SUBJECT: PENDING WATER LEGISLATION 1A, "�'
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
Endorse position of the Committee for Water Policy Consensus to
oppose all water transfer legislation currently proposed by
Senator Ayala and Assemblymember Costa and to terminate any
participation in negotiations on amendments if AB 1710 (Costa)
is passed out of the Assembly without Contra Costa County/CWPC
protections for the Bay-Delta Estuary.
Further, pledge public support for a referendum and/or initiative
to: (a) repeal any transfer legislation signed into law that
allows increases in exports without protections for the Bay-Delta
Estuary; and (b) promote new law to safeguard the bays and estuaries
of California.
BACKGROUND:
Some powerful southern California water interests and politicians
are intent on pushing legislation to increase water exports with-
out Bay-Delta safeguards and are rejecting a consensus approach
to resolving California ' s water problems . I think another Water
War is almost inevitable. The only way it will be averted is if
the proponents of the new water grab understand we are prepared
to referend any legislation signed into law which increases
exports without adequate protections and seriously begin to
negotiate to achieve appropriate safeguards for the Bay-Delta
Estuary by withdrawing the current proposals or making them
2-year bills . This will occur only if we make the necessary
commitment.
I have pledged $10 ,000 to a referendum (if necessary) and an
initiative to promote adequate protections for California ' s bays
and estuaries . A group of environmental organizations and regional
leaders are forming an organizing committee this week. Hopefully,
the individual members of the Contra Costa County Board of
Supervisors will be counted among the first to join the effort.

Also, AUTHORIZED letter to Governor Deukmejian related to his expressed policy
on Bay-Delta Estuary protections. The Board also FINDS, by at least a 2/3 vote of the
Board, that the need to take action on this matter arose after the Board's agenda was
posted, as specified in Goverment Code Section 54954.2 (a) .
