HomeMy WebLinkAboutMINUTES - 03151988 - S.1 si TO: BOARD OF SUPERVISORS FROM: Supervisor Tom Torlakson Contra March 15, 1988 Costa DATE: County REFER TO THE INTERNAL OPERATIONS COMMITTEE THE MA F SUBJECT: ADEQUATE NOTIFICATION TO APPLICANTS OF FLOOD CONTROL AND FIRE DEPARTMENT REQUIREMENTS SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: Refer to the Internal Operations Committee the matter of providing complete and "crystal clear" notification to applicants of flood control and fire department requirements. BACKGROUND INFORMATION: There have been an alarming number of incidents that have been called to my attention recently regarding the county' s alleged lack of notification to applicants during the initial stages of the process regaridng major flood control requirements and fire code requirements. There have been many similar situations that have occurred having to do with applicants finding out at the 1112th hour" of major fire department requirements. One instance involves a minor subdivision application by Bob Anderson (MS 588-88) of 9 .74 acres on Highway 4 near Marsh Creek Road in East Contra Costa County. Apparently, Mr. Anderson and another family purchased this a couple of years ago after checking with county staff and being told he would have no problem in subdividing the property. The two families began the process to subdivide the property recently and only now learned they will be required to put in over a million dollars worth of flood control and drainage improve- ments. On February 2, 1988, I brought up tnc matter of the need for coordination between the Fire Departments and the Building Inspection Department regarding the issuance. of building permits and compliance with fire codes. This need to establish stronger coordination between the two agencies became evident after reviewing recent cases in which this apparently did not occur. One situation involved the Discovery Bay Club House not having a sprinkler system installed. A similar situation occurred with an expansion project by Sure-fit Doors in Pittsburg. I have suggested in the past that FORMAL notification be given to applicants whose project is located in any part of East County or the county where there are drinage and flood control problems. I STRONGLY recommend that this notification -be on a bright flyer and should contain a signature verification by the applicant that they have read and understand these major requirements. This verification should be received and kept for our county files before the applicant is allowed to proceed with the process. I haved developed the attached suggested notification form for flood control requirements. A similar form can be developed for fire code requirements. As I have recommended directly in recent meetings with department heads, I again urge the Building Inspection Department, the Fire Chief, and the Community Development Department to immediately implement a clearer and more focused notification for Flood Control and Fire Code requirements. This can be and should be done administratively prior to the Internal Operations Committee hearing.
