HomeMy WebLinkAboutMINUTES - 03011988 - 2.1 J TO: BOARD OF SUPERVISORS IM a wi y FROM: Phil Batchelor, County Administrator =}t.r� DATE: February 11, 1988 Costa CO SUBJECT: Additional Housing at Marsh Creek Detention Center, arsh Cre ']c'•1 Authorization No. 0928-WH222E Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATION FIND and DECLARE, pursuant to Public Contract Code Section 20134 , for the reasons stated below, that an emergency exists, and that the repairs and replacements described below are necessary to permit the continued conduct of County operations and services, and to avoid danger to life and property. AUTHORIZE the County Administrator or his representative to proceed in the most expeditious manner, pursuant to Public Contract Code Section 20134, to construct new housing for approximately 120 inmates, and to construct, repair and improve appurtenant facilities and utilities necessary support the housing functions. DECLARE that the project described below is not subject to the provisions of the California Environmental Quality Act, in that the project involves emergency repairs to public service facilities necessary to maintain service, and in that the project involves specific actions necessary to prevent or mitigate an emergency. FINANCIAL IMPACT Construction of the new housing and related support facilities and utilities is fully funded through State Proposition 52 grant funds and County matching funds which have been appropriated. REASONS FOR RECOMMENDATION/BACKGROUND The emergency is created by the overcrowding of inmates in the Martinez Detention Facility and the need to transfer greater numbers of inmates to the Marsh Creek Detention Center. To protect the health and welfare of public,. staff and inmates, actions are required immediately to decrease the overcrowding at .the Martinez facility. The Sheriff-Coroner recommends that the Board declare an emergency and that it proceed to immediately construct new buildings to house approximately 120 inmates of non-violent misdemeanor/light felony classifications to relieve the overcrowding, thus leaving the secure beds at the Martinez Detention Facility for those requiring the greater security. truction and improvement of appurtenant facilities and7i i ies n essary to support the housing functions. Div. and County Administrator Sheriff-Coroner County Counsel By: DEPUTY Add:Ytidriel Housing at Marsh Creek Detention Center Authorization No. 0928-WH222E Page Two The average monthly inmate population in the Martinez Detention Facility has recently been as high as 751 in a facility designed to accommodate 386. Such overcrowding increases danger to the staff and inmates, and it is imperative to initiate immediate action to decrease the population and reduce the potential for such dangers. Existing facilities at Clayton, dating to 1941, are in some cases in noncompliance with current health and safety regulations. The new housing will eventually augment and replace such nonconforming structures. In order to accommodate this proposed expansion, it is necessary to upgrade and expand the existing on-site sanitary system consisting of a septic system and leach field. This system currently is unable to properly handle existing demands resulting in a threat to local public health. Increased populations will cause this health threat to worsen to intolerable levels if the system is not corrected. The normal design, bid, construction process for this work is estimated to require ten to twelve months. The Sheriff-Coroner considers such delay unacceptable. It is possible to bypass the normal procedures for bidding the project and accomplish the project in approximately five to six months through the provisions of Section 20134 of the Public Contract Code when the appropriate findings of an emergency are made by the Board.
