r THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on February 9, 1988 , by the following vote: AYES: Supervisors Powers, Fanden, McPeak, Torlakson, Schroder NOES: None ABSENT: None ABSTAIN: None I ------------------------------------------------------------------ ------------------------------------------------------------------ SUBJECT: Toxic Gas Leak at Tara Hills Shopping Center I In response to Board request of January 12, 1988 , the Board received the attached report dated February 9, 1988 from Mark Finucane, Health Services Director, relative to a toxic gas leak at the Tara Hills Shopping Center, Pinole area. Dan Bergman, Environmental Health Director, advised that in reviewing relevant laws pertaining to parking of hazardous material haulers in residential or commercial areas such as shopping centers, his staff was unable to find specific statutes or regulations applicable to this issue. He noted that the Environmental Health staff is working with the District Attorney' s Office to determine the feasibility of prosecution under the provisions of the State Health and Safety Code. Supervisor Nancy Fanden expressed concern about the lack of effective Statejlaws to control the parking of such vehicles in residential areas and shopping centers, and recommended that proposed legislation be drafted to strengthen existing State laws. Supervisor Tom Powers commented on the ineffectiveness of current regulations. He stated that the problem is two-fold, in that there is both inconvenience to the residents and potential harm from the presence of hazardous material haulers in residential areas. He agreed that there is a need to strengthen existing laws. Supervisor Sunne McPeak commented on the lack of compliance with existing regulations and noted that there is a need for more safety in both transportation of hazardous materials and parking of the vehicles hauling such material. Board members being in agreement, IT IS ORDERED that receipt of the report from the Health Services Director on the toxic gas leak at the Tara Hills Shopping Center is ACKNOWLEDGED. On January 10, 1988, Gabe Adebiyi and Greg Lawler,. Occupational Health Specialists with our Environmental Health Division, responded to a reported release of hazardous vapors at the Tara Hills Shopping Center. Sulfuric acid fumes were apparently escaping from a tanker trailer parked in the shopping center. The vicinity around the fuming trailer was cordoned off and evacuated for several hundred feet by the incident commander until the leak was secured and the plume dispersed. The driver of the tractor trailer, Mr. Glen Middling, with assistance from Pinole fire services personnel, secured the leak. The driver then moved the tank trailer, under escort by Environmental Health staff, to General Chemical Co. on Castro Street in Richmond. Environmental Health staff have reviewed relevant state law including Title 22, California Administrative Code; Department of Transportation (DOT) regulations; California Health and ;Safety Code; and Vehicle Code to determine violations of applicable law relative to parking a hazardous materials hauling vehicle in a shopping center. We did not find specific statutes or regulations applicable to this issue. There are, however, some general provisions in the California Health and Safety Code. Environmental Health D�ivision staff also discussed possible violation of law with the Sheriff's Dep!artment and our District Attorney's Office. The District Attorney is currently reviewing the case for potential prosecution under the provisions of the California Health and Safety Code. Success in prosecuting under the provisions of the Health and Safety Code may give us a more definitive answer to the apolica- bility and effectiveness of current state law. We are continuing to work with the District Attorney on this case. S-Middling concluded with the statement that in his opinion, the Sheriff's Department had grossly overreacted to the circumstance and he felt that no one was any jeopardy of injury at any time. At 1700 hrs, this date I i.r_terviesced Chemical Transfer General Manager, Ellis, Robert Arthur DOB 11-6-54 via telephone. W-Ellis told me that the standing company policy regarding parking of company vehicles overnight in the area of Tara Hills has been to par's them at the locked yard of General Chemical, Richmond. W-Ellis states this policy has been effect for at least three years and S fiddling was well aware of the policy since he had another occurrance of emission in Pinole at the Safeway parking lot on Tara Hills Dr. approximately 1 mile from this location. W-Ellis states S-Middling was issued a citation and fined S313.00 for that incident. Pinole CF87-1061, dtd 4-12-87 is attached to this report. It is apparent that S-i,ddling had 1.mowledge that parking his commercial" trailer in a shopping center posed a three_ to citizens, and was forbidden by law, since he was cited and fined on 4-12-87. McCarty 9325573 Ellis 951L1149 Reported smoke emitting from diesel trailer - Fire Department parked at intersection at Texaco Station at Tara Hills and San Pablo Avenue observed blue fumes escaping from 40 ' acid trailer no tractor - parked at north east corner of Tara Hills Shopping Center lot - Trailer # T-28 with placards in place indicating DOT # 1831 - oleum -j (fuming sulfuric acid) had dispatch notify OES - County Health - CHP - County S.O - Sealed off area bounded by Rim Rd at top - Brian Rd & Tara Hills Dr. - ordered homes evacuated on Brian Rd. both sides of Tara Hills Dr - only first 3-4 homes either direction. Evacuated all shops in shopping center including Texacoi - Nations Big "T" . i Trailer owned by! Cal Tank Stockton - Chemical Transfer, Ilessor - product owned bylteneral Chemical (old Allied) - oleum product is shipped from General Chemical Richmond, Castro St. , to General Chemical, Nichols, Calif. - Port Chicago. Company notified driver - driver responded - Glen Dean Meddling, 41 374 Linda, San Pablo 223-3435 Driver suited upjwith his rubber acid suit - put on one of PFD Scotts and accompanied by 2 PFD fire fighters - in full protective clothing - SCB' s - climbed ladder of tank. Pinole Fire Fighters, Francis and Lowny approached tank - did not climb .on or come in contact with unit. Pinole Fire Fighters signaled that driver had re- tightened dogs on dome cover, leak and fumes stopped. Operation observed through binoculars from San Pablo Ave. and Tara Hills Drive. Occupational Health Specialist Gabe Adebiyi declared area secure. S.O. allowed tractor to hook up to trailer and remove to General Chemical, Richmond for inspection. Note advised driver that tanks will not be allowed to be left unattended in our area - just too dangerous in residential areas. He agreed and will comply. All streets opened and residents, shop keepers, customers, resumed business. Health Dept. received beeper notification approx. 11: 35 - secured and cleared area at 12: 30.
