. For the site, the Planning Commission has approved
an Environmental Impact Report and rendered its decision, on the
site entitlements (or such actions can reasonably be expected to
have been completed prior to a June election) .
C. At this time, the Board schedules for its June 21,
1988 meeting calendar entitlement approval for any ,site advisory
measure approved by the voters on June 7, 1988.
2 . Any June advisory ballot measure should be in
substantially the following form:
"Should the Contra Costa County Board of
Supervisors approve the
Landfill site provided
that this site is approved by all
appropriate regulatory agencies and
thereby meets environmental standards?"

BACKGROUND:
On February 23, 1988, the Board of Supervisors referred to
this Committee, the Internal Operations Committee and the
Community Development Director the proposal of formulating ballot
language and a procedure for an advisory election on new landfill
site(s ) . We met February 29 with representatives of County staffs
to discuss this proposal.
Concern was expressed at the meeting that if advisory new
landfill site measure(s ) should be presented to the voters, it
must be done in a manner that will result in any voter approved
measure(s ) being implemented in the very near future. If that is
not the result, it doesn't appear appropriate to involve (and
possibly misled) the entire County electorate with the
consideration of advisory ballot measure(s) that can't be
implemented this year. Also, concern was expressed as to the
possibly County election expense and loss of staff time in
pursuing a proposal that can't be implemented. Therefore, the
following criteria should be met before calling any advisory
landfill site election:
1. An expression of intent and commitment by a majority of
the Board should be made that they will act favorably on the site
after voter approval.
2 . Only a site or sites that have filed County entitlement
applications and received Planning Commission certification of
their EIR and decision (or can reasonably be expected to have such
actions completed) prior to the time of the election will be
presented to the voters.
3 . The advisory election must be on the June 1988 ballot.
4 . Within two weeks after the June election, any site
approved by the voters should be scheduled on the Board calendar
for entitlement approval.
5. The advisory ballot measure for any proposed landfill
site should be in substantially the following form:
"Should the Contra Costa County Board of
Supervisors approve the
Landfill site provided
that this site is approved by all
appropriate regulatory agencies and
thereby meets environmental standards?"
