SUBJECT: Further Consideration Of Request To Initiate A
General Plan Amendment in the Alamo Area by William Walter
Foskett III, Owner.
On January 12, 1988, the Board of Supervisors denied the request
by Mr. William Walter Foskett III and neighbors for a General Plan
review for an approximately sixteen acre parcel located on the south
side of Livorna Road east of Vernal Drive in the Alamo area.
The Board of Supervisors on February 2, 1988 fixed this date for
further consideration of the above request of William Walter Foskett
III .
James Cutler, Community Development Department, presented a brief
history of the area of the subject request and described the site in
question and commented that staff had originally requested that the
study be authorized.
Supervisor Schroder questioned the boundaries of the proposed
study.
Mr. Cutler responded to Supervisor Schroder' s concern that the
area included in any study would be subject to the Board' s direction.
The public hearing was opened. The following people appeared to
speak:
William Walter Foskett III , 100 Vernal Drive, Alamo, presented a
description of the area, a history of the area as it pertains to
planning decisions and justification in support of the requested
study.
Ray Suppe, 71 Tracy Court, Alamo, presented a petition supporting
the request.
Doris Morehouse, 1111 Livorna Road, Alamo, commented that the
majority of people on Douglas Court, her side street, are in favor of
the half acre zoning.
William Morrison, 80 Jennifer Lane, Alamo, speaking on behalf of
a large number of Vernal area residents requested denial of the
Foskett request.
Supervisor McPeak requested clarification from Mr. Morrison on
the history of the zoning of the parcel indicating that she felt it to
be new information not presented prior to today.
David Kristick, 200 Vernal Drive, Alamo, speaking for himself and
his wife, spoke against change in zoning.
Louis Matheis_ l, 69 Jennifer Lane, Alamo, spoke in opposition to
rezoning.

Tori Lawrence, 110 Fairdale Way, Alamo, spoke in opposition to
the Foskett request.
Earl Ramer, 86 Stephanie Lane, Alamo, spoke in opposition to Mr.
Foskett' s request for a General Plan Amendment Review and submitted
several petitions signed by Vernal area residents in opposition to the
request.
Gordon Brasseur, 31 Vernal Court, Alamo, spoke in support of the
Vernal Area Improvement Association policies as outlined by Mr.
Morrison.
Jim Ornellas, 41 Vernal Court, Alamo, spoke against the request
of Walter Foskett.
Hal Petrie, 1530 Romley Lane, Alamo, representing the Alamo
Improvement Association, appeared in opposition to the request.
Mr. Walter Foskett spoke in rebuttal.
The public hearing was closed.
Supervisor Torlakson commented that he was in favor of the study
but had no inclination as to what the outcome should be due to the
lack of detail in front of the Board, and he moved to refer it as a
study, specifically limiting the study to consideration of just the
sixteen acres.
Supervisor Schroder seconded the motion in order to place the
question before the Board.
Supervisor McPeak requested Supervisor Powers to comment on the
timing of the General Plan Update in progress by the General Plan
Congress.
Supervisor Powers commented that he would request the Board to
direct the General Plan Congress to come back with the final report on
the Growth Management Aspect on April 1, 1988 and on the final General
Plan on June 1, 1988. He also commented that it would be his
intention in keeping with the Board' s previous statements not to look
at changes that would make any additional density in development in
the County until such time as those issues have been before the Board
in the General Plan Update and discussed and finalized.
Supervisor McPeak commented that to be consistent with the
Board' s past position, she was inclined not to approve going forward
with the General Plan Study at this time, but that she was
sympathetic at a future date in allowing the study to happen and that
when the work was completed by the General Plan Congress, so that the
Board understands the overview and the framework and the criteria for
development in the County, there would be sufficient background for
the staff to initiate an appropriate study on the sixteen acres.
Supervisor Fanden suggested a compromise to initiate the study
but not until after the General Plan Congress has come up with its
determinations and recommendations to the Board.
Supervisor Torlakson offered a substitute motion, or
modification, which was not to initiate the study at this time, but to
defer action until after July 1, 1988 at which time the Board would
have most of the General Plan issues completed.
Supervisor McPeak seconded the substitute motion, and requested
that the matter be scheduled at one of the first meetings after July
1, 1988 for a status report on the request.
Supervisor Schroder asked for clarification as to whether this
was denying the request at this time.
Supervisor Torlakson commented that it was.

