THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on June 23 , 1987 by the following vote:
AYES: Supervisors Fanden, Torlakson, Schroder
NOES: None
ABSENT: Supervisors Powers and McPeak
ABSTAIN: None
SUBJECT: Administrative Appeal of George Harris, Rainbow Homes,
Inc. , on Development Plan 3039-87 and Subdivision 6501,
West Pittsburg Area.
The Chair convened the hearing on the appeal of George Harris,
Rainbow Homes, Inc. , 529-C Garcia Avenue, Pittsburg 94565, from the
decision of the Community Development Director denying his request for
a revision to an approved Development Plan 3039-87 and Subdivision Map
6501 in the West Pittsburg area. A copy of the report from Harvey
Bragdon, Director of Community Development, is attached and included
as a part of this document. Mr. Bragdon recommended denial of the
appeal.
Supervisor Torlakson noted that the number of units to be
constructed is less than what was originally approved. He expressed
the opinion that the reduced density would have less impact on the
surrounding area. He advised that the developer would incur delays in
the construction schedule of the project if the application process
would have to be reinitiated.
James Snow, 2727 Alhambra, Martinez, owner/developer, appeared to
address the issue of the appeal.
All persons desiring to speak having been heard, the public
hearing was closed.
On recommendation of Supervisor Torlakson, IT IS BY THE BOARD
ORDERED that the appeal of George Harris, Rainbow Homes, Inc. , is
GRANTED with the condition that a revised subdivision map must be
filed and that any additional staff costs related to the revised plan
would be accounted for and billed to the developer.

SUBJECT: Appeal from George Harris, Rainbow Homes, Inc.
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION-
Deny appeal for waiver of- development plan and subdivision
application requirements.
BACKGROUND:
On July 13 , 1984, James Snow (applicant) and M.C.S. Corporation
(owner) submitted requests for rezoning from D-1 to M-29, and
development plan approval and subdivision approval to divide 2 . 5
acres into 68 condominiums in the West Pittsburg area. The
filing fee was $4 , 855. 00.
The items were subsequently scheduled for hearing before the
County Planning Commission on September 25, 1984, and later
rescheduled to October 9, 1984 , whereat they were approved. An
extension of time for the final map was requested on June 9 ,
1986, and later withdrawn on June 24, 1986 .
Mr. Harris met with Community Development staff on April 24 ,
1987, to discuss the procedure for gaining approval of a revised
map which would retain the existing site plan but reduce the
number of units to 34. Staff reviewed the revised plan and found
that even though the number of units were reduced, there was no
evidence that the project impacts would be reduced accordingly.
Staff found that the revised plan was not in substantial
conformance with the approved development plan, DP 3039-84 and
Subdivision 6501 and informed Mr. Harris that a new application
would be required with the following fees:
Development Plan - Flat fee: $1 , 330
- 34 units @ $20/unit 680
Subdivision - Flat fee 980
- 34 units @ $90/unit 3 , 060
Total $6,050

Fees are established by code and there is no provision for
waiving them for situations like this. Further, staff has a
concern that the public would not have the opportunity to comment
on the project if the amended plans were able to be approved
administratively.
