SUBJECT: West County Justice Center, Project Management Consultant
(O'Brien-Kreitzberg & Associates)
Specific Request(s) or Recommendations(s) & Background & Justification
RECOMMENDATION
APPROVE Amendment No. 3 to the Consulting Services Agreement with
O'Brien-Kreitzberg & Associates, Inc. to extend and expand their management
services, and AUTHORIZE the County Administrator or his designee to execute
the Amendment.
FINANCIAL IMPACT
I
This contract for project management services is currently limited to the
design phases of the West County Justice Center and the bidding and
construction phase of Project A (Project A includes the relocation of
off-site streets, utility extension and rough grading. Project B includes
the construction of the buildings and related on-site improvements) .
Amendment No. 3 has a payment limit of $1,779,715 with the following
programmatic limits: West County Justice Center, Project B (WH101B) ,
Bidding and Construction Phase Services ( $1,579 ,495) ; Martinez Detention
Facility, Remodeling (WH101F) , Project/Construction Management Services
( $65,440 ) ; Marsh Creek Detention Facility, Facility Upgrade (WH222E) ,
Master Planning and Project Management Services ( $134,780) . Funds for
these additional services were budgeted and are currently available. No
additional funds are required.
REASONS FOR RECOMMENDATION/BACKGROUND
As a result of overcrowding at the County' s adult detention facilities in
Martinez, Clayton (Marsh Creek) and Richmond (Work Furlough) , the County
made application for a $36 ,570 , 521 grant to the California Board of
Corrections in 1983 . This grant was approved for the development of the
560-bed West County Justice Center in accordance with the County Jail
Capital Expenditure Bond Act (Proposition 2 and 16) .

Currently under construction is the relocation of city streets and access
roads to adjacent properties, the extension of water storm drainage and
sewer lines, the relocation of gas and electric lines and rough grading
across the 50 acre project site. The West County Justice Center design is
almost complete and soon will be presented to the Board for their
authorization to issue Project B for bidding. Included in
O'Brien-Kreitzberg & Associates' contract amendment is the provision to
provide project and construction management services required for the
bidding and construction of this $30 million project during the coming 28
to 33 month period. This Consulting Services Agreement is based on a
maximum fee limit for ' each phase of the project, with progress payments
made monthly based on the actual time spent. The phases were anticipated
in the contract with , each phase of work to be negotiated as work
progressed. The remaining funds from each completed phase do not carry
forward to the subsequent phase. To date, none of the phases have used up
the funds authorized. The project remains on schedule and within budget.
In addition to the West County Justice Center project, the County has
identified additional work that must be done to satisfactorily house
current and projected inmate populations and to improve facilities for
certain portions of this population. On January 26, the Board approved the
December 31, 1987 Needs Assessment and Master Site Plan for submission to
the California Board of Corrections, thereby meeting the requirements of
the Proposition 52 legislation for receiving $2. 3 million in state matching
funds for county jail capital expenditures. The $800,000 County match has
been included in this year' s appropriation. Plans for the use of
Proposition 52 funds are:
a. Immediate construction of two 60-bed modular dormitory
buildings at the Marsh Creek Detention Facility.
b. Repairs and alterations to the existing facilities at Marsh
Creek necessary to operate the facility safely in the short
and long term. The construction of additional modular
dormitory buildings is also anticipated after completion of
the Marsh Creek' Master Plan.

C. Remodel of the medical/mental health module at the Martinez
Detention Facility and the conversion of F-Module into a
second medical/mental health housing unit to accommodate the
increase in inmates requiring separate housing because of
medical or mental health problems.
In order to plan, design and construct these altered and new facilities
within the established accelerated schedule, the O'Brien-Kreitzberg &
Associates ' services are being expanded to provide master planning and
project management services for work identified at the Marsh Creek
Detention Facility and to provide project and construction management
services for the work required to remodel and expand the medical/mental
health facilities at the Martinez Detention Facility.
CONSEQUENCES OF NEGATIVE ACTION
If this contract amendment is not approved, the project management
consultant will not be , authorized to start the bidding process for
construction of the detention facility. The subsequent delay will result
in increased construction costs due to escalation and extend the period of
time existing detention facilities will suffer under the pressures of
overcrowding. j
In addition, the work planned for the Marsh Creek and Martinez Detention
Facilities will not be able to proceed in a timely and cost effective
fashion. Of critical importance is the immediate ordering of two 60
modular dormitory buildings needed to provide partial temporary relief to
the serious overcrowded conditions occurring at the Martinez Detention
Facility.
