Resolution of Termination of
Offer of Dedication
(S. & H. Code Section 8335)
SUBJECT: Termination of Offer of Dedication of Wayne Court,
No. V2043 D, Project #7891-6X1795, Pleasant Hill Area.
The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Termination of an Offer of Dedication of a certain excess
right of way not required for road purposes, is made pursuant to
Government Code Section 7050 and to Division 9, Part 3, Chapter 4
of the Streets and Highways Code, commencing with Section 8330.
The termination request is for an Offer of Dedication of a five
foot wide strip of land offered for road purposes which is
located adjacent to the previously vacated road known as Wayne
Court, located in the Pleasant Hill area. A description of the
offered area to be terminated is attached hereto as Exhibit "A"
and incorporated herein by reference. The area has not been used
for the purpose for which it was dedicated for five consecutive
years immediately preceding the date of this action. (S. &
H. Code Section 8333) .
Considering all facts before it, this Board FINDS there is no
reasonable probability that the County will accept the offered
area into the County road system or for maintenance, that no
public money has been expended for maintenance of the offered
area, and that it is in the best interests of the County and the
public that the offered area be privately owned and maintained.
This Board hereby FINDS that the proposed termination will not
have a significant effect on the environment, and that it has
been determined to be categorically exempt from the California
Environmental Quality Act under State CEQA Guidelines Section
15312 . The proposed termination is not located in an area of
statewide, regional or areawide concern. The Public Works
Director is ORDERED to file a Notice of Exemption with the County
Clerk.
RESOLUTION NO. 88/109
This Board hereby TERMINATES the hereinabove described offer of
dedication and ABANDONS the right of the County to accept said
offer. The Board is not aware of any existing in place utilities
in the subject area.
The Real Property Division is ORDERED to record a certified
copy of this Resolution in the office of the County Recorder.
From and after the date this resolution is recorded, the offer
of dedication is terminated and the County's right to accept
offer is abandoned.

All of that parcel of land described in the Offer of Dedication accepted for
recording only, recorded November 27, 1979 in Book 9633 of Official Records,
at page 103, Records of Contra Costa County, California, being a portion of
the parcel of land described in the deed to Rrabert G. Zimwmn, et al,
recorded December 29, 1978 in Book 9165 of Official Records, at page 781,
records of Contra Costa County, California, lying in the Rancho Las Juntas,
described as follows:
A strip of land 5.00 feet in width, the easterly line of which is described
as follows: Beginning on the westerly line of Wayne Court, as said street
is shown on the map of "Tract 2147, Oakmore," filed April 26, 1955 in Book
58 of Maps, at page 9, records of said county, at the northerly line of said
Zimwrman, et al parcel (9165 OR 781) ; thence, frac said Point of Beginning
along said westerly line of Wayne Court, south 00 53' 30" west, 271.53 feet;
thence, southeasterly along a tangent curve concave to the northeast, having
a radius of 90.00 feet, thrown a central angle of 530 58' 3511, an arc
distance of 84.79 feet to the most northerly corner of Icvt 14 as shown on
said map of Tract 2147 (58 M 9) .
Containing an area of 0.041 acre, (1793 square feet) of land, more or less.
