March 8, 1988 CO * SUBJECT: vim' t` Legislation: Assembly Bill 4062 (Baker) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AMID JUSTIFICATION RECOMMENDATION: Adopt a position of support for AB 4062 which was introduced by Assemblyman Baker at . the request of the Board of Supervisors. BACKGROUND: Under current law, if a dependent special district becomes independent, its contribution to the Special District Augmentation Fund is rolled back to the 1983-84 fiscal year. This was probably done because the current code section was enacted in the 1984-85.. fiscal year and 1983-84 would have been the last full fiscal year prior to the effective date of. the existing Code section. If a dependent fire district were to become independent and its contribution were rolled back to the 1983-84 fiscal year, there would be a substantial reduction in funds available in the Special District Augmentation Fund. The fire district itself would not suffer any loss of funds because all of the tax increment since the 1983-84 fiscal year would be allocated directly to the fire district. However, because of this. County' s agreement that 800 of the funds in- the Augmentation Fund will go to the fire districts, the result of allowing a fire district to be directly allocated all of the tax increment since 1983-84 would be to reduce funds available to non-fire special districts, such as the library. We do not believe the Legislature .intended that for all future years the contribution to the Augmentation Fund would be rolled back to 1983-84 regardless of .when the district might become independent. We have, therefore, asked Assemblyman Baker to . introduce AB 4062 which simply specifies that the contribution to the Augmentation Fund will be frozen at the, level contributed during the last full fiscal year before . the district became independent. This bill is a part of the Board' s Legislative Program for 1988 and it is, therefore, appropriate that the Board support AB 4062 and acknowledge that it is the sponsor of this legislation.
