RECOMMENDATIONS
1. Approve Rezoning Application 2692-RZ as recommended by the
East County Regional Planning Commission;
2. Approve Development Plan 3045-86 and Tentative. Subdivision Map
6837 with conditions as recommended by the East County
Regional Planning Commission (attached as Exhibit A) ;
3. Adopt the East County Regional Planning Commission findings as
set forth in Resolution No. 16-1987 as the determinations for
these actions;
4. Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set date for the adoption of same.

The Chair opened the public hearing and the following people appeared

project and Doug Flett, 1280 Civic Drive, Walnut Creek, representing
Mr. Connor. The Public Hearing was closed. On recommendation of
Supervisor Torlakson, IT IS BY THE BOARD ORDERED that recormnendations
1 and 3 are APPROVED; and recommendation 2 is approved with amended
conditions, Exhibit A attached, ; and as suggested in recommendation 4,
Ordinance No. 87-47 is INTRODUCED, reading waived and July 7, 1987 is
set for adoption.

CONDITIONS OF APPROVAL FOR SUBDIVISION 6837 AND FINAL DEVELOPMENT PLAN 3045-86
AS AMENDED
1. This application is approved as generally shown on Tentative Map dated
August 28, 1986, as received by the Community Development Department.
2. Development has been proposed in six phases. Phase One through Five are
approved as indicated with the attached conditions. Phase Six will be
delayed no longer than 90 days to allow staff and the applicant to discuss
further design considerations. At the end of 90 days or upon agreement, a
Supplemental Staff Report shall be prepared for Phase Six with a
recommendation and, if necessary, additional conditions of approval for
Phase Six only.
3. This approval is based upon plans dated received by the Community
Development Department August 28, 1986 as follows:
a. Grading and improvement plans
b. Tentative Map
C. Landscape plans
d. Floor plans and elevations
e. Colored plates of site and elevations
4. This application is contingent upon approval of 2692-RZ.
5. Prior to the issuance of any permit on this site, including but not limited
to, grading, building, or filing of any Parcel Map, the following action
shall be completed:
A. A detailed report shall be submitted to the Community Development
Department, at least 45 days prior to the application for a permit or
filing of any map. The report shall identify the source, quality
processing, distribution and facilities for the proposed water supply
system.
B. The report shall be reviewed by the Contra Costa County Health
Department. The Director of the Health Services Department shall
notify in writing the Director of the Community Development Department
of acceptance of the proposed water supply facility plans.
C. Prior to the filing of the Parcel Map, the applicant shall submit
evidence to the Community Development Department of the creation and
implementation of the Water Utility District or other water supply
system. The review and approval of the water supply system by the
Director of the Health Department shall accompany the Parcel Map.
6. A maximum of 236 residential units is approved.
7. If archaeologic materials are uncovered during grading, trenching or other
on-site excavation, earthwork within 30 meters of these materials shall be
stopped until a professional archaeologist who is certified by the Society
for California Archaeology (SCA) and/or the Society of Professional
Archaeology (SOPA) has had an opportunity to evaluate the significance of
the find and suggest appropriate mitigation measures, if they are deemed
necessary. 2 q

8. Covenants, Conditions and . Restrictions, Articles of Incorporation and
By-laws for a mandatory homeowners association shall be submitted prior to
the recording of the Final Map. These documents shall provide for
establishment, ownership and maintenance of all project facilities,
including common open space and waterway areas, walkways, fencing, land-
scape maintenance, etc.
9. Development rights for the common open space areas of this subdivision
shall be deeded to the County with the Final Subdivision Map.
10. Development rights for the remaining portions of the parcel , generally
described as the Bethel Island Golf Course, shall be deeded to the County
with filing of the Final Parcel Map.
11. The applicant, heirs, and his successors in interest, shall be responsible
for the operation and maintenance of the open space areas described in
Condition #9.
12. The applicant shall implement measures to guarantee a stable lake level and
to provide adequate water quality in the lake system. Maintenance, future
improvements and water quality in the lake system shall be specifically
addressed in the covenants, conditions and restrictions (CC & R's) .
Maintenance shall include limiting the growth or removal of algae and water
hyacinths.
13. The applicant shall submit three proposed street names to Community
Development Department, Graphics Section, for review and approval of a
minimum of 30 days prior to filing of final map.
14. Building numbers shall be illuminated and posted in a position visible from
the street.
15. Applications for development plans approvals for multiple family residen-
tial projects will indicate a suitably enclosed area for the purpose of
locating recycling bins for paper, glass and cans. For projects of 50
units or less, such area will not be less than 10 feet by 12 feet in area,
and the enclosure shall be at least six feet high. For projects of more
than 50 units, proportionately greater areas will be required. This area
will be included in the computation of the 25 percent of lot "open area"
required of such development plans.
16. The applicant shall prepare a study to identify those units of the
subdivision hazarded by golf balls. The study shall be submitted at least
45 days prior to the filing for a final Parcel Map. The study shall be
subject to the review and approval of the Zoning Administrator and shall
include:
a. The means used to identify hazarded units,

