RECOMMENDATION•
Adopt a position of support for AB 2907 by Assemblyman Stirling
which allows the current owner of a home to obtain a copy -of the !
building plans for his or her home without having to obtain the '
written permission of the architect who signed the original
plans.
BACKGROUND:
Under current law, a copy of the building plans for a building
for which the building department issued a building permit must
be on file and available for public inspection, with certain
specified exceptions. However, in order to obtain a copy of the.
building plans, an individual must obtain the written permission
of the registered professional or successor who signed' the
original documents and the owner. of the building. Otherwise, an
individual must obtain a court order to obtain a copy of the
building plans. This means the current owner of a building
cannot obtain a copy of the plans for his or her own home, office
building, or store without the written permission of the
architect or other registered. professional who signed the plans.
This individual is frequently no longer available and may have no
successor. This leaves the owner in the position where the only
way he or she can get a copy of the plans is to obtain a court
order.
Assemblyman Stirling has introduced AB 2907 to remedy this
situation. AB 2907 would authorize the release of a copy of the
building plans with the approval of the registered professional.

Supervisor Fanden has brought to our attention a problem one of
her constituents is having with obtaining a copy of the plans for
his foundation. AB 1 2907 would remedy this situation and
authorize the current owner, on his or her own, to obtain a copy
of the building plans, of his or her own building.

Inasmuch as AB 2907 would resolve a problem faced by homeowners
in trying to obtain copies of the plans for their own homes or
other buildings which are often needed in order to perform
repairs in the future, we believe the Board should support AB
.2907. The. Director of Building Inspection concurs with this
recommendation.
