SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND Alm JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for AB 1109 by Assemblyman Tucker
which, as amended April 20, 1987, would require the assessment of
a $5.00 processing fee for each disbursement of monies collected
under a writ of execution, attachment, possession, or sale to be
deposited in a special fund. Of the deposits to this special
fund, 60% would be expended to supplement the County' s cost for
vehicle fleet replacement for the Sheriff and the Marshal. Forty
percent of the special fund would be expended to supplement the
County' s cost of vehicle maintenance for the Sheriff and the
Marshal.
BACKGROUND:
Existing law establishes a fee for keeping and caring for
property under a writ of attachment, execution, possession or
sale. AB 1109 would, in addition, impose a processing fee for
disbursing money collected under such writs. A separate
accounting would be made of the fees deposited by the Sheriff and
Marshal and could only be used in support of the department which
deposited the funds. As is noted above, these fees would be used
to supplement the County' s cost for vehicle replacement and
maintenance for the Sheriff and Marshal.
Since AB 1109 would improve the quality of the vehicle fleet for
the Sheriff and Marshal and the maintenance of their respective
fleets at no cost to the County, the bill would have the
long-term effect of reducing County costs for vehicle maintenance
and replacement. It, therefore, deserves the support of the
Board of Supervisors. AB 1109 is supported by the Marshal.