b. Safety measures proposed to protect residents of those units,
C. And language to be added to each title of the hazarded unit notifying
potential buyers of the hazards.
17. The Bethel Island Golf Course (APN 029-050-045) shall remain public. The
applicant shall pay the park dedication fees required by ordinance at the
time of the building permit issuance. The applicant shall be credited
against 100% of these fees as per the Park Dedication Ordinance for the
golf course land dedicated to remain in public use.
18. Compliance with the Federal Flood Insurance Administration regulations for
residential development in flood hazard areas will be required.
19. The guide for development and use provisions shall be the P-1, Planned Unit
Development. Any modification of the requirements shall be subject to
review and approval of the Zoning Administrator.
20. Prior to the issuance of building permits, elevations and architectural
design of buildings shall be subject to final review and approval by the
Zoning Administrator.
A. The roofs and exterior walls of the buildings shall generally be free
such objects as air conditioning equipment, television aerials or
shall be screened from view.
B. Buildings shall be combinations of two and three story building
heights as indicated on submitted plans.
C. All residential units shall have illuminated house numbers or unit
identification visible from the street.
D. A sample exterior color and texture board shall be prepared for review
and approval of the Zoning Administrator.
21. Landscaping plans submitted December 22, 1986 are approved with the
following requirements:
A. Landscaping and irrigation shall be installed prior to occupancy.
B. Additional landscaping along the south property line shall be included
and a revised schematic submitted for the review and approval of the
Zoning Administrator.
C. Native plants shall be used as much as is feasible in the landscaping
plan.
22. Comply with the recommendations of the geotechnical consultant report by J.
H. Kleinfelder & Assoc. through November 18, 1986, to improve site soils'
liquefaction resistance, as approved by the Planning Geologist. Soils of
all building areas (6 phases) and utility and service line areas are
required to be improved as necessary prior to issuance of Building
Department permits (except any necessary permits for soil improvement) .

23. The applicant shall study and review the feasibility of using concrete
piles for all structural foundations. This study shall be prepared by the
applicant's soil engineer or other designated engineer. The study shall be
presented to the Zoning Administrator for review and approval at least 30
days prior to filing of the Final Parcel Map.
24. Comply with drainage, road improvement, traffic and utility requirements as
follows:
A. In accordance with Section 92-2.006 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision
Ordinance (Title 9) . Any exceptions therefrom must be specifically
listed in this conditional approval statement.
B. The following exception to Title 9 is permitted for this subdivision:
1) Chapter 96-10, "Underground Utilities".
C. Construct necessary longitudinal and transverse drainage and pavement
widening on Gateway Road to provide a 16-foot wide painted median and
16-foot travel lanes with 4-foot graded rock shoulders at the westerly
access to this development. The applicant shall submit a scaled
drawing of the proposed intersection layout to the Public Works
Department, Road Engineering Division, for review and approval prior
to commencing work on the improvement plans.
D. Contribute $2,099 per unit to a Road Improvement Fee Trust (Fund No.
819200-0800) designated for road improvements along Cypress Road
and/or Bethel Island Road between State Highway 4 and this
development. Prior to filing of the Final Map for each phase, the
applicant shall be required to contribute the per unit amount for the
units in that phase.
E. Install shielded street lights on Gateway Road. The final number and
location of the lights shall be determined by the County Traffic
Engineer.
F. Construct a 20-foot paved private roadway to County private road
standards, within a 25-foot access easement, to serve all parcels in
this proposed subdivision. The access roads serving the units in Lot
2, Lots 3 and 4, and the units in Lot 6 shall be widened to a 28-foot
width within a 40-foot access easement, constructed to those same
standards.
G. Furnish proof to the Public Works Department, Engineering Services
Division, that legal access to the property is available from Gateway
Road along both access roads.
H. Provide emergency access between the access road serving Lot 2 and
Bethel Island Road, and also between the access roads serving Lot 4
and Lot 6. Construct the emergency access roads as 16-foot