Therefore, IT IS BY THE BOARD ORDERED that the request to
initiate a General Plan Amendment Study in the Alamo area by William
Walter Foskett III, owner is DENIED; and the Community Development
Department is REQUESTED to prepare a status report on the request for
Board consideration after July 1, 1988, following completion of the
General Plan Update.

SUBJECT: Hearing on County Initiated Rezoning Application 2733-RZ
in the Danville Area.
This being the time heretofore noticed by the Clerk of the Board
of Supervisors for hearing on the recommendation of the San Ramon
Valley Regional Planning Commission on the Planning Commission' s
initiated rezoning request ( 2733-RZ) for a change in zoning on
approximately 18 . 25 acres of land from Single Family Residential
(R-20) to Single Family Residential (R-40) in the Danville area, Mary
Fleming, Community Development Department, presented the request and
described the site in question and recommended acceptance of the
environmental documentation as adequate and approval of the rezoning
adopting the San Ramon Valley Regional Planning Commission' s findings.
She commented that the vote of the Planning Commission was unanimous.
The public hearing was opened and the following people appeared
to speak:
Robert Myhre, P.O. Box 153, Alamo, spoke in opposition to the
requested rezoning;
William Bassett, 54 Provo Lane, Danville, spoke in favor of R-40
zoning;
Gregg Coons, 273 Marks Road, Danville, spoke in favor of R-40
zoning;
Jerry B. Vaughn, 295 Marks Road, Danville, did not speak but his
comments in support of R-40 zoning were read into the record;
Charles Jarrett, 305 Cross Road, Danville, representing Alamo
Oaks Homeowners Association and Community Club, presented material to
the Board and spoke in favor of R-40; and Mr. Jarrett also presented
letters of support for R-40 from the following people:
Craig and Yvonne Shotwell;
Mr. and Mrs. James R. Anthony, 256 Marks Road, Danville;
Robert and Dori Bailey, 153 Marks Road, Danville;
John R. Poole, 175 Marks Road, Danville;
John and Rose Fisher, Jr. , 332 Marks Road, Danville;
Ray Rockwell, 2930 Camino Diablo, Walnut Creek, representing Earl
Rossi, presented material dated March 3 , 1988 and requested denial of
the rezoning and he requested a General Plan study to change the
General Plan for this strip of land to single family low density and
he also requested that this matter be sent to the General Plan
Congress;
Heather Estes, 147 Cross Road, Danville spoke in favor of R-40
zoning;
The following people submitted written comments in favor of R-40;
Heather Dawson, 300 Marks Road, Danville;
Elsa Rossetter, 29 Via Aspero, Danville;
Connie Quresehi, 180 Dean Road, Danville;
Ruth Ann Yates, 199 Dean Road, Danville;
Gail Weymouth, 215 Marks Road, Danville;
The public hearing was closed.
Supervisor McPeak commented on the difficulty of the situation
before the Board and requested advice from County Counsel on the legal
implications involved in changing the zoning and commented she would
prefer asking Mr. Schroder' s recommendation before taking final
action.
Victor Westman, County Counsel, responded to Supervisor McPeak' s
concerns relative to the legal implications of the rezoning request.
Mr. Rockwell commented on a similar case in Los Angeles he felt
supported Mr. Rossi' s position.
The Board discussed the matter.
Supervisor Torlakson expressed support for the staff
recommendation.
Supervisor Fanden moved to defer decision on the matter for one
week in order that Supervisor Schroder might review the testimony and
placing the matter on the March 15, 1988 determination calendar.
Mr. Westman advised the Board that Supervisor Schroder would not
be present until the March 22, 1988 meeting.
Therefore, IT IS BY THE BOARD ORDERED that the hearing on the
County Initiated Rezoning request 2733-RZ is CLOSED and decision on
the matter is DEFERRED to the March 22, 1988 determination calendar.
