Coons (Owner) , requests to rezone 5 acres from General Agricultural District (A-2) to Single Family Residential District (R-40) in the Morgan Territory area. (2) Initiation of review of the area designated as Single Family Residential - very low density, in the General Plan for the Morgan Territory area. (S.D.V) SPECIFIC RBgUEST(S) OR REC01g4ENDATIONS(S) 6 BACKGROUND AND JUSTIFICATION RECOMMENDATIONS (1 ) Adopt the environmental review documentation as being adequate. (2) Adopt 'the County Planning Commission's findings as set forth in its Resolution #11-1988 as the basis for your Board' s decision. (3 ) Approve rezoning application 2742-RZ as amended by the County Planning Commission (Rezone to R-100 instead of R-40) and thereby recommended on February 23,1988. 4. Introduce the ordinance giving effect to the rezoning; waive reading and set date for the adoption of same. 5. Initiate review of the area designated as Single Family Resi- dential - Very Low Density, in the General _Plan for the Morgan Territory area. BACKGROUND Application 2742-RZ, to rezone 5 acres located at 3103 Morgan Territory Road, .7 miles south of Marsh Creek Road from General Agricultural (A-2) to Single Family Residential (R-40) : Applica- tion filed by Bellecci & Associates on behalf of Robert D. Coons. Subject parcel lies within the area designated as Single Family Residential - Very Low Density, in the General Plan for the Morgan Territory area. Mary Fleming, Community Development Department, described the site and the location and commented on the Planning Commission recommendation of rezoning from A-2 to R-100, and on the staff recommendation to adopt the Planning Commission' s findings and approve the rezoning to R-100. Supervisor Torlakson questioned whether the rezoning was in conformance with the General Plan. Mary Fleming responded that it was and that part of the Planning Commission recommendation was to initiate a study of the area designated as Single Family-Very Low Density in the Morgan Territory area. The public hearing was opened and the following people !appeared to speak: Frank Bellecci, representing Robert Coons and Bellecci & Associates, 2552 Stanwell Drive #201, Concord, requested approval for the rezoning to R-100 as before the Board today. Susan Howell, 210 Tumbleweed Court, Clayton, expressed support for the proposed review of the Morgan Territory area and for change back to five acre parcels and a rural setting. Robert Coons, 3103 Morgan Territory Road, Clayton, owner, presented a brief history of the site and the General Plan in the area and requested approval of the rezoning to R-100. Robin Griffiths, 3133 Morgan Territory Road, Clayton, spoke in support of the review of the General Plan in the Morgan Territory. Gene Wagner, 3149 Morgan. Territory Road, Clayton, spoke against subdividing the area in any form, and expressed concern for setting a precedent for further subdivision by granting this request. Darlene Abbas, 5780 Morgan Territory Road, Clayton, commented against anything other than A-2 -zoning in the area. Harvey E. Toponce, 4970 Morgan Territory Road, Clayton, spoke against the rezoning but in favor of the review of the General Plan for the area. Frank Bellecci spoke in rebuttal. The public hearing was closed. The Board discussed the matter. Supervisor Torlakson requested clarification on when the General Plan was adopted, and expressed concern with the timing of the adoption of General Plans for areas and the rezoning of areas. Mary Fleming responded that the General Plan for this area was probably begun in 1980 and adopted in 1981. On recommendation of Supervisor Torlakson, IT IS BY THE BOARD ORDERED that recommendations 1, 2, 3 , and 5 are APPROVED; and as in recommendation 4, Ordinance No. 88-29 is INTRODUCED, reading waived, and April :5, 1988 is set for adoption of same; and Community Development staff is REQUESTED to process rezoning more promptly following General Plan Amendments.