all-weather roads within 25-foot access easements constructed to
current County private road standards. The alignment shall be subject
to the review and approval of the Zoning Administrator.
As an alternate, the applicant shall submit a letter from the Fire
District stating that:
1) The Fire District accepts the applicant's modified proposal .
2) The Fire District assures the County that they can move their
heaviest piece of equipment along the emergency access in all
weather conditions.
I . Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance
for the East/Central County Travel Corridor Area of Benefit as adopted
by the Board of Supervisors.
J. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across driveways.
K. Furnish proof to the Public Works Department, Engineering Services
Division, of the acquisition of all necessary rights of entry, permits
and/or easements for the construction of off-site, temporary or
permanent, road and drainage improvements.
L. The applicant shall construct a sewage collection system to Contra
Costa County Sanitation District No. 15 standards, dedicate the sewage
collection system and all necessary easements to the District, obtain
a District Permit to connect to the collection system and pay all
applicable fees prior to the start of construction.
M. The applicant shall develop a water source that meets all County and
State regulations, construct a water distribution system, dedicate the
water source, water mains along with all necessary easements to Contra
Costa County Sanitation District No. 15, and pay all applicable fees
prior to the start of construction.
N. Comply with the Federal Emergency Management Agency National Flood
Insurance Program and related regulations which includes the
following:
1) Designing -structural components to prevent flotation, collapse or
permanent lateral movement of the building during floods. .
2) Using building materials and utility equipment resistant to flood
damage. All building machinery and equipment must be elevated
above the base flood/elevation.
3) Limiting uses in spaces below the base flood elevation to
vehicular parking, limited storage and building access.

4) Enclosing spaces below the base flood elevation shall be designed
to minimize buildup of flood loads and withstand those loads.
0. Prior to issuance of building permits, file the Final Map for
Subdivision 6837.
25. On the provision of police service, the applicant agrees to vote their
property into a special tax area for police service at an initial level of
$100 per parcel annually. This amount shall be adjusted yearly according
to the Bay Area CPI. Furthermore, the Board of Supervisors shall review
the assessment amount and adjust it to a higher level as conditions warrant
it.
26. The applicant shall pay a traffic mitigation fee for the impact of traffic
through the Oakley area. The amount shall be up to $1,000 per unit until a
fee is determined through the Bethel Island Specific Plan process and
public hearing at the Board of Supervisors or instituted by a standard
regional traffic mitigation fee for new development.
The applicant shall comply with the following advisory conditions:
1. Contra Costa County Health Services Department:
A. All living units must connect to Sanitation District #15.
B. The proposed community water supply must meet Title 22 requirements
and County Water Standards.
2. Bethel Island Fire Protection District: Comply with the requirements of
the Fire Protection District (see attached letter) .

SUBJECT: In the Matter,of Adopting Report, Determining Lack of Majority Protest,
Establishing Area of Benefit, and Establishing Estimated Costs, Cost
Allocation, Fee Apportionment. East/Central County Travel Corridor
(Unincorporated)
The Board of Supervisors of Contra Costa County FINDS that:
Government Code Section 66484 and Division 913, Title 9, of the Contra Costa
County Code provide for assessing and collecting fees for bridge and/or major
thoroughfare construction within a designated Area of Benefit as a condition of
approval of a final subdivision map or as a condition of issuing a building
permit; and
The Public Works Director and the Director of Community Development have
completed a Development Program Report for the unincorporated East/Central County
Travel Corridor Area of Benefit which was filed with the Clerk of the Board.
Notice of the hearing was duly given in accordance with Goverrment Code Sections
65091, 65962 and 66484; and
For the purposes of compliance with CEC,A, the County is considered the lead
agency for the project involving the establishment of the area of benefit, the
collection of fees, and the construction of the road improvements. A Negative
Declaration pertaining to this project was published. No protests were received
during the review period. The Board hereby CONCURS in the findings that the
project will not have a significant effect on the environment and hereby DIRECTS
the Director of Community Development to file a notice of Determination with the
County Clerk; and
The improvements described in the Development Program Report are necessary
and desireable within the Area of Benefit, in that the improvements furnish a
direct, efficient and cost-effective means of moving traffic within the Area of
Benefit, and in that the improvements are required to reduce the traffic
congestion, delay, economic loss, stressful driving conditions and degradation of
air quality within the Area of Benefit.
This Board hereby DETERMINES that a majority protest does not exist, inasmuch
as a written protest has not been filed by the owners of more than one-half of
the area of the property to be benefited by the improvements; and
This Board hereby ADOPTS the Development Program Report pertaining to the
East/Central County Travel Corridor Area of Benefit, its boundaries, estimated
cost of improvements, cost allocation, method of fee apportionment and provision
that the interest accrued on the fees collected in this Area of Benefit shall
continue to accumulate in the same account and shall be used to cover the cost of
administration, design and construction of the fee area improvements; and
The Board hereby INTENDS to adopt the following fee schedule by ordinance,
as recommended in the Development Program Report: Residential Family Dwelling
Unit, $230/unit.
The Board hereby RESOLVES that
a. The Public Works Department and the Department of Community Development
are DIRECTED to work with communities in the East/Central County Travel Corridor
area and with local and State agencies in periodically reviewing the fee schedule
for the Board of Supervisors' consideration.

