AYES: Supervisors Powers, Fanden, McPeak, Torlakson and Schroder

SUBJECT: Hearing On Appeal By Peter Ostrosky on Minor Subdivision
67-86 In The Alamo Area.
This being the time heretofore noticed by the Clerk of the Board
of Supervisors for hearing on the appeal by Peter Ostrosky from the
decision of the San Ramon Valley Regional Planning Commission as the
Board of Appeals upholding the decision of the Zoning Administrator
denying the request by Isakson and Associates (applicants) and Peter
Ostrosky (owner) for a minor subdivision to divide 50 ,720 square feet
into two parcels (Minor Subdivision 67-86) in the Alamo area; and
Mary Flemming, Community Development Department, described the
proposal site and location and presented a brief history of the
proposal and the appeal. She commented that the proposal was found to
be exempt from the California Environmental Quality Act (CEQA) so
there was not a negative declaration on this part of it. Ms.. Flemming
advised that the staff had originally recommended approval on the
subdivision because they felt it was basically compatible with the
development in the area and that it was consistent with the R-20
zoning district.
Supervisor Schroder questioned the size of the originally
approved lot within the subdivision.
Supervisor Powers questioned the size of the requested proposed
lots in relation to the other lots in the subdivision.
Ms. Flemming responded to the concerns on the lot size at present
and the size of the proposed lots.
The public hearing was opened and the following people appeared
to speak in favor of the proposal:
Peter Ostrosky, 17 Sugarloaf Terrace, Alamo, commented on the
proposed lot split and issues including the history of the
application, the location of the storm drain easement and requested
approval for the lot split;
Adlai S. Leiby, 930 Virginia Street, Berkeley, building a home on
lot 16 , voiced approval for the proposal;
Robert Lee, 129 Roslyn Drive, Concord, expressed interest in
purchasing parcel B if the lot split were to be approved and commented
on easements both scenic and sewer;
Wayne Robinson, 111 Deerwood Place #200, San Ramon, Real Estate
Developer, expressed an interest in purchasing parcel A of this
subdivision;
Jay Watt, 11 Crow Canyon Court, San Ramon, building a home on lot
12 of the subdivision commented that he had no objection to the split
on this lot if it is in conformity to the project;
Stephen Cline, 1440 Creekside, Walnut Creek, Manager of the
Walnut Creek Branch of the Summit Bank commented on construction loans
the bank had financed in the area and that the bank would approve
financing for two homes on the site but one home on the site would be
an inordinate risk for the bank;
Beatrice Bell, 41 Sugarloaf Terrace, Alamo, commented on issues
including favoring two homes on the lot rather than one and that
traffic is not a problem in the subdivision;
The following person spoke in opposition to the proposal:
Hal Petrie, 1530 Romley Lane, Alamo, representing the Alamo
Improvement Association, presented a brief history of the subdivision
and commented on issues including the number of homes in the
subdivision, the location of the 'storm drain and urged that the Board
of Supervisors support staff, the Zoning Administrator and the San
Ramon- Valley Regional Planning Commission and deny Mr. Ostrosky' s
appeal and not allow the lot split on lot 9 in the Sugarloaf
Subdivision.
Mr. Ostrosky spoke in rebuttal.
The public hearing was closed.
The Board discussed the matter.
Supervisor Schroder commented that he would be willing to defer
action for two weeks so that the Board might have the opportunity to
go out and look at the site.
Supervisor Torlakson commented he would appreciate the time to be
able to look at the site.
On recommendation of Supervisor Schroder, IT IS BY THE BOARD
ORDERED that the hearing on the appeal of Peter Ostrosky from the
decision of the San Ramon Valley Regional Planning Commission denying
Minor Subdivision 67-86 is CLOSED and decision is DEFERRED to March
15, 1988 on the Determination Calendar.
