SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
Recommendation:
Adopt a position in support of AB 54 by Assemblyman Margolin
which would implement a provision -in federal law which permits
states to make ambulatory prenatal care available to pregnant
women under the Medi-Cal Program during a period of presumptive.
eligibility pending a determination of actual eligibility. The
bill also implements a provision of federal law which makes
eligible for Medi-Cal aged and disabled persons with family
incomes up to the federal poverty level as well as pregnant women
and children under the age of 5 .
Background:
Provisions of the Omnibus Budget Reconciliation Act of , 1986 (P.L.
99-509). provide states with the option of making pregnant women
presumptively eligible for Medi-Cal and provide states with the
option of making the aged, disabled, pregnant women and children
under the age of 5 with family incomes not to exceed 100% of the
federal poverty level eligible for Medi-Cal. Assemblyman
Margolin has introduced AB 54 to take advantage of these options.
Under AB 54 a pregnant woman could be determined presumptively
eligible for Medi-Cal, providing she applies for Medi-Cal within
14 days and would continue eligibility until 45 days from the
date of presumptive eligibility or until eligibility is either
approved or denied, whichever comes first. , In addition, the
aged, disabled, pregnant women, and children under the age of 5
would be eligible for Medi-Cal if their family incomes do not
, exceed 100% of the federal poverty level.
These provisions are intended to encourage pregnant women to
obtain proper prenatal care which has been proven to assist in
reducing the possibility of complications at the time of delivery
and the likelihood of low birthweight babies. In addition the
bill would encourage parents, to obtain appropriate medical care
for preschool children which again has been shown to detect and
.treat early ,conditions which could otherwise become much more
expensive when left untreated until later in life. In the case
of the elderly and disabled AB 54 would make additional
individuals eligible for Medi-Cal thereby relieving the county

from paying for the cost of care for these individuals. Finally
AB 54, by making more pregnant woment and young children eligible
for Medi-Cal has the potential of increasing revenue to the
County in treating these individuals and relieves the Public
Health Division of some of the county costs which must be
expended in treating the health conditions which are caused by
the failure to obtain proper prenatal care and postnatal care for
the young babies and children. As a result it is recommended
that the Board of Supervisors support AB 54 as was recommended to
the Board by the Maternal, Child, and Adolescent Health Advisory
Board.
AB 54 has passed the Assembly and is now on referral to the
Senate Health and Human Services Committee.
