RECOMMENDATION•
Adopt a position of support for AB 689 by Assemblyman Robert
Campbell which authorizes the California Highway Patrol (CHP) to
close a highway to hazardous materials and hazardous waste
transportation where the highway is located within the watershed
of a drinking water reservoir and is within 1/2 mile of the
shoreline of that reservoir.
BACKGROUND:
Concern has been expressed for some time by members of the Board
about the possibility of a spill of hazardous materials or
hazardous waste on San Pablo Dam Road where the spill could
contaminate the San Pablo Reservoir. Public Works staff have
concluded that the only feasible solution is to amend legislation
which would authorize the CHP to close a highway, such as San
Pablo Dam Road, where a spill could contaminate the water supply.
In working with Assemblyman Campbell' s office and the East Bay
Municipal Utility District, it has been decided that legislation
is the best solution to this problem. The result is AB 689.
Under current law, the CHP is authorized to close a highway to
vehicles transporting hazardous materials or hazardous waste if
specified requirements are met, including that the highway is
less safe than a reasonable alternate highway, as determined by
using specified federal guidelines, which requires surveys of
accident data and other information which proves that the highway
proposed for closure is less safe than an alternate route.
AB 689, as amended on May 14, removes the need to prove that the
highway is less safe by specifying that a highway is appreciably
less safe if it is located within the watershed of a drinking
water reservoir and if the reservoir' s shoreline 'is located
within one-half mile of the highway. This would allow the CHP,
upon passage and signature of AB 689, to close San Pablo Dam Road
to the transportation of hazardous materials and hazardous waste.
