THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on July 14, 1987 by the following vote:
AYES: Supervisors Fanden, Schroder, and Torlakson,
NOES: None
ABSENT: Supervisors Powers and McPeak left during the course of the
meeting and were not present for the vote.
ABSTAIN: None
SUBJECT: Proposed establishment of the Briones Hill Agricultural
Preserve
This being the time for hearing on the proposed Briones
Hills Agricultural Preservation Agreement which would commit the
County to agree to a policy of non-annexation to urban service
districts and cities for agricultural and open space properties which
would lead to urban development within the area generally located on
the east and south by the Martinez, Pleasant Hill, Lafayette and
Orinda City Spheres of Influence; on the west by the Richmond, San
Pablo, Pinole and Hercules City Spheres of Influence; and on the west
and north from Rodeo to Martinez by the LAFCO adopted sewer sphere of
influence boundary and the Solano/Contra Costa County line, except for
exclusion of the Port Costa Community;
James Cutler of the Community Development Department
reviewed the proposal and the staff report, commenting that discussion
on the protection of the agricultural and open space resources of the
Briones Hills area has been an issue of concern to the County and
adjacent cities for some time, that in 1980 the National Park Service
undertook a study to determine if Federal funds should be utilized to
preserve much of the Briones Hills and that the major finding of the
study was that Federal funding wasn't required because the area could
be protected by local land use controls. Mr. Cutler stated that the
impetus for this particular program was a request from Supervisors
Powers and Fanden calling for the County to work toward an agreement
with affected cities to provide protection to the Briones Hills area
beyond that afforded by the adopted city and county general plans.
The Board on May '22, 1986 requested the Community Development
Department to develop an approach to the problem and appointed
Supervisor Powers and Fanden to represent the County on a committee on
this matter.
Mr. Cutler further advised that there had been discussions
with the city councils and the committee had met to try to develop a
consensus to move forward for adoption of the agreement.
Mr. Cutler advised that he had just last evening received a
telephone request from the City of Lafayette to expand the boundaries
to include certain city-owned open space. Mr. Cutler further advised
that the only other request for modification was from the City of
Hercules in the area of Christie Road. He noted that said request was
not inconsistent with the whole concept.
Mr. Cutler noted that the proposed agreement would not
affect the general plan
Mr. Cutler noted that the existing general plan would not be
affected by the proposed agreement, that people would have to right to

apply for subdivision, that it does not change any general plan
categories and it- does not rezone any land.
Mr. Cutler responded to various inquiries from Board
members.
The Chair recognized the presence of elected officials from
the various cites, and invited those present in the audience to address
the Board on this matter.
Peter Langeley, Councilman for the City of Martinez, advised
that the Martinez City Counsel had not taken a formal action on the
proposal, but Jim Cutler had appeared before the Council and no one
had expressed any opposition. He stated that his personal view was
that it was a good idea, and noted that there are landowners present
who have questions.
Rose Mary Corbin, Vice Mayor of the City of Richmond,
advised that the City Council had not yet voted on the matter, that
Richmond was the City that prompted the proposal because of problems
that have occurred around the City boundaries. She stated that she
supports it.
Erling Horn, City of Lafayette Planning Commission, stated
that the City had not voted on it yet, but that he supports it and the
Vice Mayor supports its.

John Hook, 3169 Tergland Road, Lafayette, representing
property owners in the McKewen/Cummings Skyway area.
Gordon Strain, 5020 Alhambra Valley Road, Martinez
Loma Hallissy, P. 0. Box 517, 3901 Highway 4, Crockett.
Good cause appearing therefore, IT IS BY THE BOARD ORDERED
that the matter is referred to the General Plan Congress, and this
hearing is continued to July 28, 1987 at 2: 30 p.m.
