RESOLUTION No . 87/332 SUBJECT: In the Matter of Pay and Performance Evaluation for the Deep Class of Deputy District Attorney Whereas the Board of Supervisors has enacted Resolution 83/1, as amended, referred to as the Salary Regulations, and Section 20 of that Resolution relates to the compensation and terms and conditions of employment in deep classes; and The Board having adopted various resolutions in 1981, 1982, 1983, and 1984 establishing, correcting, and revising selected elements of the pay and performance plan for the deep class of Deputy District Attorney which has resulted in unnecessary administrative duplication; therefore It is By the Board Resolved that effective June 1, 1987 preceding resolutions governing this class, including 81/1388, 82/1449, 83/65, 83/401 and 84/443, are rescinded and superseded by the compensation provisions and terms and conditions of employment contained herein. 1. Salary Range: The compensation in the class of Deputy District Attorney is s set by the Board of Supervisors and reviewed periodically during consideration of compensation for County management classifications. The following basic and advanced salary range correspond with the Deputy District Attorney job specification in which duties and responsibilities are defined. The steps within each level are as follows: Basic Level : Steps 1-11 , Advanced Level : Steps 9-15 LEVEL STEPS SCHEDULE XA-2107 (Effective 7/1/86) 15 outstanding $5196 14 pay levels 5.264 Advanced 13 5135 Level B 12 5007 (steps 9-15) 1 outstanding 4882 K18 0 pay levels 475994639 4525 7 4409 6 4301 Basic 5 4192 Level A 4 4087 (steps 1-11) 3 3986 2 3885 1 3789 RESOLUTION NO . 87/332 Increments between steps are two and one-half percent (2 1/2%) within the salary progression for steps 1-15. For positions given Advanced Level assignments, step 13 is the maximum salary for, satisfactory performance and steps 14 and 15 are reserved for Outstanding Merit Performance salary advancement as provided in Section 9b herein. For positions given Basic Level assignments, step 9 is the maximum salary ford satisfactory performance and steps 10 and 11 are reserved for Outstanding Merit Performance salary advancement as provided in Section 9b herein. 2. Salary on Appointments: Initial appointment into the class of Deputy District Attorney shall be made at any step if the salary range for the level to which the employee is appointed, however, that a promotional appointment to Deputy District Attorney must result in at least a five percent (5%) salary increase, if the salary schedule permits such an adjustment at the Basic Level . Deputy District Attorneys are expected to have access to a privately owned vehicle which may be used during the course of their employment. 3. Salary on Reassignment to Advanced Level : A Deputy District Attorney at a Basic who meets the minimum qualifications for Advanced Level assignment and is reassigned by the appointing authority to the Advanced Level on a permanent basis shall not be placed higher than step 10 irrespective of whether or not this results in a salary adjustment of less than five percent (5%) . Deputy District Attorney who are at step 10 or 11 at the time of reassigned upward shall receive a 2 1/2% increase in pay. Designation of an assignment to Advanced Level is the sole prerogative of the appointing authority. As additional organizational or operational needs arise, Deputy District Attorney positions may be added to or deleted from the Advanced Level . Continued incumbency in any Advanced assignment shall be dependent on the incumbent receiving a satisfactory performance evaluation from the appointing authority or his/her designee immediately preceding completion of six months initial tenure in the assignment and annually thereafter. 4. Temporary Short-Term Reassignments: A Deputy District Attorney who is temporarily reassigned from a Basic Level position to an Advanced Level assignment shall have his/her salary increased on the twenty-first (21st) calendar day of said assignment to that salary step in the Advanced Level which constitutes at lest a two and one-half percent (2 1/2%) increase, but in no case shall. be higher than step 10, and shall continue to receive this pay for the duration of the assignment. A Deputy District Attorney at salary steps 10 or 11 of the Basic Level who is so reassigned shall be placed on the Advanced Level at step 12 and shall continue to receive this pay for the duration of the assignment. Upon termination of the assignment, the incumbent shall immediately revert to the salary step he/she would have received had he/she remained in his/her permanent assignment. Designation of temporary short-term reassignments shall be the sole prerogative of the appointing authority. Short-term reassignments may include, but are not limited to: backup for a Deputy District Attorney on extended sick leave, vacation or leave of absence. 5. Re-Employment: Deputy District Attorneys who terminate their employment with the County in good standing and who are subsequently re-employed as a Deputy District Attorney within their two years period of reemployment eligibility may be appointed at the salary level assignment at which they were employed at the time of their termination provided that a vacant position exists at the level . Said appointment will be at the first salary step of the appropriate schedule, unless otherwise provided for by the appointing authority or designee in which case employees may be appointed up to the salary step of the level at which they were employed at the time of their termination. Definition and Application of Terms: a. Reassignment means the movement of a position and its incumbent, if filled, from on level to, another within the deep class or the movement of an incumbent between positions at the same or different level within the deep class., b. Promotion, Demotion and Transfer - For the purposes of promotion, demotion and trnasfer to and from the deep class of Deputy District Attorney, "salary" refers to :and shall be based on the salary established for each of the levels within the whole deep classification rather than on the bottom and top salary steps of the whole deep class. 7. Anniversary Dates: a. Current Probationary and New Employees - The anniversary date of an employee having probationary status as of the effective date of this Resolution and all new employees appointed at the first salary step shall be the first day of the calendar month after the calendar month when he/she successfully completes six months full-time service, except that when he/she began work on the first regularly scheduled workday of the month for his/her position which was not the first calendar day that month, the anniversary is the first day of the calendar month when he/she successfully completes six months full-time service. b. Reassignment to Higher Level Position - The anniversary date of a Deputy District Attorney who is reassigned to an Advanced Salary Level is determined as for a new employee in "a" above. C. Reassignment to Lower Level Position - The anniversary date of a Deputy District Attorney who is reassigned from an Advanced Salary Level to a Basic Salary Level shall remain unchanged. 