The Board of Supervisors of Contra Costa County ordains as follows:
SECTION I. Summar . This ordinance provides for the adoption of fees to
e co ected rom residential developments proposed in the East/Central
County Travel.Corridor Area of Benefit to fund road improvements along that
corridor.
SECTION 11. Authority. This ordinance is enacted, in part, pursuant to
overrurent Cade §66484 and Division 913, Title 9, of the Contra Costa County
Ordinance Code.
SECTION III. Notice andHearing. This ordinance was adopted pursuant to
t e procedure set ort in Uoverrunent Code §65962 and 66464 and Ordinance
Code Division 913, and all required notices have been properly given and
public hearings held.
SECTION IV. Findings. In adopting this ordinance, the Board finds that
the failure to require payment of the fee described in this ordinance as a
condition of issuing a building permit or equivalent permit would place the
residents of the subdivision, immediate community and fee area in a condition
perilous to their health and safety, in that the failure to promptly fund
necessary improvements to the East/Central County Travel Corridor will
result in continuing and additional traffic congestion, delay, economic
loss, stressful driving conditions and reduction in air quality.
SECTION V. Fee Adoption. The following fee is hereby ADOPTED for the
ast/Central County Travel Corridor Area of Benefit to fund road improvements,
as established by Resolution 86/545 , dated September 16, 1986, and shall be
LEVIED and COLLECTED pursuant to the above authorities:
Residential Family Dwelling Unit $230/unit
The fee shall be payable as specified in Chapter 913-4 of the Contra Costa
County Ordinance Code.
SECTION VI. Fee Area. The fee described in this ordinance shall apply to
a property re-scribed in Exhibit A attached hereto.
SECTION VII. Severability. If any fee or provision of this Ordinance is
e inva id or unenrorceable by a court of competent jurisdiction, that
holding shall not affect the validity or enforceability of the remaining fees
or provisions, and the Board declares that it would have adopted each part
of this Ordinance irrespective of the validity of any other part.
SECTION VIII. Effective Date. This Ordinance shall become effective 60
aysatter an within 15 days of passage, shall be published once
with the names of the Supervisors voting for and against it in the Contra
Costa Times, a newspaper of general circulation published in this County.

