SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND
JUSTIFICATION
I. Recommended Action:
DETERMINE that release of the Deferred Improvement Agreement
described in this Board Order will not jeopardize completion
of the agreed upon improvements, in that the improvements are
no longer needed. RELEASE and TERMINATE the Deferred
Improvement Agreement (9633 OR 110) recorded against the
property described in attached Exhibit "A" pursuant to
Government Code Section 66499, and DIRECT Real Property
Division to have certified copy of this Board Order recorded
in County Recorders Office.
II. Financial Impact:
None
III. Background and Reasons for Recommendations:
On November 20, 1979, the Board of Supervisors approved a
Deferred Improvement Agreement with Robert E. Zimmerman, et

Court in the Pleasant Hill area.
The County's plans for redevelopment of the Pleasant Hill
BART Station area required the vacation of Wayne Court which
has been completed. There is no need for the Deferred
Improvement Agreement for frontage improvements now that the
road itself is not needed.
IV. Consequences of Negative Action:
Delay of implementation of redevelopment plans.

EXHIBIT "A"
All of that parcel of land described in the Deferred Improvement Agreement,
recorded November 27, 1979 in Book 9633 of Official Records, at page 110,
Records of Contra Costa County, California, being a portion of the parcel. of
land described in the deed to Robert G. Zin, et al, recorded December
29, 1978 in Book 9165 of Official Records, at page 781, records of Contra
Costa County, California, lying in the Rancho Las Juntas, described as
follows:
A strip of land 5.00 feet in width, the easterly line of which is described
as follows: Beginning on the westerly line of Wayne Court, as said street
is shown on the map of "Tract 2147, Oakmore," filed April 26, 1955 in Book
58 of Maps, at page 9, records of said County, at the northerly line of said
Zimmerman, et al parcel (9165 OR 781) ; thence, from said Point of Beginning
along said westerly line of Wayne Court, south 00 53' 30" west, 271.53 feet;
thence, southeasterly along a tangent curve concave to the northeast, having
a radius of 90.00 feet, through a central angle of 530 58' 3511, an arc
distance of 84.79 feet to the most northerly corner of Lot 14 as shown on
said map of Tract 2147 (58 M 9) .
Containing an area of 0.041 acre, (1793 square feet) of land, more or less.