8. Performance Evaluation: The performance of each Deputy District Attorney shall be reviewed and evaluated by the appointing authority or designee on or before the employee's anniversary date and annually thereafter. The appointing authority may conduct an evaluation of the employee's performance at a time other than the employee's anniversary date for the purpose of awarding an outstanding performance step increase. 9. Salary Adjustments: a. Merit Adjustment - Based upon a review of each Deputy District Attorney's performance, the appointing authority may authorize a merit adjustment in the salary of that Deputy District Attorney. Such adjustment shall consist of an advancement of the employee's salary by two (2) steps on the appropriate salary schedule established for that level and class of Deputy District Attorney. In the case of less than satisfactory performance, the employee's salary may be held until such time as the performance of the employee is satisfactory. No salary adjustment shall be made unless an affirmative recommendation to do so is made by the appointing authority or designee, and no provision of this section shall be construed to make the adjustment of salaries mandatory on the County. The appointing authority may recommend unconditional denial of the increment; or make the denial subject to review at some date preceding the next anniversary date. The salary of employees who are on leave without pay more than six (6) months during their anniversary year preceding the review date shall be reviewed on the anniversary date. Employees on stipendiary educational leave are 'Er-OL UT1,0N NO ,. 8 i� i32 excluded from the above .six (6) months limitation. Persons on military leave shall receive anniversary increments that may accrue to them during the period of military leave. b. Outstanding Performance Adjustment: If the appointing authority deems that a Deputy District Attorney's performance has been outstanding, the employee's salary may be advanced not more than two steps in any anniversary year on the appropriate salary schedule established for that level class of Deputy District Attorney regardless of the step to which currently assigned. Such adjustment may be awarded on other than the employee's anniversary date only for outstanding merit performance providing that the increment is not effective sooner than 60 days from any merit adjustment granted on the employee's anniversary date. Any additional step(s) awarded to reflect Outstanding Performance shall remain in effect until terminated by the appointing authority. C. Salary adjustments other than Outstanding Merit steps shall be effective on the employee's anniversary date. 10. Salary on Demotion: A county employee who promotes from Deputy District Attorney and is subsequently reinstated to the class as the result of demotion of failing probation will be reinstated to the level he/she attained prior to promotion. Applicable rules on 'layoff and displacement will be effectuated in the event a vacant position, at the level to which the employee is to be demoted, does not exist. An employee who demotes to Deputy District Attorney shall have his/her salary reduced on the appropriate salary schedule to the monthly salary step of Deputy District Attorney which is next lower than the salary he/she received before demotion. In the event this decrease is less than five percent (5%) , the employee's salary shall be adjusted to the step on the appropriate salary schedule that is five percent (5%) less than the next lower step, if the schedule permits such adjustment. Whenever the demotion is the result of layoff, the salary of the demoted employee shall be that step on the applicable salary schedule which he/she would have achieved had he/she remained continuously in the position to which he/she has been demoted, all within range increments being granted on the anniversary dates in the demotional class. If the demotion is a result of a failure of probation, the employee shall be placed at the level and salary step he/she was at prior to being promoted. 11. Salary on Voluntary Demotion: Notwithstanding Section 10 above, whenever any employee voluntarily demotes to Deputy District Attorney at a level which has a salary schedule lower than the class from which the employee is demoting, his/her salary shall remain the same if the steps in the new (demoted) salary schedule permits, and if not, his/her new salary shall be at the step next below his/her former salary. 12. Whenever a permanent employee moves to a Deputy District Attorney position at a work level , the salary schedule of which is allocated to the same salary range as the class of the position which employee previously occupied, the employee shall continue to be compensated at the same step of the salary schedule to which the classes are allocated. 13. Salary on Reassignment from Advanced Salary Level Assignment to a Basic' Salary Level Assignment: An employee who is reassigned from an Advanced Salary Level assignment to a Basic Salary Level assignment shall be placed on that step of salary schedule at which he/she would have achieved had she/he remained continuously in the Basic Salary Level assignment which she/he has been reassigned. Reclassification of Position: The salary of an employee whose position is reclassified from a class on the basic salary schedule to the Deputy District Attorney classification shall be established in accordance with the applicable Sections of this Resolution. An employee's salary who is in a position that is reclassified from Deputy District Attorney to another class on the basic salary schedule shall be determined based upon the Deputy District Attorney salary for his/her level and the provisions of Resolution 83/1 or other applicable deep class resolutions or ordinances. 15. Seniority: An employee's seniority for layoff and displacement purposes in the deep class of Deputy District Attorney shall be determined by adding (a) his/her length of service in other classes at the same or higher salary levels as determined by the salary. schedule in effect at the time of layoff and by adding (b) his/her length of service in the abandoned classes of Deputy District Attorney III and IV to other service described in (a) above. Employees reallocated to a deep class because the duties of the position occupied are appropriately described in the class shall carry into the deep class the seniority accrued or carried forward in the former class and seniority accrued in other classes which have been included in the deep class. Service for layoff and displacement purposes includes only the employee's last continuous permanent County employment. Other rules affecting seniority are contained in the Personnel Management Regulations. Additionally, a. For purposes of layoff and displacement, no incumbents who occupy lower level assignment positions shall be considered as meeting the position requirements for higher level positions. b. For purposes of layoff and displacement, incumbents in higher level positions shall be considered as meeting the position requirements for lower level assignment positions. C. Notwithstanding (b) above, incumbents of higher level positions may not displace into positions requiring special licenses, experiences or skills, such as bilingual proficiency, unless they possess such licenses, experiences or skills. 16.