_ (Urgency Pleasure for Interim Authorization
to Adopt Road Fees for
East/Central County Travel Corridor Area of Benefit)
The Board of Supervisors of Contra Costa County ordains as follows:
SECTION 1. SUMMARY. This ordinance provides for the adoption of an urgency
measure as an interim authorization for fees to be used for major thoroughfare
improvements within the East/Central County Travel Corridor Area of Benefit,
which improvements are needed to protect the public health, safety and welfare.
SECTION II. FINDINGS. The East/Central County Travel Corridor (Highway 4),
ocat� ed between the cities of Antioch/Pittsburg and the cities of Concord/Martinez,
is the major regional access route between East Contra Costa County and the
central part of the county.
The Board finds that:
The East/Central County Travel Corridor is currently inadequate in lane
capacity to serve peak hour traffic generated by residential development,
particularly in the westbound direction between Bailey Road in Pittsburg and
Willow Pass Road in Concord. This segment of the travel corridor is now
experiencing travel delays of 10 minutes or more on a daily basis.
There is an urgent need for an interim fee as the inadequacy of this segment
of the major access route causes significant congestion, delay and economic
loss to the entire East County Region. The resulting stressful driving
conditions and reduction in air quality are adverse factors affecting the
public health, safety and welfare.
Housing construction activity is expected to be very heavy in the near
future for the unincorporated areas of .East Contra Costa County. The
corresponding increase in peak hour traffic along the travel corridor will
further reduce the quality of travel along this important route.
Failure to adopt an interim fee at this time will result in a loss of
potential revenues as residential units are built without having to contribute
to the proposed improvements.
The inability to finance construction of improvements to the East/Central
County Travel Corridor is detrimental to the public health, safety and
welfare.
Failure to require paynent of the fee described in this ordinance as a
condition of issuing a building permit or equivalent permit would place the
residents of the subdivision, immediate community and fee area in a condition
perilous to their health and safety, in that the failure to fund necessary
improvements to the East/Central County Travel Corridor will result in
continuing and additional traffic congestion, delay, economic loss, stressful
driving conditions and reduction in air quality.
The Board also finds that:
The adoption of an interim fee at this time will allow the immediate
collection of revenues from residential units. The end result will be to
decrease travel delay, relieve traffic congestion, and thus, protect the
public health, safety and welfare.
SECTION 111. AUTHORITY. This ordinance is enacted, in part, pursuant to Government
odl�Sections 6 9952 and 66484, and Division 913 of the Contra Costa County
Ordinance Code.
SECTION IV. NOTICE AND HEARING. This ordinance was adopted pursuant to the
procedure set forth in Government Code Sections 65962(c) and all required notices
have been properly given and public hearings held.
SECTION V. FEE ADOPTION. The following interim fee is hereby ADOPTED for the
East/Central County Travel Corridor Area of Benefit to fund the major thoroughfare
improvements described in the Area of Benefit report on file with the Clerk of
the Board, and shall be LEVIED and COLLECTED pursuant to the above authorities:
Residential Family Dwelling Unit $230 per unit
The interim fee shall be payable as specified in Chapter 413-4 of the Contra
Costa County
�Ordinance Code.

Railroad, 97.7 feet north of the northwest corner of the railroad station,
43.2 feet north of the north rail of the main tracks, 19.7 feet south of the

Dear Ms. Kestly:
We have reviewed the Application for a Development Plan dated
August 28 , 1986 , for the subject project. The development is to
consist of 170 condominium units distributed among several multi-
unit residential structures, an 80-unit motel structure, and a
golf course. This project is regulated in part by codes and
ordinances administered by this Fire District relative to Contra
Costa County Ordinance 86-68 . If approved by your office, the
following shall be included as Conditions of Approval:
1. The developer shall submit two ( 2) . complete sets of
plans and specifications of the subject project,
including any required built-in fire protection systems,
to the Fire District for review and approval prior to
obtaining building permits for construction to insure
compliance with minimum requirements related to fire and
life safety.

2. The developer shall provide an adequate and reliable
water supply for fire protection as set forth in the
Uniform Fire Code.

According to available information, there are no
existing water supply facilities in the area which are
adequate to provide the fire flow ( 3 , 000 GPM) required
for the subject project. In order to satisfy Fire
District requirements, additional built-in fire
protection shall be provided.

3 . The developer shall provide all structures with an
approved automatic fire sprinkler system designed and
installed in accordance with the requirements and
guidelines of the Fire District.
The developer shall provide fire-retardant roof
coverings, as defined in the current edition of the
Uniform Building Code.
Prior to issuance of a building permit for any
construction, the developer shall submit plans and
specifications with regard to built-in fire protection
features required, to the Fire District for review and
approval.

4. The developer shall provide fire hydrants of the East
Bay type, each incorporating one ( 1 ) 4-1/2" and two
( 2 ) 2-1/2" independently-valved outlets. Cost of the
installation to be borne by the developer.
Location of hydrants will be determined by the Fire
District upon submittal of two ( 2) copies of a tentative
map or site plan.

5. The developer shall provide access roadways with all-
weather driving surfaces of not less than 20 feet of
unobstructed width, and not less than 131 - 6" of
vertical clearance, to within 150 feet of all portions
of the exterior walls of every building. Access roads
shall have a minimum centerline turning radius of
40 feet and must be capable of supporting the imposed
loads of fire apparatus ( 30 tons) .

6 . Dead-end fire department access roads in excess of 150
feet long shall be provided with approved provisions for
the turning around of fire department apparatus.

7 . Access roads and water supply shall be installed and in
service prior to combustible construction.

8 . The developer shall provide illuminated addressing
located on all buildings in such a manner as to be
plainly visible and legible from the street or road
fronting the property.

9 . All open spaces , when left in their natural state, shall
meet the Fire District ' s weed abatement standards.

It is requested that a copy of the completed Conditions of
Approval for the subject project be forwarded to this office when
compiled and adopted by the planning agency.
